Irwin, Planner ' Date: August 3, 2000 Subject: Site Plan Review for an application from Sprint PCS for a Telecommunication Tower as provided by Section X (A)(f), Wireless Telecommunication Towers and Antennas, of the Village of Tequesta Zoning Ordinance No. 355, as amended, to allow for an approximately 156.5'(foot) tall telecommunications facility (monopole) at the Village of Tequesta Water Treatment Plant located at 901 Old Dixie Highway, within the C-2, Community Commercial Zoning District of the Village of Tequesta. According to Section X, Supplemental Regulations, (f) Wireless telecommunication towers and antennas, (D) Permitted uses, (1)(iii), prior to the granting of a building permit a duly noticed (1000' notification) and advertised public hearing is required by the Village Council. The applicant is proposing erecting a 156.5' (foot) telecommunications tower on the Village of Tequesta Water Treatment Plant Property. Antennas or towers located on property owned or leased by the Village of Tequesta within the commercial zoning district of the Village are a permitted use provided certain conditions are met. The applicant must have a lease authorizing a tower approved by the Village Council. The applicant has worked with the Village Administration is creating a lease to be approved by the Village Council. Also, the proposed tower must meet all regulations of the Village relating to setbacks, height, lot coverage, landscaped open space, and other such regulations. Finally, the applicant must attend a duly noticed and advertised public hearing. The public hearing has been advertised fifteen (15) and five (5) days prior to the public hearing in the Jupiter Courier and letters of notification have been sent to property owners within 1000' feet of the tower site. The Village owned property lies within the Village of Tequesta C-2 Community Commercial District. Antennas and towers are a permitted use on Village owned property in the commercial zoning districts of the Village. The code requires the following for a permitted use tower/antenna located on Village property. • A lease approved by the Village Council authorizing the antenna/tower. • The tower meets all sit regulations of the Village relating to setbacks, height, lot coverage, landscaping, and other such regulations. • An advertised public hearing and notice to residents within 1000 feet of the proposed tower site. The Tequesta R.O. Treatment Plant is located at 873 Old Dixie Hwy. Directly South of the property is a Assisted Living Community Campus located within the Mixed-Use Zoning District. East of the proposed site is the County Line Plaza Commercial Center located within the C-2 Community Commercial District. West of the proposed site is the FEC Railroad property. North of the proposed site is residential homes located within unincorporated Palm Beach County. Staff Report and Comments: An informal Development Review Committee process was performed on July 11, 2000. Chief Steve Allison, Chief Jim Weinand, Gary Preston, Joe Grusauskas, and Scott Ladd were all represented in the review. States review,comments and requests are outlined below: Comments by Scott D.Ladd,Director of Community Development: • Need a line of sight drawing for this proposed tower from the tower location at the well field outward to the adjacent property lines in each compass direction. • The total height of this proposed tower seems excessive and there does not appear to be any convincing justification presented with this proposal for this extreme height. • The sample tower photographs that were submitted with this proposal are of much shorter towers. We need some photographs of comparable towers to the proposal before us. • There is a security concern that I have with regard to section 6. (c)on page 2 of the Communications Site Lease Agreement(Ground) that was submitted to us by the applicant. Security must be maintained at our Water Plant Facilities and this section of the Agreement indicates that this would not be possible unless an exterior access way be installed that does not enter or go through our fenced in Water Plant Facilities in order to get to the cell tower site. • A tower of the intended height being requested by Sprint could create a major hurdle for the Village with regard to any future annexation proposals from the county unincorporated areas adjacent to our Well Field/Water Plant site. Comments by Joe Grusauskas,Utilities Director: • Provide swale along the roadway for the three lift station sites. • Relocate the Live Oak at lift station#2 so that it does not block the visibility of automobiles and pedestrians. The Village suggests interchanging the placement of the Live Oak and the three cabbage palms. Comments by Gary Preston,Director of Public Works& Recreation: • No comment. Comments by Chief Steve Allison,Police: • The Police Department has reviewed the plans submitted for the proposed Sprint PCS Telecommunications Tower. Our concerns are security issues for the Utilities department property and facilities created by the proposed unrestricted access to the site. Staff Recommendation: Please provide responses to the comments offered by the Department Heads. I have asked the RF Engineers to provide the necessary detail information and justification for the height. • The submitted sample photographs demonstrate the different types of antenna mounts. Not all of the towers depicted are 150' tall. Security is a matter of great concern to ?CS. Sprint PCS does not intend to diminish the level of security for the plant in any vuay. There are many cell sites in locations with extreme security and Sprint has been able to obtain the required reasonable access to the site to operate and maintain its facility. As we have explained, once the facility is constructed, access to the site will be by Sprint PCS --cchnicians who monitor and service the site. These individuals have high levels of security 2r?rce. Sprint PCS performs ail maintenance and services during low traffic periods in '' e hours of the night. Sprint PCS typically services sites during day only in the case of emergency or an equipment change. The posed telecommunications tower is similar with these uses and consistent with the purpose and intent for such property in the comprehensive plan for the Village of Tequesta. I am also not aware of any provision of the comprehensive plan for the