Meeting was called to order at 10:00 A.M. A. Code Enforcement Special Master Torcivia approved the minutes of the March 23, 2000 hearing as submitted. B. Fine Imposition Hearings: None C. Violation Hearings: Case No. 002974 Heide A. Violation of Tequesta Code of Ordinances, Chapter 4,ANIMALS AND FOWL, ARTICLE I IN GENERAL, Sec. 4-, 13,. Animals creating nuisances, Pages No. 257, 258. The Respondent, Heide A. Wilkinson, was present at the hearing and testified that the pit bull belonged to her son's girlfriend. Respondent further testified that the girlfriend and dog no longer live at her home. Code Enforcement Officer Sgt. irovando testified that the pit bull was attacking officers, garbage men, and the animal regulation officer. He further testified that there were dogs barking in the back yard which constituted a nuisance. Conclusion of law was that Respondent is in repeat violation of Sections 4-13 of the Code of Ordinances of the Village of Tequesta; and that Respondent is in violation of Sections 4-7 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that a fine of two hundred fifty dollars ($250.00) shall be assessed in accordance with Sections 4-13 of the Code of Ordinances of the Village of Tequesta. This fine is to be paid by May 12, 2000. If Respondent repeats a violation of Sections 4-13, a fine of two hundred fifty dollars($250.00)shall be assessed for each day the violation continues to exist. Respondent shall be assessed one hundred fifty dollars ($150.00) per day for each day violation of Sections 4-7 occurs. Case No. 995786 John P. Flanagan and Kathleen L. Davis 347 Country Club Drive Tequesta, Florida 33469 Legal: TEQUESTA Lt 130 2 SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES April 27, 2000 Page 3 60-42-40-26-01-000-1300 Nature of Violation: Repeat Violation of Tequesta Code of Ordinances, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several or to all Districts (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots, (3), Page No. 1185 The Respondent, John P. Flanagan, was present at the hearing. Code Enforcement Officer Sgt. Irovando testified to the repeat violation. Conclusion of law was that Respondents are in repeat violation of Appendix A, Section X (L) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that a fine of fifty dollars($50.00)shall be assessed. This fine is to be paid by May 12, 2000.. If Respondents repeat this violation,a fine of one hundred dollars($100.00)shall be assessed for each day the violation continues to exist. Case No. 005242 Donald G. and Wanda F. Blauvelt 83 Golfview Drive Tequesta, Florida 33469 Legal: TEQUESTA Lt 345 60-42-40-26-01-000-3450 Nature of Violation: Violation of Tequesta Code of Ordinances of the Village of Tequesta, Florida, Chapter 6, Buildings and 3 SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES April 27, 2000 Page 4 Building Regulations, Article IX, Swimming Pools,Sec.6-151, Page No. 378. The Respondents, Donald G. and Wanda F. Blauvelt, were not present at the hearing, however, there was a finding of proper notice. Code Enforcement Officer Sgt. Irovando testified to and produced photographs of the violation. Conclusion of law was that Respondents are in violation of Chapter 6,Article IX, Sec 6-151 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Donald G. and Wanda F. Blauvelt, shall comply with Chapter 6, Article IX, Sec. 6-151 of the Code of Ordinances of the Village of Tequesta by the 27th day of April, 2000. If Respondents do not comply within the time specified, a Fine Assessment Hearing will be held before the Special Master on the 18th day of May, 2000, at 10:00 a.m., at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Should a dispute arise concerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. Case No. 005740 Craig A. and Dorene L. Lussier 27 Ridgewood Circle Tequesta, Florida 33469 Legal: RIDGEWOOD HOMES Lt 35 60-42-40-25-09-000-0350 Nature of Violation: Repeat Violation of Tequesta Code of Ordinances, APPENDIX A-ZONING, SECTION X, SUPPLEMENTAL REGULATIONS APPLYING TO A SPECIFIC, TO SEVERAL OR TO ALL 4 SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES April 27, 2000 Page 5 DISTRICTS, (L) Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots, (1), Page No. 1184. The Respondents, Craig A. and Dorene L. Lussier, were not present at the hearing, however, there was a finding of proper notice. Code Enforcement Officer Sgt. Irovando testified the violation. Conclusion of law was that Respondents are in violation of Appendix A, Section X (L) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents Craig A.and Dorene L. Lussier, shall comply with Appendix A, Section X (L) of the Code of Ordinances of the Village of Tequesta by the 28th day of April, 2000. If Respondents do not comply within the time specified, a Fine Assessment Hearing will be held before the Special Master on the 18th day of May, 2000, at 10:00 a.m. at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469.
