Date: July 12, 2000 Subject: Agenda Item - July 20, 2000, Village Council Meeting; Resolution Authorizing Reese, Macon & Associates, Inc. Providing Services to Tequesta Country Club Drainage Easements The attached Reese, Macon & Associates, Inc. proposal to perform survey, legal description and sketches for easements in the Tequesta Country Club is to complete a 1979 Drainage Agreement. The easements were inadvertently not recorded with the original document. Although the Tequesta Country Club and the Village of Tequesta have worked together in good faith under the existing drainage agreement, the easements need to be properly recorded to ensure a harmonious relationship. The drainage easements are utilized to move water in large drainage pipes to and from the golf course pond network to provide neighborhood stormwater flood relief, storage, recharge and cleansing prior to discharge. Sketch "A" provided in the RMA proposal identifies the approximate locations of the 10 easements. A field survey will verify and document the actual positions for record. This issue was brought to light with the Tequesta Peninsula Stormwater Improvement Project. RMA was requested to provide a proposal since they are the engineer of record for the Tequesta Peninsula project. Although this is not a planned aspect of the Tequesta Peninsula Project, the $6,650 funding for this project is available in the Tequesta Peninsula project as a result some cost- saving measures implemented by staff. Please place this item on the July 20, 2000, Village Council Meeting for Council's consideration. A Resolution authorizing the Acting Village Manager to execute the Service Agreement with RMA under their master engineering contract on behalf of the Village is attached. JFG/mk RESOLUTION NO. 70-99/00 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING A PROPOSAL WITH REESE, MACON & ASSOCIATES, INC. , OF LAKEWORTH, FLORIDA, FOR ENGINEERING/SURVEY SERVICES IN CONNECTION WITH TEQUESTA COUNTRY CLUB DRAINAGE EASEMENTS, PHASE II, IN THE AMOUNT OF $6, 650 . 00, HAVING AN FY 1999/2000 BUDGET ALLOCATION OF $500, 000 WITH FUNDS BEING APPROPRIATED FROM THE TEQUESTA PENINSULA CAPITAL PROJECT FUND AND AUTHORIZING THE VILLAGE MANAGER TO EXECUTE THE APPLICABLE PROPOSAL ON BEHALF OF THE VILLAGE. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Engineering/Survey Services in connection with Tequesta Country Club Drainage Easements, Phase II, with Reese, Macon & Associates, Inc . , of Lake Worth, Florida, attached hereto as Exhibit "A" and incorporated by reference as a part of this Resolution is hereby approved and the Acting Village Manager of the Village of Tequesta is authorized to execute the same on behalf of the Village of Tequesta. Reese, Macon and Associates, Inc., hereinafter referred to as the Engineer, shall perform the services as documented below for the Village of Tequesta, hereinafter referred to as the Client. SCOPE The following specific tasks will be performed by the Engineer: 1. Perform the necessary field work (survey) to define the locations of the pipe outfalls into the golf course ponds and the interconnecting pipes between the ponds. 2. Prepare eleven(11) land descriptions/sketches of the drainage pipes within the golf course. 3. Provide three(3) sets of land descriptions/sketches for the Village's use in having their legal counsel review and prepare the documents for recording within the County. The above scope is predicated on the assumption that the Client shall furnish, at no cost to the Engineer, utility personnel to assist in locating/exposing drainage structures and pipe, all available pertinent information including previous reports, plans, specifications, permits, plats, existing survey information and other data relevant to the performance of the above services for the project. TIME OF PERFORMANCE The Engineer will commence work within ten (10) days of receipt of an executed authorization. FEES For Scope Items 1 through 3, the Engineer shall be paid according to the following schedule on the basis of actual time spent plus any applicable sales tax and reimbursement for non-salary expenses including, but not limited to, automobile travel at $.30/mile, reproduction and long distance . telephone. We estimate the total cost for the services provided under the Scope Items will not exceed Six Thousand, Six Hundred and Fifty Dollars ($6,650). This amount shall not be exceeded without prior written approval by the Client. Project Manager $70.00/HR. Senior Engineer $65.00/HR. Engineer/Sr. Technician $55.00/HR. Designer $50.00.11R. Draftsman $40.00/HR. Technician $37.50/HR. Secretary $25.00/HR. If services are required in the performance of the above scope, beyond those normally provided by the Engineer, which must be sublet, the Engineer shall order the work after obtaining the written authorization of the Client. The subcontractor shall bill the work directly to the Client. If the Engineer is requested to subcontract the work directly, a 10% handling charge will be added to the subcontractor's invoice. Invoices for services rendered are issued on a monthly basis and are due within thirty (30) days of the invoice date. Interest at a compound rate of one and one-half percent per month shall be charged to any past due statements. Interest shall be computed on past due statements from the date of the invoice. TERMINATION This agreement may be terminated by either party by giving thirty (30) days written notice. The Engineer shall be paid for all services rendered prior to the termination date. 2 ACCEPTANCE Acceptance of this proposal may be indicated by executing this document in the space provided below. This contract shall be considered void if not executed within thirty (30) days from the above date. Upon execution of this agreement, the Client shall return one copy to the Engineer.
