After having worked with Mr. Diamond this past week, I concur with Ms. Manganiello's recommendation and I respectfully request that the Village Council consider approval of Mr. Diamond's Temporary Employment Agreement as Special Projects Coordinator. amipro/fdes/managakecom 1 Memorandum To: Michael R. Couzzo, Jr., Village Manager From: Joann Manganiello, Assistant Village Manager/Village Clerk 714 Date: October 6, 2000 Subject: Temporary Employment Agreement With Richard Diamond for Special Projects Coordinator Position;Agenda Item The Temporary Employment Agreement with Richard Diamond for the position of Acting Assistant Manager was to terminate at the time a new Village Manager was hired. As you know, at the September 28, 2000, Village Council Meeting, the Village Council extended the Temporary Employment Agreement with Richard Diamond through October 13, 2000, to enable you to determine whether Mr. Diamond's continued assistance would be helpful during this transitional period. The Village Council requested that you review and assess Mr. Diamond's assignments and responsibilities and to make a recommendation to them in this regard at the October 12, 2000, Village Council Meeting. During his tenure as Acting Assistant Manager, Mr. Diamond has been assigned many projects, which are still ongoing, and highlighted below: • Contract negotiations: Fraternal Order of Police (FOP) and Communications Workers of America(CWA); personnel issues/Employee Handbook revisions • Temporary facilities for Public Safety and Department of Community Development • South Cypress Drive streetscape and drainage improvements (NPCBID) • Extension of water service to Tropic Vista (Martin County) - with Tom Jensen, Acting Utilities Director • Development regulations updates and revisions and Overlay Zoning District • School Concurrency Agreement • Compensation Study • Citizens' Satisfaction Survey As I previously noted to the Village Council, Mr. Diamond has been an invaluable assistant and a tremendous help to the Department Heads, Village staff, and Village Council. He is extremely qualified, well-versed, and experienced in municipal government. Mr. Diamond has a wonderful work ethic and is willing to do anything asked of him. He is always professional and has been very representative of the Village of Tequesta in his position as Acting Assistant Village Manager. Memorandum: Village Council October 6, 2000 Page 2 - Additionally, Mr. Diamond is well-liked and has become an integral part of the day-to-day activities of the Village. I believe that Mr. Diamond's assistance is still very much needed and recommend that you consider extending his tempoary employment with the Village of Tequesta. As we discussed, Mr. Diamond could serve as a Special Projects Coordinator. Enclosed is a revised Temporary Employment Agreement with Richard Diamond for the Position of Special Projects Coordinator. Noted changes are as follows: • Position and title: Special Projects Coordinator • Duties: Those performed by a Special Projects Coordinator • Term: October 16 -December 29, 2000 • Hourly Rate: $25.00 (formerly $32.00 per hour) All other terms and conditions as contained in Mr. Diamond's current Temporary Employment Agreement remain the same. Funds are available in the Village Manager's Personal Services Salaries and Wages Account FY 1999/2000 and can be encumbered to provide for Mr. Diamond's services in this fiscal year. Enclosure amipro/filesJasstmgrkempagre RESOLUTION NO. 1 - 00/01 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, APPROVING A TEMPORARY EMPLOYMENT AGREEMENT WITH RICHARD DIAMOMD FOR THE SPECIAL PROJECTS COORDINATOR POSITION WITH FUNDS BEING ALLOCATED FROM THE VILLAGE MANAGER'S PERSONAL SERVICES SALARIES AND WAGES ACCOUNT, HAVING A FY 2000/2001 BUDGET AMOUNT OF $209, 571, AND AUTHORIZING THE VILLAGE MANAGER TO EXECUTE THE APPLICABLE AGREEMENT ON BEHALF OF THE VILLAGE. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. A Temporary Employment Agreement for the Special Projects Coordinator Position, attached hereto as Exhibit "A" and incorporated by reference as a part of this Resolution, is hereby approved and the Village Manager of the Village of Tequesta is authorized to execute the same on behalf of the Village of Tequesta. THE FOREGOING RESOLUTION WAS OFFERED by Councilmember , who moved its adoption. Capretta ATTEST: Joann Manganiello Village Clerk word/mydocuments/resolutions/resolution 1-00-01 EXHIBIT "A" TEMPORARY EMPLOYMENT CONTRACT This Temporary Employment Agreement ("Agreement") is made and entered into this day of October, 2000, by and between the Village of Tequesta ("Village") and Richard Diamond ("Diamond") . The Village has a temporary need for an individual to assist the Village Manager for an interim period (October 16 through December 31, 2000) , and Diamond desires to be temporarily employed by the Village to perform such duties as required by the Village Manager. Accordingly, the parties agree to Diamond' s temporary employment under the following terms and conditions. 1 . Position and Title . Village agrees to employ Diamond as a Special Projects Coordinator. 2 . Duties . Diamond shall perform such duties as those performed by a Special Projects Coordinator, and shall have such additional duties, responsibilities and authority as may from time to time be determined by the Village Manager. 3. Term. The term of this Agreement shall be indefinite, and it is terminable at the will of their party for any or no reason upon two (2) weeks written notice. 1 4 . Compensation and Related Matters. During the term of this Agreement, Diamond shall be compensated at the rate of $25. 00 per hour. It is anticipated that Diamond shall work 37 . 5 hours per week as scheduled by the Village Manager. Diamond may be permitted time off without pay to attend to other matters at the discretion of the Village Manager. 5. Benefits and Personnel Policies . Diamond shall receive no other compensation or benefits except as required by state or federal law (e.g. workers' compensation) . Diamond shall receive a copy of the Tequesta Employee Handbook at the time of initial employment, and he is responsible for compliance with General Personnel Policies (pages 3-8) and Standards of Conduct (page 30) . Except for General Personnel Policies and Standards of Conduct, Diamond is not covered by the Village' s Employee Handbook, including its Employee Benefits and Grievance Procedure, and he does not have a property right in employment. 6. Termination. Diamond' s employment hereunder may be properly terminated by either party with or without cause upon two (2) weeks written notice . The Village may substitute pay in lieu of notice in the discretion of the Village Manager. 2 7 . Complete Understanding. This Agreement represents the entire understanding between Village and Diamond regarding the subject matter of this Agreement, and it cannot be altered by oral agreements, statements or representation.
