Bradford,Village Manager p D, cJ FROM: Scott D.Ladd,Director of Community Development J(�1 —' DATE: February 3,2000 SUBJECT: Draft Ordinance for First Reading to Adopt the 1999 National Electric Code and The 1999 Countywide Amendments to the National Electric Code. Tom, attached are nineteen (19) sets of packets, including an original, for the above referenced subject. The Building Code Advisory Board of Palm Beach County has notified us that on December 21, 1999,the Palm Beach County Board of County Commissioners adopted the same and that we should now proceed to adopt these latest versions of the Electrical Code. As the State of Florida mandates the various construction codes for use within all of the States Counties and Municipalities, and has also notified each County and Municipality that the subject versions of the Electrical Codes set forth above are to be adopted, this is simply a housekeeping matter. Please place this item on the February 10,2000 Council Meeting under New Business. Thanks. ORDINANCE NO. AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 6 OF THE CODE OF ORDINANCES, BUILDINGS AND BUILDING REGULATIONS, AT ARTICLE HI, AT SECTIONS 6-41 AND 6-42, TO PROVIDE FOR THE ADOPTION OF THE 1999 NATIONAL ELECTRIC CODE AND THE 1999 EDITION OF THE UNIFORM COUNTYWIDE AMENDMENTS TO THE NATIONAL ELECTRIC CODE; PROVIDING FOR PREVAILING STANDARDS IN.THE EVENT OF CONFLICT; PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Village of Tequesta, Florida has adopted uniform building codes together with certain amendments to the codes which are intended to address specific local conditions within Palm Beach County, Florida; and, WHEREAS, new model codes have now been published in the several categories relating to building and construction, and the same have been updated and revised, including administrative changes, as recommended by the Palm Beach County Building Code Advisory Board; and, WHEREAS, the Village Council of the Village of Tequesta has determined that the 1999 edition of the National Electric Code and the Uniform Countywide Amendments thereto, are consistent with the adopted Comprehensive Development Plan of the Village of Tequesta, Florida as required by Section 163.3194(2), Florida Statutes; and, WHEREAS, the Village Council of the Village of Tequesta, Florida deems it necessary and advisable to amend its building and construction codes by adopting the 1999 National Electric Code and Countywide Amendments as set forth herein, NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: Section 1. Section 6-41 of the Code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the Code the National Electric Code, 1999 Edition as fully as if set forth at length herein as the Electric Code of the Village of Tequesta. Section 2. Section 6-42 of the Code of Ordinances of the Village of Tequesta is hereby amended by adopting and incorporating into the Code the Uniform, Minimum Countywide Amendment to the National Electric Code, 1999 Edition as fully as set forth at length herein. Section 3. Prevailing standards in the Event of Conflict. It is the intent of this Ordinance to maintain the highest standards for Building and Construction in the Village of Tequesta. Therefore, in the event of a conflict between the standards and requirements of the several codes hereby adopted, the more stringent provisions shall prevail. Section 4. Repeal of Ordinances in Conflict. All other Ordinances of the Village of Tequesta, Florida, or parts thereof which conflict with this or any other part of this Ordinance are hereby repealed. Section 5. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance, which can be given effect without the invalid provisions or applications, and to this end, the provisions of this Ordinance are hereby declared severable. Section 6. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Village of Tequesta. Section 7. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. THE FOREGOING ORDINANCE WAS OFFERED BY Council Member , who moved its adoption.
