Regular Council STAFF MEMO Meeting: Regular Council - Oct 10 2024 Staff Contact: Marjorie Craig, Utilities Director Department: Utilities immr Consider Approval of Holtz Engineering Work Authorization 15 for State Revolving Fund (SRF) Construction Administration Assistance for the Water Treatment Plant (WTP) Upgrades in the Amount of$59,370 The Village of Tequesta (VOT or Village) Utilities Department (UD) recommends approval of work authorization 15 to Holtz Engineering (Holtz) for support of a Florida Department of Environmental Protection (FDEP) state revolving fund (SRF) loan. This work authorization for $59,370 will support the FDEP SRF loan requirements during bidding and construction of the water treatment plant (WTP) improvements project. Holtz has successfully provided SRF assistance for the Village since 2020 and helped put the current SRF loan in place. The Village will fund the upcoming "Water Treatment Plant (WTP) Process Efficiency and Control Improvements" (Project) using FDEP SRF loan funding. FDEP SRF loans have specific requirements which include a considerable amount of reporting, communication, and auditing. This scope of services provides for professional engineering assistance to the UD for SRF compliance during the bidding and construction phase of the WTP Project. This includes tracking documentation to ensure all applicable materials on the project to comply with the provisions of the AIS/BABA requirement as part of the SRF loan, copies of labor interviews conducted, copies of all weekly payroll documentation and completed disbursement packages to be forwarded to the FDEP for processing. The project has 100% bid documents (plans, specifications, and permits) and will be ready to bid once the FDEP SRF loan agreement is fully executed by both parties (VOT and FDEP) and FDEP approves bidding. Funding for the work authorization will come from the Water Fund, Capital Improvement budget, Account 401-412-663.632, Architect & Engineering - Other. NO. : UTIL 06-20 WORK AUTHORIZATION NO.15 FOR CONSULTING SERVICES PROJECT No. G/L CODE: HOLTZ CONSULTING PROJECT NO.: PROJECT TITLE: State Revolving Fund (SRF) Construction Administration Assistance for Water Treatment Plant Upgrades This Work Authorization, when executed, shall be incorporated in and shall become an integral part of the Agreement for Professional Services dated September 10, 2020 between the Village of Tequesta ("VILLAGE"), and Holtz Consulting ("CONSULTANT") hereafter referred to as the Agreement. I. PROJECT DESCRIPTION The VILLAGE owns and operates a potable water utility system to serve customers within the VILLAGE's service areas. The VILLAGE intends to fund the upcoming Water Treatment Plant Process Efficiency and Control Improvements project (Project) using State Revolving Fund (SRF) loan funding. This scope of services provides for professional engineering assistance during construction of the Project for compliance with the SRF funding requirements. SCOPE OF SERVICES The following is a description of the services to be provided under this Work Authorization. TASK 1 - ENGINEERING SUPPORT FOR STATE REVOLVING FUND (SRF) COMPLIANCE DURING CONSTRUCTION CONSULTANT will provide the following services during the construction phase of the water treatment plant upgrades project: • Work with Contractor to ensure all applicable materials on the project comply with the provisions of the "American Iron and Steel (AIS)" and/or "Build WORK AUTHORIZATION NO. 15 1 of 3 Page 102 of 512 Agenda Item #7. America Buy America(BABA)" requirement as part of the SRF loan. • Review and approve weekly payroll information submitted by the Contractor and subcontractor(s) to ensure requirements for Davis Bacon wage requirements are met. • Conduct labor interviews with the Contractor's personnel throughout the construction duration as required by SRF guidelines. • Prepare and submit disbursement requests with required supporting documentation to the FDEP SRF department in Tallahassee. II. DELIVERABLES Task 1 - Deliverables: 1. Tracking documentation to ensure all applicable materials on the project comply with the provisions of the AIS/BABA requirement as part of the SRF loan. 2. Copies of all labor interviews conducted. 3. Copies of all weekly payroll documentation. 4. Completed disbursement packages to be forwarded to the FDEP for processing. III. SCHEDULE Upon receipt of Notice-To-Proceed the CONSULTANT will complete the services identified in this Work Authorization within IV. COMPENSATION AND PAYMENT The CONSULTANT will perform the tasks as outlined in the scope of services for Lump Sum Fee of$59,370 in accordance with our approved billing rates with an estimate of costs by task provided in Table 2 and further detailed in Attachment A. Monthly progress payments will be authorized based on percent complete as determined by CONSULTANT and approved by VILLAGE. Table 2 Budget Summary Description Total 1. AGREEMENT REFERENCE The work authorized under this Work Authorization shall be performed under the terms and conditions described within the Professional Services Agreement dated September 10, 2020,by and between the Village of Tequesta ("VILLAGE") and Holtz Consulting ("CONSULTANT"). Compensation shall not exceed the hourly rates currently in effect under this Agreement. In accordance with Sec. 119.07011 Florida Statutes, CONTRACTOR must keep and maintain this Agreement and any other records associated therewith and that are associated with the performance of the work described in the Proposal or Bid. Upon request from the Village's custodian of public records, CONTRACTOR must provide the Village with copies of requested records, or allow such records to be inspected or copied, within a reasonable time in accordance with access and cost requirements of Chapter 119, Florida Statutes. A CONTRACTOR who fails to provide the public records to the Village, or fails to make them available for inspection or copying, within a reasonable time may be subject to attorney's fees and costs pursuant to Sec. 119.0701, Florida Statutes, and other penalties under Sec. 119.10, Florida Statutes. Further, CONTRACTOR shall ensure that any exempt or confidential records associated with this Agreement or associated with the performance of the work described in the Proposal or Bid are not disclosed except as authorized by law for the duration of the Agreement term, and following completion of the Agreement if the CONTRACTOR does not transfer the records to the Village. Finally, upon completion of the Agreement, CONTRACTOR shall transfer, at no cost to the Village, all public records in possession of the CONTRACTOR, or keep and maintain public records required by the Village. If the CONTRACTOR transfers all public records to the Village upon completion of the Agreement, the CONTRACTOR shall destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. If the CONTRACTOR keeps and maintains public records upon completion of the Agreement, the CONTRACTOR shall meet all applicable requirements for retaining public records. Records that are stored electronically must be provided to the VILLAGE, upon request from the Village's custodian of public records, in a format that is compatible with the Village's information technology systems. Pursuant to Article XII of the Palm Beach County Charter, the Office of the Inspector General has jurisdiction to investigate municipal matters, review and audit municipal contracts and other transactions, and make reports and recommendations to municipal governing bodies based on such audits, reviews, or investigations. All parties doing business with the Village shall fully cooperate with the inspector general in the exercise of the inspector general's functions, authority, and power. The inspector general has the power to take sworn statements, require the production of records, and to audit, monitor, investigate and inspect the activities of the Village, as well as contractors and lobbyists of the Village in order to detect, deter, prevent, and eradicate fraud, waste, mismanagement, misconduct, and abuses.
