KUPFERSCHMID,JASON AND MARIE Respondent. JOINT CODE COMPLIANCE STIPULATION Re: Violation of Chapter 78, Article XIV, Section 78-890 of the Code of Ordinances of the Village of Tequesta. Address: 52 Azalea Circle Tequesta,Florida 33469 Legal Description: RIDGEWOOD HOMES SEC 3,LT 98 PCN: 60-43-40-30-07-000-0980 This Joint Code Enforcement Stipulation between the Village of Tequesta("Village") and Kupferschmid, Jason and Marie ("Respondent") resolves the code enforcement case identified above in a fair and amicable manner. The Village and Respondents agree and stipulate to the following: 1. On Septemberllth, 2024, Respondents' above-referenced property ("Subject Property") was found to be in violation of Chapter 78, Article XIV, Section 78-890 of the Code of Ordinances of the Village of Tequesta. 2. On November 61h, 2024, an Order Assessing Fine was issued for the continuing violation of Chapter 78, Article XIV, Section 78-890 of the Code of Ordinances of the Village of Tequesta,assessing a continuing fine of Two-Hundred and Fifty Dollars($250.00)per day from the date of violation until the Respondents achieved compliance (Order Assessing Fine, dated November 6th, 2024). 3. Village records indicate that Respondents brought the Subject Property into compliance with the Village of Tequesta Code of Ordinances and the Florida Building Code on Page 1 of 4 November 81',2024,as stated on the properties Affidavit of Compliance attached hereto as "Exhibit A". 4. The Village and Respondents agree that in exchange for payment to the Village by Respondents in the amount of Four Thousand Two-Hundred and Twenty Dollars ($4,220.00),to be made within thirty(30)days of the date of this fully executed Stipulation, and following magistrate approval the Village will release its above-referenced lien. Said release shall occur no later than thirty (30)days after receipt of said payment. 5. Should Respondents fail to pay the Village Four Thousand Two-Hundred and Twenty Dollars ($4,220.00) within thirty (30) days of the date of this Stipulation, this Joint Code Compliance Stipulation shall be deemed void and the lien amount shall revert to its full amount and the lien will not be released. 6. Nothing contained in this Joint Code Compliance Stipulation shall be construed as precluding the Village from enforcing repeat violations at the Subject Property. Should Respondents violate the same sections of the Code again,Respondents may be subject to a fine of up to $500.00 per day for such repeat violation. Should the violations be deemed to be irreparable and irreversible,Respondents may be subject to a fine of up to$5,000.00 for each violation. Additionally, the Code Inspector is not required to give a reasonable time to correct a repeat violation or an irreparable/irreversible violation and the case may be presented to the Special Magistrate even if the repeat violation has been corrected or the irreparable/irreversible violation has stopped prior to the Special Magistrate hearing. 7. Each party shall bear its own fees and costs in connection with this matter. 8. The parties agree to the terms of this Joint Code Compliance Stipulation above. E240089 DATE: November 8, 2024 LOCATION OF VIOLATION: 52 Azalea Circle Tequesta, FL 33469 Per the Building Department Director, the property described above is in compliance with the Village of Tequesta Code per ordinance section: Sec. 78-890.-Vacation rental permit application. Every vacation rental owner or operator shall register with the village by submitting to the building department a completed vacation rental permit application in a form promulgated by the village, together with registration and inspection fees in amounts established by resolution of the village council, which amounts may be amended from time to time. A separate permit application form with separate registration and inspection fees shall be required for each vacation rental unit.
