RESOLUTION 03-25, A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, SETTING THE MUNICIPAL ELECTIONS CANDIDATE FILING FEE
PURSUANT TO SECTION 2-272 OF THE VILLAGE CODE OF ORDINANCES; PROVIDING FOR
AN EFFECTIVE DATE.
Upon review, there is no Resolution on file establishing the qualifying filing fee. However, Ordinance
303, adopted on August 11, 1981 (43 years ago), set the fee at $30. Prior to that, in the 1960s, the
fee was 5% of the council salary.
In accordance with Sec. 2-272 — Filing Fee, which requires the fee to be set by Resolution,
recommend that the Council approve setting the qualifying filing fee at 1% of the council salary and
adopt it by Resolution.
A review of other municipalities shows a wide range of qualifying fees, from $0 (typically where
council members do not receive a salary) to $1,894, with a wide array of amounts in between.
Sec. 2-272. - Filing fee.
Any qualified candidate seeking election as a member of the village council shall pay a filing fee as
set by resolution of the village council and on file in the village clerk's office, which shall be paid at
time of notice of candidacy.

RESOLUTION 03-25
A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, SETTING THE MUNICIPAL ELECTIONS
CANDIDATE FILING FEE PURSUANT TO SECTION 2-272 OF THE
VILLAGE CODE OF ORDINANCES; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 2-272 of the Village Code of Ordinances provides that any
qualified candidate seeking election as a member of the Village Council shall pay a filing
fee as set by resolution of the Village Council and maintained on file in the Village
Clerk's Office; and
WHEREAS, the Village Council seeks to set a fair and reasonable filing fee for
candidates seeking election to the Village Council that recognizes the existence of
actual costs to the Village associated with managing elections, and accounting for
inflation since its original determination in 1981 (via Ordinance 303); and
WHEREAS, the Village Council has determined the appropriate Village
candidate qualifying filing fee beginning in the year2025 is 1% of council salary; and
WHEREAS, the Village Council finds that setting the municipal election qualifying
fee as provided herein is appropriate and serves the general public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA FLORIDA, AS FOLLOWS:
Section 1. As required by Sec. 2-272 of the Village of Tequesta Code of Ordinances,
the qualifying filing fee to qualify for municipal elected office in the Village of Tequesta is
hereby be set at 1% of council salary.
Section 2. This filing fee shall be paid by the qualifying candidate as part of the
qualifying process required by the Village of Tequesta Charter.
Section 3. The Village Clerk is hereby directed to maintain a copy of this Resolution on
file in the Village Clerk's Office and to ensure compliance with Section 2-272 of the
Village Code of Ordinances.
Section 4. This Resolution shall take effect immediately upon adoption.
