HomeMy WebLinkAboutMinutes_Local Planning Agency_6/20/2024 MINUTES LOCAL PLANNING AGENCY MEETING VILLAGE OF TEQUESTA, FL JUNE 20, 2024 5:30 PM COUNCIL CHAMBERS CALL TO ORDER AND ROLL CALL The meeting was called to order by Board Chair, Leslee Dasher at 5:30 p.m. A roll call was taken by Community Development Planner, Meg Wyble. Present were: Member Jeanne McEldowney, Alt. 1 Member Marie Sapirie, Chair Leslee Dasher, Vice-Chair Theresa Maggio, and Member Elizabeth Schauer. Absent were: Member Sherry Ambrose. APPROVAL OF AGENDA MOTION: Member Schauer made a motion to approve the agenda; Member McEldowney seconded the motion. Carried unanimously 5-0 (absent: Member Ambrose). APPROVAL OF MINUTES 2. May 2024 Local Planning Agency Minutes MOTION: Alt. 1 Member Sapirie made a motion to approve the minutes with an adjustment from Chair Dahser to change the reference made in the agenda regarding the Local Planning Agency to the Planning and Zoning Board; Member McEldowney seconded the motion. Carried unanimously 5-0 (absent: Member Ambrose). AGENDA ITEMS 3. ORDINANCE 00-24: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE VILLAGE CODE OF ORDINANCES AT CHAPTER 78. ZONING. ARTICLE Vl. SCHEDULE OF DISTRICT REGULATIONS. BY CREATING A NEW DIVISION 3. ENTITLED "AFFORDABLE HOUSING AND LIVE LOCAL ACT." TO PROVIDE AND IMPLEMENT ADMINISTRATIVE PROCEDURES AND REQUIREMENTS FOR DEVELOPMENT OF AFFORDABLE HOUSING Page 1 of 3 PROJECTS PURSUANT TO THE FLORIDA LIVE LOCAL ACT; PROVIDING FOR ENFORCEMENT, AND PROVIDING FOR PENALTIES FOR VIOLATIONS; PROVIDING THAT EACH AND EVERY OTHER SECTION AND SUBSECTION OF CHAPTER 78. ZONING SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ADOPTED; PROVIDING A CONFLICTS CLAUSE, SEVERABILITY CLAUSE AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Community Development Director, Jay Hubsch provided the Board with an update on the Live Local Act and the Village's proposed Live Local Act Ordinance. He informed the Board that the Village Council did not adopt the Live Local Ordinance earlier in 2024 because the state legislature was re-visiting it during the 2024 session. Mr. Hubsch informed the Board of the changes to the Live Local Act that were adopted by the state in 2024 and stated that many of the changes do not impact Tequesta. Member Marie Sapirie requested a requirement that there be a semi-annual report capturing the rental agreements of any Live Local Act projects so that developers are not able to violate the terms of the Act, and that the Village punish violators to the fullest extent possible. Jessica Namath, a resident of the Village of Tequesta, expressed her disappointment in the Live Local Act. MOTION: Member Schauer made a motion to recommend approval of Ordinance 00-24 with a recommendation of a semi-annual recording requirement and exacting language outlining penalties; Vice-Chair Maggio seconded the motion. Carried 4-1 (opposed: Alt. 1 Member Sapirie) (absent: Member Ambrose). STAFF COMMENTS 4. Introduction to Living Shorelines Code Community Development Director, Jay Hubsch, informed the Board that a seawall code will be coming to the Local Planning Agency. This will protect out still natural shorelines, and discourage any future hardening. Jessica Namath, spoke supporting the upcoming Shoreline Code. PUBLIC COMMENTS There was no Public comment. BOARD COMMENTS The was no Board comment. ADJOURNMENT The meeting was adjourned at 7:04 PM. 5. MOTION: Member Schauer made a motion to adjourn the meeting; Vice-Chair Maggio seconded the motion.
