Workshop STAFF MEMO Meeting: Workshop - Feb 03 2025 Staff Contact: Jeremy Allen, Village Manager Department: Manager Discussion On Proposed Village Of Tequesta Legislative Priorities. Each year municipal officials from across the state volunteer to serve on one of five Florida League of Cities legislative policy committees. The committees address municipal affairs that directly pertain to the governmental, corporate and proprietary powers to conduct municipal government, perform municipal functions, render municipal services, and raise and expend revenues. Protecting Florida's cities from egregious far-reaching attacks on Home Rule powers is always the Florida League of Cities' top priority. The committee members meet numerous times to address the following issues affecting municipalities: 1. Finance and Taxation 2. Development, Code Compliance, and Redevelopment 3. Intergovernmental Relations, Mobility, and Emergency Management 4. Municipal Operations 5. Utilities, Natural Resources, and Public Works. Policy committee members help League staff understand real-world implications of proposed legislation, provide a broad spectrum of ideas, and addresses the impact of policy proposals on rural, suburban and urban cities of all sizes. Additionally, the members serve as advocates throughout the year. Resolution 04-25 expresses the Village Council's support for the 2025 Florida League of Cities Legislative Action Agenda and the Palm Beach County League of Cities Legislative Priorities.. RESOLUTION NO. 04-25 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, SUPPORTING THE 2025 FLORIDA LEAGUE OF CITIES LEGISLATIVE PLATFORM; PRIORITIZING AGENDA LEGISLATION THAT WOULD (1) ALLOW FOR A COLLABORATIVE APPROACH BETWEEN LOCAL GOVERNMENT NEEDS AND HOUSING NEEDS TO PROVIDE FOR WORKFORCE AND AFFORDABLE HOUSING OPPORTUNITIES WHILE PRESERVING LOCAL CONTROL OF GROWTH MANAGEMENT; (2) ENSURE THAT ELECTRIC VEHICLES CONTRIBUTE FAIRLY TO THE FUNDING NEEDS FOR FLORIDA'S TRANSPORTATION INFRASTRUCTURE; (3) PRESERVE MUNICIPAL AUTHORITY OVER UTILITY FUND REVENUE GENERATION AND USE; (4) CONTINUE TO PERMIT LOCAL GOVERNMENTS TO LEVY AND COLLECT PROPERTY TAXES TO FULLY FUND MUNICIPAL SERVICES; AND (5) PRESERVE REASONABLE CAPS ON SOVEREIGN IMMUNITY WAIVER AMOUNTS; FURTHER SUPPORTING THE FLORIDA LEAGUE OF CITIES' POLICY POSITIONS ON THE TOPICS OF ANNEXATION, IMPACT FEES, LOCAL BUSINESS TAXES, "ONE WATER" POLICIES, AND PUBLIC SAFETY RECRUITMENT AND RETENTION; FURTHER SUPPORTING THE 2025 LEGISLATIVE PLATFORM ADOPTED BY THE PALM BEACH COUNTY LEAGUE OF CITIES; FURTHER SUPPORTING LEGISLATION THAT WOULD RELAX HOME RULE PREEMPTIONS RELATED TO AFFORDABLE HOUSING; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES WHEREAS, the Village of Tequesta wishes to engage in productive, focused dialogue with the Florida State Senate and House of Representatives; and WHEREAS, the State of Florida 2025 Legislative Session will convene on March 4, 2025; and WHEREAS, the Village of Tequesta is an active member of the Florida League of Cities and actively support the development of priorities for the 2025 Legislative Action Agenda; and WHEREAS, the Village of Tequesta supports the 2025 Florida League of Cities legislative platform; and prioritizes legislation which would (1) allow for a collaborative approach between local government needs and housing needs to provide for workforce and affordable housing opportunities while preserving local control of growth management; (2) ensure that electric vehicles contribute fairly to the funding needs for Florida's transportation infrastructure; (3) preserve municipal authority over utility fund revenue generation and use; (4) continue to permit local governments to levy and collect property taxes to fully fund municipal services; and (5) preserve reasonable caps on sovereign immunity waiver amounts; and 1 Page 5 of 50 Agenda Item #1. WHEREAS, the Village of Tequesta further supports the Florida League of Cities' policy positions on the topics of annexation, impact fees, local business taxes, "One Water" policies, and public safety recruitment and retention; and WHEREAS, The Village Council further supports the formation of the 2025 Palm Beach County League of Cities Legislative Platform; and WHEREAS, The Village Council of the Village of Tequesta further supports legislation that would, while recognizing the need for affordable housing in Palm Beach County, relax the home rule preemptions that have been enacted into state law through the Live Local Act. