Bradford, Village Manager From: Joann Manganiello, Assistant Village Manager/Village Clerk Date: April 6, 2000 Subject: Resolution No. 54 - 99/00-Approving a Temporary Employment Agreement for Acting Assistant Village Manager Position;Agenda Item Per your direction, I sought out the services of a professional with municipal government administrative experience to assist me during the interim period before the hiring of a new Village Manager. Fortunately, Richard Diamond, former Assistant City Manager for the City of Palm Beach Gardens, with whom we are both acquainted, is available and interested in working for the Village of Tequesta in this temporary position. A copy of Mr. Diamond's resume is enclosed for your information and review. As you can see, Mr. Diamond has the qualifications and experience to serve in this position. Also, enclosed is a Temporary Employment Agreement for the Acting Assistant Village Manager position which was prepared by the Village's Labor Attorney, Michael Whalen. Mr. Diamond has reviewed the Agreement and has agreed to the provisions of temporary employment contained therein. As we discussed, the recommended rate of compensation per hour is $32.00. This hourly rate is less than the hourly rate paid to me when you consider my salary and benefits. Funds are available in the Village Manager's Personal Services Salaries and Wages Account to provide for Mr. Diamond's services in this fiscal year. Please place Resolution No. 54-99/00 on the April 13, 2000, Village Council Meeting Agenda for consideration by the Village Council. Thank you. February 1987—March 1992. City Manager,City of Palm Bay, Florida. Full- service city of 67,000 and one of the fastest growing cities in Florida Over 500 full-time employees, 65 square miles of territory, and over$30 million budget. Six bargaining units. Accomplishments: • Consolidated departments/functions through administrative staff reorganization. • Implemented contract services and privatization of some municipal functions_ • Reduced citywide departmental operating expenditures. • Negotiated settlement of lawsuit with adjacent city over disputed sewer charges. • Completed construction of new city hall,police station, public works facility, and fire stations_ • Negotiated purchase of private water and sewer facilities_ • Consistently received the GFOA distinguished budget award_ • Revised developed impact fees for police, fire,recreation, and transportation improvements • Initiated a stormwater utility program. • Reduced annual debt service through bond refinancing. • Doubled CDBG funding(to$400,000 annually)through negotiated interlocal agreement with county. • Bargained with six labor unions. • Negotiated land acquisition and monetary payments as part of banlauptcy settlement with largest developer in State_ • Served on the Technical Advisory Committee(TAC)of the Brevard Metropolitan Planning Organization(MPO). Vol. 2, No. 2. 1998. ! - a ' RESOLUTION NO. 54 - 99/00 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING A TEMPORARY EMPLOYMENT AGREEMENT FOR THE ACTING ASSISTANT VILLAGE MANAGER POSITION WITH FUNDS BEING ALLOCATED FROM THE VILLAGE MANAGER' S PERSONAL SERVICES SALARIES AND WAGES ACCOUNT, HAVING A FY 1999/2000 BUDGET AMOUNT OF $173 , 300, AND AUTHORIZING THE ACTING VILLAGE MANAGER TO EXECUTE THE APPLICABLE AGREEMENT ON BEHALF OF THE VILLAGE. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. A Temporary Employment Agreement for the Acting Assistant Village Manager Position, attached hereto as Exhibit "A" and incorporated by reference as a part of this Resolution, is hereby approved and the Acting Village Manager of the Village of Tequesta is authorized to execute the same on behalf of the Village of Tequesta. MAYOR OF TEQUESTA ATTEST: Joann Manganiello Village Clerk word/mydocuments/resolutions/54-99-00 "Exhibit A" . • TEMPORARY EMPLOYMENT AGREEMENT This Temporary Employment Agreement ("Agreement") is made and entered into this day of April, 2000, by and between the Village of Tequesta ("Village") and Richard Diamond ("Diamond") . The Village has a temporary need for an individual to assist the Acting Village Manager during an interim period before the hiring of a new Village Manager (approximately three (3) months), and Diamond desires to be temporarily employed by the Village to perform such duties as required by the Acting Village Manager. Accordingly, the parties agree to Diamond's temporary employment under the following terms and conditions. 1. Position and Title. Village agrees to employ Diamond as an Acting Assistant Village Manager. 2. Duties. Diamond shall perform such duties as those performed by an Assistant Village Manager, and shall have such additional duties, responsibilities and authority as may from time to time be determined by the Acting Village Manager. 3. Term. The term of this Agreement shall be indefinite, and it is terminable at the will of either party for any or no reason upon two (2) weeks written notice. 4. Compensation and Related Matters. During the term of this Agreement, Diamond shall be compensated at the rate of per hour. It is anticipated that Diamond shall work 37.5 hours per week as scheduled by the Acting Village Manager. Diamond may be permitted time off without pay to attend to other matters at the discretion of the Acting Village Manager. 1 4 Temporary Employment Agreement Page 2 5. Benefits and Personnel Policies. - Diamond shall receive no other compensation or benefits except as required by state or federal law (e.g., workers' compensation) . Diamond shall receive a copy of the Tequesta Employee Handbook at the time of initial employment, and he is responsible for compliance with .General Personnel Policies (pages 3-8) and Standards of Conduct (page 30) . Except for General Personnel Policies and Standards of Conduct, Diamond is not covered by the Village's Employee Handbook, including its Employee Benefits and Grievance Procedure, and he does not have a property right in employment. 6. Termination. Diamond's employment hereunder may be properly terminated by either party with or without cause upon two (2) weeks written notice. The Village may substitute pay in lieu of notice in the discretion of the Acting Village Manager. 7. Complete Understanding. This Agreement represents the entire understanding between Village and Diamond regarding the subject matter of this Agreement, and it cannot be altered by oral agreements, statements or representation. 2 Temporary Employment Agreement Page 3 IN WITNESS WHEREOF, the parties have executed this Agreement as of the date and year first above written.
