RESOLUTION NO. 39-99/00
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AWARDING A CONTRACT TO REESE, MACON
& ASSOCIATES, INC. , OF LAKE WORTH, FLORIDA,
TO DESIGN THE PHASE I WATER DISTRIBUTION
SYSTEM IMPROVEMENTS FOR THE TEQUESTA
PENINSULA IN THE AMOUNT OF $66, 500, HAVING A
FY 1999/2000 WATER ENTERPRISE FUND,
ENGINEERING SERVICES BUDGET ALLOCATION OF
$100, 000, AND AUTHORIZING THE VILLAGE MANAGER
TO EXECUTE THE APPLICABLE CONTRACT ON BEHALF
OF THE VILLAGE.

NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY,

Section 1 . A contract with Reese, Macon & Associates,
Inc . , of Lake Worth, Florida, to design the Phase I
Water Distribution System Improvements for the
Tequesta Peninsula, attached hereto as Exhibit "A" and
incorporated by reference as part of this Resolution
is hereby approved, and the Village Manager of the
Village of Tequesta is authorized to execute the same
on behalf of the Village .
THE FOREGOING RESOLUTION WAS OFFERED by Council
member who moved its adoption. The
motion was seconded by Councilmember
and upon being put to a vote, the vote was as follows :

The Mayor thereupon declared the Resolution duly
passed and adopted this 13th day of January, A.D. ,

RE: Water Distribution System Improvements - Phase I
Country Club and Bermuda Terrace
Gentlemen:
We are pleased to submit this proposal for engineering services in connection with design,
permitting and bidding of the above referenced project. REESE, MACON and ASSOCIATES,
INC., hereinafter referred to as the Engineer, shall perform the services as documented below for
The Village of Tequesta, hereinafter referred to as the Client.
SCOPE
The Engineer understands this authorization is to cover engineering services related to the
design, permitting and bidding of the water main replacement and associated appurtenances
within the Country Club and Bermuda Terrace subdivisions. The following specific tasks will be
performed by the Engineer:
1. Prepare design plans and specifications for the water main system improvements. The
improvements will consist of replacing the existing cement asbestos (AC)pipe with either
PVC/DIP/HDPE. All new services up to the existing meter box, hydrants, and valves are
also included. The existing AC pipe will be abandoned in place and filled with
grout/flowable fill.
2. Attend two (2) meetings with ENCON and the Village to coordinate the design aspects as
they relate to the proposed sewer project.
3. Prepare and submit, where applicable, permit applications with support documentation to
the following agencies:
► Palm Beach County Engineering
► Village of Tequesta
► Palm Beach County Health Department
4. Prepare an updated Engineers estimate of construction.
5. Prepare bid documents, advertise the project, respond to questions from potential bidders,
attend bid opening, evaluate the bids and make a recommendation of award.

The above scope is predicated on the assumption that the Client shall furnish, at no cost to the
Engineer, all available pertinent information including previous reports, plans, specifications,
permits and other data relevant to the performance of the above services for the project. In
addition, the Client shall designate, in writing, a person to act as the representative for services
performed under this agreement.
The following specific information and/or items shall be furnished at no cost to the Engineer:
1. Surveys, topographic, property,boundary, right-of way, permanent reference monuments,
permanent control points and plats.
2. Data prepared by or services rendered by others such as subsurface explorations laboratory
tests and inspections of samples.
4. All permit application and government inspection fees.
TIME OF PERFORMANCE
The Engineer understands the urgency of this project and will complete the work commensurate
with ENCON's sewering project which is anticipated to start mid February 2000, exclusive of
delays beyond the control of the Engineer.
FEES
For Scope Items 1-5 the Engineer shall be paid a lump sum fee of Sixty-Six thousand Five
Hundred Dollars ($66,500.00).
If services are required in the performance of the above scope, beyond those normally provided
by the Engineer, which must be sublet, the Engineer shall order the work after obtaining the
written authorization of the Client. The subcontractor shall bill the work directly to the Client. If
the Engineer is requested to subcontract the work directly, a 10%handling charge will be added
to the subcontractors invoice.
Invoices for services rendered are issued on a monthly basis and are due within thirty(30) days
of the invoice date. Interest at a compound rate of one and one-half percent per month shall be
charged to any past due statements. Interest shall be computed on past due statements from the
date of the invoice.
COST ESTIMATES
Construction cost estimates are developed from knowledge of market conditions and based on
the experience of the Engineer. However, the Engineer exercises no control over the competitive
bidding process and, therefore, makes no guarantee of the accuracy of the estimate when
compared to previous estimates or actual bids.

TERMINATION
This agreement may be terminated by either party by giving thirty (30) days written notice. The
Engineer shall be paid for all services rendered prior to the termination date.
ACCEPTANCE
Acceptance of this proposal may be indicated by executing this document in the space provided
below. This contract shall be considered void if not executed within thirty(30) days from the
above date. Upon execution of this agreement the Client shall return one copy to the Engineer.

Subject: Resolution Approving a Contract with Reese, Macon and Associates,
Inc. for Tequesta Peninsula Water Distribution Improvements
Over the last several months various Village Council Members have expressed their
desire to improve Village infrastructure on the Tequesta Peninsula in conjunction with
the Loxahatchee River Districts sewer installation project. The Utilities Department has
partially fulfilled this request in that all applicable infrastructure design details and permit
applications are complete with the exception of those for the water system distribution
system.
Reese, Macon and Associates, Inc. (RMA) scope of services (Exhibit "A") provides
assistance in completing the Council's request and includes:
1. Preparation of water distribution improvement design plans and specifications
2. Permitting assistance
3. Construction cost estimating
4. Preparation and coordination of multiple bid documents for the peninsula •
project
The total costs for these services is $66,500 and funding will be provided for from the
Water Enterprise Fund, Engineering Services Account having a Fiscal Year 1999/2000
budget allocation of $100,000.
Please place the resolution approving RMA's scope of services to design and permit the
Tequesta Peninsula Water Distribution System Improvements on the January 13, 2000,
Village Council Meeting Agenda for consideration by the Members.