County that is negatively impacted by our proposed use. PCS LICENSED SURVEYOR Memorandum of Proposal of Sprint PCS Development Review Committee (DRC) Application Village of Tequesta Site # MI42XC057 Sprint PCS, lessee of certain property owned by the Village of Tequesta, requests Development Review Committee (DRC) approval for property located in Section 30, Township 40 South, Range 43 East, Palm Beach County so that a building permit may be issued for the location. Sprint PCS proposes to construct a 156.5 foot high (measured from finish grade) PCS monopole on the aforesaid property. According to the Village of Tequesta Zoning Maps, the subject site lies in the Commercial 2 (C-2) zoning district. Per the Village of Tequesta Zoning Ordinance, the construction of the monopole requires Development Review Committee (DRC) approval in the C-2 zoning district. The subject sites is presently partially developed and supports a water treatment plant and preserve area. The proposed monopole is immediately adjacent to the base of a much larger guy tower that has been previously removed. FOUNDATION FOR THE DRC APPLICATION The Development Review Committee (DRC) approval requested here by Sprint PCS is sought pursuant to and in the spirit of the Village of Tequesta Zoning Ordinance, as well as the 1996 Federal Telecommunications Act, 47 U.S.C. §332(c)(7). Based on current PCS technology, the proposed use is necessary to promote the public interest at this location. The use is designated, and will be operated and maintained by Sprint PCS, so that the public health, safety and welfare will be protected. Other property in the neighborhood will not be harmed by the proposed use, and granting of the DRC approval will not impair a supply of light and/or air to adjacent property, increase traffic, adversely impact adjoining property or residential areas of the Village or otherwise endanger the public safety. The proposed monopole meets the established setbacks of the Village of Tequesta Zoning Ordinance. The proposed monopole is located within a large commercial parcel of land supporting a water treatment plant. The proposed tower is not located within 1,500 feet of any other telecommunication tower or monopole. There are no structures, existing communications towers or monopoles within the geographic area that meets the engineering requirements of Sprint PCS. The proposed development is in compliance with the Buffering requirements of the Zoning Ordinance. No advertising signs are proposed with this development. The proposed antenna mounting system is an adequate camouflage technique consistent with the existing use of the site. The design of the monopole and antenna mounting system minimizes any perceived or identified impacts on adjacent residential areas and the community. The proposed tower is designed to support a minimum of three arrays of antennas. Sprint PCS has master agreements with the telecommunications providers in Village of Tequesta and makes all of its towers available for collocation to all of these carriers on a first come basis. The tower therefore qualifies and meets the standards for a "Multiple antenna/tower plan." Most of the existing Sprint PCS towers support at least one additional carrier. Many existing Sprint PCS sites currently supports three (3) sets of antennas. To ensure all sites are made available for collocation, Sprint PCS has established a separate group to assist and administer all applications for collocation. All sites are secured by means of a fence. In addition, all equipment is locked and inaccessible. The local exchange carrier (telephone company) provides backhaul for Sprint PCS. The need for additional sites in the future is primarily dependent on the service demands placed on any cell site. Like any other infrastructure, a cell site has capacity limitations. Sprint PCS designs its sites with the ability to add additional equipment to a cell site to address additional capacity. However, the ability to expand the capacity at a cell site is limited. 2 The purpose of the Development Review Committee (DRC) requested by this application is founded in large part upon a very real and substantial need to improve wireless telephone service to the general public and to the citizens of Village of Tequesta, which service is guaranteed to those persons by the Federal Government through the Federal Communications Commission. At present, approximately 1,500,000 people in the Treasure Coast area, and 32% of the households nationwide use wireless or PCS phones, with more signing up every day for service. Wireless technology is being used more and more as an emergency back-up communication system. Sprint PCS provides enhanced 911 service wherever it is available. The majority of emergency calls are initiated from a wireless telephone. In the event of a hurricane, power outage or flood, wireless technology is frequently the only form of telecommunications still operable. Sprint PCS is a relative new entrant to the wireless communications market in Village of Tequesta. Sprint PCS was a successful bidder in a Federal Communications Commission auction for the band of radio frequency on which the Sprint PCS telephones will operate. One of the principal goals of PCS is to improve the quality of wireless telephone service and, ultimately, it is expected that wireless telephones will replace landline telephones in their entirety. By carefully planned site selections and placement of PCS sites in Village of Tequesta, the local consumer of wireless telephone services is provided with an increasingly better quality product which enhances the ability of that consumer and all persons in this area to conduct their business and affairs in the Village. It should be specifically noted that the proposed monopole is designed to accommodate "co-location" by another PCS or cellular carrier of its antennas on the same structure. This will reduce the need for additional towers or monopoles in the area. In short, this proposal is in the best interests of the Village, the community and the neighborhood. 3 To ensure all collocating carriers preserve the camouflage character and design standards of this proposal, Sprint PCS proposes that the Village impose a condition of approval requiring any additional antenna installations on the monopole use similar antenna mounting systems as specified in our application. :.•.