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA: SECTION 1. The above recitals are declared to be true and correct and are incorporated herein by reference. SECTION 2. The Village Council supports the formation of the 2025 Florida League of Cities Legislative Platform attached hereto and incorporated as "Exhibit A" as part of the legislative priorities of the Village of Tequesta. As an active member of the Florida League of Cities, the Village of Tequesta, through the Village Council, will also support additional legislative priorities identified by the Florida League of Cities, unless the Village Council determines that it is in the best interests of the Village and its residents to take a contrary position. SECTION 3. The Village Council hereby adopts as priorities legislation which would (1) allow for a collaborative approach between local government needs and housing needs to provide for workforce and affordable housing opportunities while preserving local control of growth management; (2) ensure that electric vehicles contribute fairly to the funding needs for Florida's transportation infrastructure; (3) preserve municipal authority over utility fund revenue generation and use; (4) continue to permit local governments to levy and collect property taxes to fully fund municipal services; and (5) preserve reasonable caps on sovereign immunity waiver amounts. SECTION 4. The Village Council supports the Florida League of Cities' policy positions on the topics of annexation, impact fees, local business taxes, "One Water" policies, and public safety recruitment and retention as stated in Exhibit "A". SECTION 5. The Village Council recognizes the need for affordable housing in Palm Beach County; however, it would strongly support legislation that relaxes the home rule preemptions enacted by the Florida Legislature through the Live Local Act. SECTION 6. The Village Council further supports the formation of the 2025 Palm Beach County League of Cities Legislative Platform attached hereto and incorporated as "Exhibit B" as part of the legislative priorities of the Village of Tequesta. 2 Page 6 of 50 Agenda Item #1. FLORIDA LEAGUE OF CITIES 2025 LEGISLATIVE YPI A 1 0 0 0 0 0 0 0 '40 'P PLATFORM 0 0 0 0 0 0 a PRIORITIES: Affordable Housing The Florida League of Cities SUPPORTS legislation that allows for a collaborative approach that balances the pressing needs for affordable and workforce housing while respecting the ability of Local governments to effectively manage growth to ensure developments align with the character, capabilities and resources of each community. Electric Vehicles The Florida League of Cities SUPPORTS legislation that ensures all vehicles, regardless of fuel type, contribute fairly to the funding of Florida's transportation infrastructure,which will allow cities to maintain safe and reliable roads for all residents. Enterprise Fund Transfers and Extraterritorial Surcharges The Florida League of Cities SUPPORTS preserving municipal authority over utility revenues and the ability to realize a reasonable rate of return on utility assets. Legislation should honor current practices, existing contracts, utility operation and maintenance costs, service territory obligations and revenues obligated for debt service and planned projects. Property Taxes The Florida League of Cities SUPPORTS the levy of property taxes by municipalities to provide critical services such as infrastructure, police,fire and emergency services. Further changes or exemptions to the property tax system and tangible personal property taxes would create inequities and unfairly shift the tax burden onto families, homeowners, renters, businesses and our most vulnerable population. Sovereign Immunity The Florida League of Cities SUPPORTS preserving reasonable sovereign immunity liability caps for municipal governments to protect taxpayer funds and ensure delivery of public services. POLICY POSITIONS: Annexation The Florida League of Cities SUPPORTS legislation that facilitates the municipal annexation of unincorporated areas in a manner that respects municipal boundaries, protects private property rights and encourages cooperation between municipal and county governments. Impact Fees The Florida League of Cities SUPPORTS protecting municipal authority to set impact fees that safeguard existing taxpayers from incurring additional infrastructure costs.
