Applicant seeks relief from the provisions of Appendix A-
Description of Variance: Comprehensive Zoning, Section X—Supplemental Regulations
Paragraph (8) Floor Elevation above sea level. Applicant seeks relief from the minimum 8.5 feet
above MSL, to permit the finished floor areas of the remodeled expanded floors shown on
attached survey to meet existing structure floor level of 8.33 +/- feet above MSL.
Subject Property is described as: Lot 175, and the Northern portion of Lot 176, according to the
Plat recorded in Palm Beach County Plat Book 25, Pages 7—15, inclusive.
Justification for Variance: Please attach a letter addressing:
1. The six (6)•criteria of the Village of Tequesta's zoning code section XIII (E) (1)
(b) 1-6,which are attached to this application.

• 2. If the variance request is related to the public waters of the State of Florida,
comprising the Loxahatchee River and the Intracoastal l Waterway,including
all creeks,canals or tributaries therewith,the applicant must:
•
a. Attach a letter addressing the ten (10) criteria listed in zoning code
section XVI (G) (2) a-j,which are attached to this application.
b. If the variance is in regard to a dock,the applicant must provide a
Special Purpose Survey indicating the plan view and elevation view of
the dock referenced to the NGVD. The plan view of the survey must
indicate the dock, Riparian Lines, setback of the dock and associated
piles from the Riparian Line,or extended property line where
appropriate. The elevation view must delineate the depth of the water
at ten (10) foot intervals from the mean low water line for the entire
length of the dock (inclusive of all moorings,boat lifts and any other
structures appurtenant to the dock). Accurate tide and water level data
for the site must be included on the drawing.Twelve (12) signed and
sealed copies of the survey at a legible scale must be provided.
NOTE: In addition to those items listed above,the applicant shall include the
following items with the application:
1. Current survey of the property indicating all structures and setbacks.
2. Drawing to scale of the proposed improvements.
3. Written approval from the property owner,if other than the applicant.
4. Any other documentation pertinent to this application.
5. Copies of all submittals as follows:
a. Board of Adjustment Request: Two (2) signed and sealed 24"X 36" and
ten (10) 11"X 17" copies of all surveys.
b. Village Council: eight (8) signed and sealed 24"X 36" and eight (8)
11" X 17" copies of all surveys.
6. Application Fee:
a. Single family $ 300.00
b. Duplex $ 500.00
c.Multiple family $ 750.00
d. Commercial .$1,000.00
The Department of Community Development must be in receipt of the completed
application and fee 30 days prior to the meeting date.The Board of Adjustment meets the
third Monday of each month,while the Village Council meets on the second Thursday of
each month.

Dear Property Owner:
As the owner of property in the Village of Tequesta, Florida, located within 300 feet of ,
the below referenced property, you are hereby notified that the Village of Tequesta Board
of Adjustment will hold a Public Notice at 7:00 P.M. April 19, 2004, in the Village
Recreation Center, 399 Seabrook Road, Tequesta, Florida to consider:
An application from Stephan H. & Mary Louise Osburn, owner of the property
located at 216 Country Club Drive, Lot 175 and the northern portion of Lot 176,
according to the Plat recorded in Palm Beach County Plat Book Page 25, Pages 7-15,
requesting a variance to the terms of the Official Comprehensive Ordinance No. 355,
as amended, Section X. Supplemental Regulations Applying to a Specific, to Several
or to all Districts, Subsection (A) General Provisions, (8) Floor elevation above sea
( level; to allow for the finished floor areas of the proposed remodeled floor expansion
and additions indicated on the attached survey to the existing house floor elevation of
8.33' (feet) above mean sea level (MSL), or 18+ inches above the crown of road, to
match the rest of the house, in lieu of all new construction, additions, and substantial
improvements to existing structures being 8.5' MSL or 18" above the crown of the
road, cul-de-sac or highway or meet the requirements of Section XV, Flood Hazard
Areas, whichever is more stringent, as required by the Zoning Ordinance.
You are advised that if any person decides to appeal any decision made by the Board of
Adjustment with respect to any matter considered at the Public Hearing, he will need a
record of the proceedings, and for such purpose he may need to ensure that a verbatim
record of the proceedings is made, which record includes the testimony upon which the
appeal is to be based. PLEASE GOVERN YOURSELVES ACCORDINGLY.

Dear Mr. &Mrs. Osburn:
This letter is to confirm the action of the Village of Tequesta Board of Adjustment at their April 19,
2004, Public Hearing approving your application as the owners of the property located at 216
Country Club Drive, Lot 175 and the northern portion of Lot 176, according to the Plat recorded in
Palm Beach County Plat Book Page 25, Pages 7-15, requesting a variance to the terms of the
Official Comprehensive Ordinance No. 355, as amended, Section X. Supplemental Regulations
Applying to a Specific, to Several or to all Districts, Subsection (A) General Provisions, (8) Floor
elevation above sea level; to allow for the fmished floor areas of the proposed remodeled floor
expansion and additions indicated on the attached survey to the existing house floor elevation of
8.33' (feet) above mean sea level (MSL), or 18+ inches above the crown of road, to match the rest
of the house, in lieu of all new construction, additions, and substantial improvements to existing

Please note that this variance shall expire within six (6) months from the date of grant, unless a
building permit based upon and incorporating the variance is issued within the aforesaid six-month
period and construction has begun thereunder. The action of this Board has no bearing or
relationship to any other approvals or permits which may be required.
