John Irovando; Recording Secretary Betty Laur., Meeting was called to order at 9:57 A.M. A. Code Enforcement Special Master Torcivia approved the minutes of the October 28, 1999 hearing with correction of two typographical errors. B. Fine Imposition Hearings: None C. Violation Hearings: Case No. 9923719 Marcia Lynn Spalter/ Heide A. Wilkinson 68 Azalea Circle Tequesta, FL 33469 Legal: RIDGEWOOD HOMES SEC 3, LT 92 60-43-40-30-07-000-0920 Nature of Violation: Violation of Tequesta Code of Ordinances, Chapter 4, ANIMALS AND SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES November 18, 1999 Page 2 FOWL, ARTICLE II, Dogs and Cats, Sec. 4-13, Running at Large, Prohibited, Page No. 259 The Respondents, Marcia Lynn Spalter and Heide A. Wilkinson, were present at the hearing and testified to means by which they were now containing the dogs. Sgt. Irovando, Tequesta Code Enforcement Officer, testified to the violation. Conclusion of law was that Respondents are in violation of Chapter 4, Article II, Section 4-13, of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, Marcia Lynn Spalter and Heide A. Wilkinson, shall comply with Chapter 4, Article II, Section 4-13, of the Code of Ordinances of the Village of Tequesta by the 19th day of November, 1999. If Respondents do not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondents are in violation of Appendix A-Zoning, Section X (H) (15) of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondents, K-Mart Corporation and Tamwest Realty, Inc., shall comply with Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several to all Districts (H); Landscaping General Requirements (15) Maintenance Required Pages No. 1178.8 of the Code of Ordinances of the Village of Tequesta by the 27th day of January, 2000. If Respondents do not comply within the time specified, a fine of up to two hundred fifty dollars ($250.00) per day, five hundred ($500.00) dollars per day for repeat violators, may be assessed for each day the violation continues to exist. A Status Hearing will be held before the Special Master on the 27th day of January, 2000, at 10:00 a.m. at the Tequesta Village Council Chambers, 357 Tequesta Drive, Tequesta, Florida 33469. Should a dispute arise concerning compliance, either party may request a hearing before the Special Master on the issue of compliance only. Case No. 995122 Cynthia S. Seidel 18 Hemlock Lane Tequesta, Florida 33469 Legal: TEQUESTA PINES LT 198 60-42-40-25-25-000-1980 Nature of Violation: SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES October 28, 1999 Page 4 Violation of Tequesta Code of Ordinances, Chapter 4, ANIMALS AND FOWL, ARTICLE I, IN GENERAL, Sec. 4-7, Animals creating nuisances, Pages No. 257, 258. The Respondent, Cynthia S. Seidel, was not present at the hearing, however, there was a finding of proper notice. The Tequesta Code Enforcement Officer testified to the violation. Conclusion of law was that Respondent is in violation of Chapter 4, Section 4-7 of the Code of Ordinances of the Village of Tequesta. Special Master Paulette Torcivia ordered that Respondent, Cynthia S. Seidel, shall comply with Chapter 4, Section 4-7 of the Code of Ordinances of the Village of Tequesta by the 19th day of November, 1999. If Respondent does not comply within the time specified, a fine of fifty dollars ($50.00) per day shall be assessed for each day the violation continues to exist. King 98000695 366 Elm Avenue Tequesta, Florida 33469 Legal Description JUPITER IN THE PINES SEC B LT 2 BLK 25 60-42-40-25-06-025-0020 Nature of Violation: Repeat Violation of Tequesta Code of Ordinances, Appendix A-Zoning, Section X, Supplemental Regulations Applying to a Specific, to Several to all Districts (L); Commercial Vehicles and Trucks, Recreational Vehicles on Private Lots (2), Page No. 1184.1. The Tequesta Code Enforcement Officer reported that on October 28, 1999 the SPECIAL MASTER CODE ENFORCEMENT HEARING MINUTES October 28, 1999 Page 5 Special Master had imposed a $50.00 fine for repeat violation which had been paid by Respondents on November 11, 1999.
