Meeting was called to order at 10:00 A.M. A. Code Enforcement Special Master Torcivia approved the minutes of the February 24, 2000 hearing as submitted. B. Fine Imposition Hearings: None C. Violation Hearings: Case No. 9927541 John A. Zedaker Barbara Rettig (Owner) 380 Franklin Road Tequesta, Florida 33469 Legal: JUPITER IN THE PINES SEC B Lt1 BIk14 60-42-40-25-06-014-0010 Nature of Violation: Violation of Tequesta Code of Ordinances, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several to all r SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES March 23, 2000 Page 2 Districts (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots, (2), Page No. 1184.1 The Respondents, John A. Zedaker and Barbara Rettig, were present at the hearing. Code Enforcement Officer Sgt. Irovando testified to the violation. Conclusion of law was that Respondents are in violation of Appendix A, Section X (L)(2) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, John A. Zedaker and Barbara Rettig, shall comply with Appendix A, Section X(L)(2) , of the Code of Ordinances of the Village of Tequesta by the 25th day of March, 2000. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Should a dispute arise concerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. Case No. 995786 Charles J. & Patricia N. Hartley 279 Country Club Drive Tequesta, Florida 33469 Legal: TEQUESTA Lt 207 60-42-40-26-01-000-2070 Nature of Violation: Violation of Tequesta Code of Ordinances, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific,to Several to all Districts(L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots, (3), Page No. 1185 2 SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES March 23, 2000 Page 3 The Respondent, Patricia N. Hartley, was present at the hearing. Code Enforcement Officer Sgt. Irovando testified to the violation. Conclusion of law was that Respondents are in violation of Appendix A, Section X (L)(3) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Charles J. and Patricia N. Hartley, shall comply with Appendix A, Section X(L)(30 , of the Code of Ordinances of the Village of Tequesta by the 25th day of March, 2000. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Funkey 124 Fairview East Tequesta, Florida 33469 Legal: TEQUESTA Lt 473 60-42-40-26-01-000-4730 Nature of Violation: Violation of Tequesta Code of Ordinances, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific,to Several to all Districts(L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots, (3), Page No. 1185 The Respondents, John P. and Ann P. Funkey, were not present at the hearing, however, there was a finding of proper notice. 3 t SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES March 23, 2000 Page 4 Code Enforcement Officer Sgt. Irovando testified to the violation. Conclusion of law was that Respondents are in violation of Appendix A, Section X (L)(3) of the Code of Ordinances of the Village of Tequesta. Funkey, shall comply with Appendix A, Section X (L)(3), of the Code of Ordinances of the Village of Tequesta by the 25th day of March, 2000. if Respondent does not comply within the time specified, a fine of Fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. Should a dispute arise concerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. Case No. 00760 Lee H. Garlington Trust 164 Intracoastal Circle Tequesta, Florida 33469 Legal: KEY WEST VILLAGE Lt 17 60-43-40-30-39-000-0170 Nature of Violation: Repeat Violation of Tequesta Code of Ordinances, Chapter 4, ANIMALS AND FOWL,ARTICLE I IN GENERAL,Sec.4- 7, Animals creating nuisances, Pages No. 257, 258. The Respondent, Lee H. Garlington Trust, was not present at the hearing, however, there was a finding of proper notice. Code Enforcement Officer Sgt. Irovando testified the violation. Conclusion of law was that Respondent is in violation of Chapter 4, Article I, Sections 4-7 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Lee H. Code Enforcement Officer Sgt. Irovando testified that Tamwest Realty had accepted responsibility for the hedge, had replaced the missing and dying portions, was continuing to maintain the hedge, and that Respondent was in full compliance. 5 SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES March 23, 2000 Page 6 No order was issued by the Special Master.
