NOREN,JOHAN A Respondent. RE: Violation of Chapter 14, Article II, Section 14-31, FBC 105.1 81 Edition, 2023 Appendix B, Ch. 3 Section 303.1 & Chapter 78 Article IX, Section 78-585 of the Code of Ordinances of the Village of Tequesta. Address: 116 River Drive Tequesta, Florida 33469 Legal Description: TEQUESTA LT 426 PCN: 60-42-40-26-01-000-4260 The Special Magistrate appointed by the Village Council to hear code compliance cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Compliance Special Magistrate Hearing held on the 61' day of November 2024, and based on the evidence and testimony presented, enters this Order Approving Settlement. The following Findings of Fact, Conclusions of Law, and Order are hereby entered: FINDINGS OF FACT 1. The Respondents are the owners of the above-described property. 2. The Respondents were not present at the hearing; there was a finding of proper notice. 3. Code Officer Frank Ciatto provided testimony and evidence of the violation, as contained in the Village's evidentiary case file which was accepted into evidence without objection. Page 1 of 3 4. By the "Order Finding Violation" dated March 611, 2024, the Special Magistrate ordered the Respondents to comply with Chapter 14, Article II, Section 14-31 (FBC 105.1) of the Code of Ordinances of the Village of Tequesta by April 51a, 2024, if not complied, a daily fine of two-hundred and fifty dollars ($250.00) per day shall be accessed against the property for each day thereafter the violation continues to exist. 5. By the "Order Accessing Fine" dated April 1011, 2024, the Special Magistrate found the property remained out of compliance, a daily fine of two-hundred fifty dollars ($250.00) per day was imposed against the property for each day following the compliance deadline the violation continues to exist. 6. The property came into compliance on October 411, 2024. CONCLUSIONS OF LAW 1. The Magistrate has reviewed the proposed settlement agreement between the Village of Tequesta and the respondent and finds the agreement to be sufficient. ORDER It is the Order of the Special Magistrate that the attached fine settlement agreement between the Village of Tequesta and respondent is approved. Upon complying with any code compliance matter, it is always the responsibility of the Respondents to contact the Code Compliance Division at (561) 768-0519 to request a reinspection of the property.
