Right-of-Way that is the southern most seven hundred and three point thirty
one feet (703.31') of the thirty foot (30') right-of-way, identified as Tequesta
Drive, and commonly known as Country Club Drive, on the Plat of Tequesta,
as recorded in Plat Book 25, Page 8, Public Records of Palm Beach County,
Florida. James Ryan, Esq. as agent.
Attached are nineteen (19) sets of packets, including an original, for the above referenced
subject. Please place this item on the January 13, 2000, Council agenda. Staff recommends
approval.

Ladies and Gentlemen:
I have been retained by Mr. Walker, Mr. and Mrs.Burchart, Mr. and Mrs. O'Brien, and
Mr. and Mrs. Legato, the owners of Lots 10, 9, 4 and 3 of the Plat of Bayview Terrace
respectively. On their behalf I am submitting the required Power of Attorney forms for each of
them together with this statement of reason for abandonment, and a survey of the subject property
with legal description and a list of the names and addresses of all adjacent property owners. Also
included are copies of consent letters from F. P. &L, Southern Bell, Tequesta Water Department
and Adelphia.
The primary reasons for the abandonment request are the danger and nuisance which
exist under the present conditions. Further, the right-of-way is not developed or maintained in
compliance with the standards established by today's codes and ordinances.
Specifically the ordinances which establish today's ordinances relative to this right-of-
way are: Article IV, §3 (1), (2), (3), (4), (5), (9), (10), (11), (15), §4(4), Article VII, §9 (M)(2),
(3) and Article IV. B. (13). The existing condition of the subject property does not comply with
these ordinances respectively for the following reasons:
1. The very existence of a right of way in this location is not in conformity with the
Village in relation to existing and planned development. When this right of way
was created, it was intended to provide access to another property which no
longer needs or uses the right-of-way in question.
2. It does not create any added convenience to the Village as a whole and it
certainly is not the most advantageous development for the surrounding
neighborhood. To the contrary, it creates a nuisance and numerous safety

hazards which diminish the value of the surrounding property and tax base. As
such,the right-of-way presents substantial potential liability by the Village to any
one injured or damaged because of the Village's failure to maintain the property
in a manner consistent with those in the rest of the community as well as the
Village.
3. The property is not improved and/or maintained as other public roads in the
Village. It seems inappropriate that the Village should continue to own property
dedicated as a road right of way and fail to install the improvements consistent
with those in the rest of the community.
4. The right of way in question is only thirty feet wide and therefore, does not meet
the minimum width for a road as required by the Village code.
5. Even though the right of way is a dead end right of way the Village has not
constructed adequate improvements to discourage through traffic.
6. Recently improvements have been constructed on one adjacent property owner's
property which violate the non-access reservation which exists along the rear
property line of all abutting property owners.
7. Tequesta Country Club was developed to be consistent with the front set backs
being measured from the paved street and the rear setback being measured from
this supposed right of way. Use of the property in a manner inconsistent with
this not only violates said non-access reservation along the rear property line, but
it also further diminishes property value, enhances the dangers and calls into
question why the Village has failed to prevent the recent improvements which
appear to be illegal non-conforming uses.
8. Being only 30' wide,the right-of-way is not even considered a half street. "No
partial streets, less than half the width of the nonpartial portions of the street are
permitted by the Ordinance unless essential." Certainly there is no essential use
for this property, and the rest of Country Club Drive is 80' wide.
9. There is no land owned by the Village of Tequesta for implementation of a cul de
sac or other turnaround facility as required by ordinance. It certainly would be
less expensive to the Village tax payers to have this property abandoned rather
than to do the necessary taking of neighboring property and install the required
cul de sac and to widen the right-of-say to conform to the ordinances.
10. Since the property really has no essential purpose it cannot be considered a road
right of way. As such it is more appropriately categorized as an alley. Dead end
alleys, however, are to be avoided where possible. Certainly there is no need for
such an alley since all properties adjacent to this right of way have better, safer,
more easily regulated means of access.
11. To be a road right of way,the parcel would need to be widened by 20' to meet
the minimum width requirement of 50' in addition to paving a road on the 50'
wide strip of land,the Village would also be required to install a raised curb and
possibly lighting.
12. In the event the right of way is not abandoned and not developed into a road, but
is maintained as an alley, it exceeds the maximum width for alleys by 10' and,
therefore,would need to be narrowed nonetheless.
13. If the property is not abandoned, it should be kept in mind that in addition to the
immediate taxpayer expense relative to additional land acquisition and
improvement construction needed,the Village would also be obligating itself to
long term maintenance expenses while continuing to suppress the surrounding
property values and tax basis.
For all of the foregoing reasons, but most importantly to prevent the danger to Village
residents,the subject right of way should be abandoned.

Dear .=tr.
This is in response to your correspondence dated March 31, 1999, relative to the submittal of an
application with the Village of Tequesta for abandonment of a road right-of-way and the existence
of any active water utilities within the area.
The Village of Tequesta has no active water utilities within the road right-of-way on the property
described as that southernmost seven hundred three point thirty-one feet (703.31') of the thirty
foot (30") right-of-way, identified as Tequesta Drive, and commonly known as Country Club
Drive, on the Plat of Tequesta, as recorded in Plat Book 25, Page 8, Public Records of Palm
Beach County, Florida. And, at this time, the Village of Tequesta has no interest in installing any
water distribution facilities within said right-of-way in the future. Therefore, the Village of
Tequesta Water Department has no objection, from a water utility perspective, to the Application
for Abandonment.

RE: Roadway Abandonment in the Village of Tequesta
Dear Mr. Ryan:
Pursuant to your letter dated September 23, 1999, we have determined that FPL
has no objection to the abandonment of the roadway as described in your
correspondence provided an easement is reserved or granted for electric
facilities that occupy a portion of said roadway. Overhead electric facilities exist
within approximately the northerly seventy-five (75) feet of the area proposed to
be abandoned.
You may call FPL's local service planner, Hank Thomasson at 575-6339 to assist
you with FPL's specific easement requirements in this matter.
Meanwhile, should you have any questions, please do not hesitate to call me.
