Subject: Consideration of request to waive/lift zoning-in-progress for Assisted Care Living
Facilities in the Village of Tequesta Mixed-Use District. Terrace Communities,
L.L.C. as applicant.
A letter of request was submitted to the Department of Community development for a
waiver/lifting of the Zoning-in-Progress for Assisted Living Facilities in the Village of Tequesta
Mixed-Use District for the development of a multiple-story assisted living facility and a one-
story special care facility on the Southwest corner of Village Blvd and U.S. Highway One. The
Village is currently under zoning-in-progress for Assisted Care Living Facilities in order to
reassess and/or redesign the Village's current code regulations for the development of ACLF's.
Attached are nineteen (19) sets of packets, including an original, for the above referenced
subject. Please place this item on the January 13, 2000, Council agenda. Staff recommends
approval.

Dear Mr. Wayman,
In response to your letter dated December 20, 1999, the Village would be happy to take your
request for lifting of Zoning-in-Progress for Assisted Care Living Facilities in the Mixed-Use
district to the January 13, 2000 Village Council meeting, but there is not sufficient time to research
the legitimacy of your request for a zoning text amendment in order to bring it before the Village
Council at that time.
If you receive a waiver/lifting of the Zoning-in-Progress, the textual amendments you are
requesting would not be necessary since many of the development regulations are negotiable in the
Mixed-Use district. If you are determined to seek a textual Code amendment,a formal application
for request for textual amendments to the Village of Tequesta Zoning Code must be submitted to
the Department of Community Development prior to review by the Village Council. Village staff
would need sufficient time in order to research any proposed textual amendments in order to
provide adequate review and support documentation to the Village Council.
The request for waiver/lifting of the Zoning-in-Progress for Assisted Living Care Facilities in the
Mixed-Use District is on the January 13, 2000 Village Council meeting agenda;please contact us if
you do not desire to be on the agenda.

Re: MU Zoning District / Amendment to Ordinance 355
Dear Scott:
As developers of Extended Congregate Care Facilities in New England and Florida; we
would like to respectfully offer the following Amendments to the Village Council for your
proposed Ordinance above.
As you know, we are also under contract, through our subsidiary Fifty Eight Asset Co.,
to purchase three properties in the SWC of Village Blvd. and US Hwy One. We are
proposing an Extended Care Facility for that site.
We would appreciate the opportunity of approaching the Village Council at the January
13, 2000 meeting and presenting our project for preliminary review. As there is a Zoning
in Progress for this use, we would like to request a waiver to the Zoning in Progress.
We will then be prepared to submit a complete Site Plan Review and Special Exception
Application shortly thereafter. We will follow this letter, during the first week of January
with a package of a proposed Site Plan and Elevation which we will modify according to
Staff and Council dictates.
We look forward to working with the Village and bringing to the Village a true Landmark
Project which the Village and its residents will be proud of for generations to come.

Add to Section I., between Assisted Living Facility and Nursing Facility
"Extended Congregate Care facility. Any building or buildings, section of a building, or
distinct part of a building, residence, home for the aged or other place whether operated
for profit or not, which undertakes its ownership or management to provide, for a period
exceeding 24 hours, housing, food service, exercise, health education, limited dementia
care, dietary management and personal services for more than four adults, not related to
the owner or administrator by blood or marriage, who require such services, when
specifically licensed to.do so pursuant to Florida Law, unless the facility is licensed as an
adult family-care home. This facility will have licensed health care professionals on staff
and is able to provide medical services as allowed according to Florida Law, and will
provide offices wherein a licensed physician is able to treat patients. A facility offering
services to fewer than four persons is within the meaning of this definition if it hold itself
out to the public to be an establishment which regularly provides such services."
6., (d), 4., add: Assisted Living Facility and Extended Congregate Care Facility
6., (d), 4, a. add: An Extended Congregate Care Facility may contain up to 40
percent of the square footage for dementia care and no more than 20 percent to be used
for a Nursing facility.
6., (d), 4., i., add: (2) Extended Congregate Care facilities: Facilities wherein a
higher level of Medical Care and Personal Attention are provided, wherein each room is
designed to house one or two family members. The maximum allowable density shall be
equal to one half dwelling unit.
(3) Extended Care Facilities: Each bed shall be equal to one-
half a dwelling unit.
6., (d), 4.,j., add: Parking: Required Parking shall be required in the following
manner:
Assisted Living Facility .56 parking spot per unit.
Extended Congregate Care Facility .50 parking spot per unit
Nursing Facility .33 parking space per unit
In all of these facility's, there shall be a minimum of 20 percent of
the required parking provided as grass parking spaces.
THE ABOVE WOULD ALL BE INSERTED INTO THE MIXED USE DISTRICT:
REGULATIONS WHERE APPROPRIATE.

Subject: Consideration of Zoning-in-Progress for specific sections of the Village of Tequesta,
Code of Ordinances.
Staff recommends that the Village Council consider placing zoning-in-progress in effect for specific
sections of the Village of Tequesta Code of Ordinances. The reason for this action is due to the large
number of proposed zoning changes to the various sections of the Zoning Ordinance, which have
been found to be outdated and/or ineffectual for proper regulation within the Village. A re-
evaluation of the Village Code of Ordinances should be done periodically.
The Village is currently negotiating with a zoning consultant for a large number of proposed zoning
changes to the various sections of the Zoning Ordinance which include but are not limited to
changes, corrections and/or additions to the following;
• Sign Regulations
• Parking Regulations
• Landscape Regulations for Public Utility Structures/Facilities
• Landscape Regulations for Non-Vehicular Areas
• Adult Congregate Living Facilities(ACLF's)
Zoning-in-Progress currently exists for monument signage and ACLF's in the Mixed-Use District,
and for Adult Entertainment regulations.
At this time, staff requests that the Village Council place Zoning-in-Progress in effect for the
following three sections of the Zoning Code.
1. Appendix A,Zoning, Section XII, Sign Regulations
2. Appendix A, Zoning, Section X, Supplemental Regulations, Subsection H, Landscaping:
General Requirements, Landscape Regulations for Public Utility Structures/Facilities
3. Appendix A, Zoning, Section X, Supplemental Regulations, Subsection H, Landscaping:
General Requirements,Landscape Regulations for Non-Vehicular Areas
