Workshop STAFF MEMO Meeting: Workshop - Jul 29 2024 Staff Contact: Jay Hubsch Department: Community Development ITOMM Discussion on Commercial Zoning Overlay's At the July 13th Regular Council meeting, the Village Council voted 3-2 to delay adoption of Ordinance 1-24 (Commercial Overlays) to further workshop the definition of formula business and to consider development incentives. Staff gave a presentation at the July 1 Council Workshop on formula businesses and possible development incentives. At that meeting, all major concerns with formula businesses were resolved, but Council requested further information on development incentives. Development Incentives The concept of allowing limited development incentives has been discussed at previous Council meetings, at the July 1 workshop, and at the May 16 Local Planning Agency meeting. The property owners of 1 Main Street have attended those previous meetings and claimed that they would be able to donate a larger civic open space to the Village if they were able to be granted development incentives. One of the big questions that came up at the July workshop was whether it would be appropriate to only allow development incentives in limited areas, such as the Village Center Overlay or Mixed-Use Zoning District. The Village Master Plan ("Master Plan") does highlight the 1 Main Street property as one of four "Priority Civic Open Space" locations in the Village. The other three locations are all public property. Additionally, in the Key Recommendations section in the Master Plan, Priority Action Item E is to "Consider Appropriate Development Incentives for Town Center and Main Street". Town Center is what the Village Center Overlay was called in the Master Plan. Lastly, the Local Planning Agency voted 3-1 to recommend that Council adopt the commercial overlays, but delay adoption of the Village Center Overlay and to workshop incentives with the owner of the 1 Main Street Property. Based on this information, it does appear to be appropriate to consider development incentives in limited areas of the Village, such as the Village Center Overlay. There has also been discussion about whether or not the Village shall adopt development incentives at all. The Village Master Plan states, "The concept of development incentives was raised during the Village of Tequesta planning process and there was little to no interest in raising building heights or increasing densities. Should the Village reconsider this concept at some point, regardless of the incentives being offered, it is recommended that the affected areas be limited and precise. There should be a clear and transparent process which specifically articulates the incentives offered and the public benefits gained." Page 37 of 51 Agenda Item #3. While the concept of outright incentives was rejected during the Master Plan process, all six tables at the Master Plan charettes designed a significant amount civic open space for the 1 Main Street property during charettes. The Master Plan states, "During the April 2022 public design charrette, it was made clear to the team that some form of public open space needs to be retained through redevelopment within the Paradise Park (1 Main Street) parcels." Without the provision of incentives in exchange for civic open space, it may be difficult for the Village to ever ensure that significant civic open space is provided at 1 Main Street, or other parcels during redevelopment. This concept is also supported by the Comprehensive Plan. Policy 1.16.5 of the Future Land Use Element of the Comprehensive Plan states "The Village shall consider providing incentives to developers to preserve trees and natural resources to encourage additional tree plantings and green areas". Staff will provide a more comprehensive presentation at the July 29th workshop about development incentives.
