Meeting was called to order at 10:03 A.M. A Code Enforcement Special Master Torcivia approved the minutes of the January 27, 2000 hearing as submitted. B. Fine Imposition Hearings: None C. Violation Hearings: Case No. 9925686 Thomas F. Westoff 55 River Drive Tequesta, Florida 33469 Legal: TEQUESTA Lt 18 60-42-40-26-01-000-0180 Nature of Violation: Violation of Tequesta Code of Ordinances, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific,to Several to all Districts(L) Commercial Vehicles and SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES February 24, 2000 Page 2 Trucks, Recreational Vehicles on Private Lots, (3), Page No. 1185. The Respondent, Thomas F. Westoff, was present at the hearing. Code Enforcement Officer Sgt. Irovando testified to the violation. Conclusion of law was that Respondent is in violation of Appendix A, Section X (L)(3) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Thomas F. Westoff, shall comply with AppendixA, Section X(L)(3), of the Code of Ordinances of the Village of Tequesta by the 26th day of February, 2000. ff Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Code Enforcement Officer Sgt. Irovando testified to the violation. Conclusion of law was that Respondents are in violation of Appendix A, Section X (L) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents,Alberto and Pamela G. Sorzano, shall comply with Appendix A, Section X (L) , of the Code of Ordinances of the Village of Tequesta by the 26th day of February, 2000. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Running at Large. Prohibited, Page No. 259. The Respondent, Louis J. Rivera, was present at the hearing and testified to the measures he was taking to contain his pet inside the fence. Code Enforcement Officer Sgt. Irovando testified to the violation. Sgt. Irovando testified further that the property lies close to a school. 3 SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES February 24, 2000 Page 4 Conclusion of law was that Respondent is in violation of Chapter 4, Article II, Sections 4-13 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Louis J. Rivera, shall comply with Chapter 4, Article II, Sections 4-13, of the Code of Ordinances of the Village of Tequesta by the 26th day of February, 2000. If Respondent does not comply within the time specified, a fine of One Hundred Fifty dollars ($150.00)per day shall be assessed for each day the violation continues to exist. Should a dispute arise concerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. Case No. 002974 Heide A. Wilkinson 68 Azalea Circle Tequesta, Florida 33469 Legal: RIDGEWOOD HOMES SEC 3 Lt 92 60-43-40-30-07-000-1920 Nature of Violation: Repeat Violation of Tequesta Code of Ordinances, Chapter 4,ANIMALS AND FOWL,ARTICLE II Dogs and Cats,Sec. 4-, 13,. Running at Large. Prohibited, Page No. 259. The Respondent, Heide A. Wilkinson, was present at the hearing and testified that she had given up her dog to animal rescue. Code Enforcement Officer Sgt. Irovando testified to and produced photographs of the repeat violation. Conclusion of law was that Respondent is in violation of Chapter 4, Article II, Sections 4-13 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Heide A.Wilkinson's fine of fifty dollars ($50.00) is hereby waived. 4 SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES February 24, 2000 Page 5 Case No. 20649 Patrick A. Joseph 328 River Drive Tequesta, Florida 33469 Legal: TEQUESTA Lt 95 & 1/2 OF ABANDONED ROAD ROW 60-42-40-26-01-000-0950 Nature of Violation: Violation of Tequesta Code of Ordinances, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific,to Several to all Districts (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots, (3), Page No. 1185. The Respondents, Patrick A. O'Sheasy and Amelia M. Joseph,were not present at the hearing; however, there was a finding of proper notice. Code Enforcement Officer Sgt. Irovando testified to the violation. Conclusion of law was that Respondents are in violation of Appendix A, Section X (L)(3) of the Code of Ordinances of the Village of Tequesta. The Respondents, Christopher B. and Ana G. Marsh, were not present at the hearing; however, there was a finding of proper notice. Code Enforcement Officer Sgt. Irovando testified to the repeat violation. Conclusion of law was that Respondents are in violation of Appendix A, Section X (L)(3) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Christopher B. and Ana G. Marsh, shall comply with Appendix A, Section X (L)(3) , of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia further ordered that Respondents, Christopher B. and Ma G. Marsh, shall be assessed a fine of fifty dollars ($50.00) and that said fine shall be paid by March 20, 2000. A copy of this Order shall be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondents, pursuant to Chapter 162, Florida Statutes for the original amount. Davis 286 Country Club Drive Tequesta, Florida 33469 Legal: TEQUESTA Lt 157 60-42-40-26-01-000-1300 Nature of Violation: Violation of Tequesta Code of Ordinances, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific,to Several to all Districts (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots, (3), Page No. 1185. The Respondents, John P. Flanagan and Kathleen L. Davis, were not present at the hearing; however, there was a finding of proper notice. Code Enforcement Officer Sgt. Irovando testified to the violation. Conclusion of law was that Respondents are in violation of Appendix A, Section X (L)(3) of the Code of Ordinances of the Village of Tequesta Special Master Paulette Torcivia ordered that Respondents, John P. Status Hearings: Case No. 9926162 V 0 Properties Richard Osterer 945 Spring Road Pelham Manor, New York 10803-2714 Nature of Violation: Violation of Tequesta Code of Ordinances, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific,to Several to all Districts (H) Landscaping General Requirements (15) Maintenance Required, Page No. 1178.8. The Respondent, V 0 Properties, was not present at the hearing. Code Enforcement Officer Sgt. Irovando testified that the landscaping was being maintained, that after the last hearing everything had been corrected, and that Respondent was in full compliance. No order was issued by the Special Master. E. Fine Reduction Hearings: None F.
