The Village Council adopted Resolution 21-19 at the July 11, 2019, Regular Village Council meeting. The resolution established a seven (7) member Environmental Advisory Committee (EAC) that will serve at the pleasure of the Council. There was no specific meeting scheduled aligned with the resolution; however, the resolution does require them to hold public meetings and report/present recommendations to the Village Council for further direction. Per Resolution 21-19, the EAC was tasked with developing recommendations for best practices, fostering community partnerships, and within the bounds of the Village's Comprehensive Development Plan, developing recommendations for goals, objectives, and polices relative to sustaining and improving the environment of the Village. At the May 8, 2025, Regular Village Council meeting, the Council made annual appointments to Boards and Commissions; however, we did not have any applicants for the vacant seat on the EAC after advertising for the position on two occasions. At the meeting, the Village Council had a desire to further the discussion on the Environmental Advisory Committee Vacancy and Meeting Schedule. Village of Tequesta RESOLUTION NO. 21-19 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FOR A VILLAGE OF TEQUESTA ENVIRONMENTAL COMMITTEE; PROVIDING FOR COMMITTEE COMPOSITION, AUTHORITY & RESPONSIBILITIES; PROVIDING FOR COMPLIANCE WITH LAWS; PROVIDING FOR SUNSET OF SAID COMMITTEE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS,the Village of Tequesta is a waterfront community which both benefits from, and impacts,coastal and inland waterways; and WHEREAS,the Village of Tequesta is home to a variety of natural and park areas,including a fully developed golf course a natural preserve area and all manner of parklands in between; and WHEREAS, the wellbeing of all these natural and public resources, as well as the general wellbeing of all residential and commercial landscaped areas and vegetation areas is of great importance to the Village Council; and WHEREAS, negative impacts on the Villages environment and its natural and public resources can come from sources from within and from outside of the Village and with proper education and regulation may be controlled or mitigated; and WHEREAS,in an effort to preserve and protect all of the Village's environmental resources and amenities,the Village Council of the Village of Tequesta,Florida,now desires to provide for a "Village of Tequesta Environmental Committee"; and WHEREAS, the Village Council desires to provide for the committee's composition, its authority&responsibilities, and for its compliance with applicable laws; and WHEREAS,the Village Council desires to provide for the sunset of the committee. Section 3: The Village of Tequesta Environmental Committee shall hold public meetings for the purpose of developing recommendations for best practices,fostering community partnerships, and within the bounds of the Village's Comprehensive Development Plan, developing recommendations for goals, objectives and policies relative to sustaining and improving the environment of the Village of Tequesta. The Village of Tequesta Environmental Committee shall report to the Village Council from time to time and shall present its recommendations to the Village Council for further direction, final review and ultimate approval. Section 4:_ The Village of Tequesta Environmental Committee shall appoint from among its membership a Chair and a Vice-Chair,and shall establish its own rules of procedure;however any such rules shall comply with and be subject to the Florida Government in the Sunshine laws and the Florida Public Records Act. Additionally, all committee members shall be bound by the Florida Code of Ethics and the Palm Beach County Code of Ethics for appointed officials. Section 5:, The Village of Tequesta Environmental Committee shall continue until such time as the Village Council shall by resolution deem the committee to no longer be required and dissolve same. NATURAL RESOURCES PRESERVATION ADVISORY BOARD Sec. 2-135. Created; composition; terms of office. A natural resources preservation advisory board is hereby created,consisting of seven (7) members, each of whom shall be appointed by the town commission for a term of three(3)years.The regular term of a board member shall commence on May 1 and shall expire on April 30 of the third year following appointment. Each member of the board shall serve until the expiration of the member's term,or until a successor is appointed.The town commission shall initially appoint members for staggered terms; however, no terms shall extend beyond six (6)consecutive years. In the event a member is appointed for a term that will continue beyond the six(6) consecutive years limit,the member shall be allowed to complete the term. (Ord. No. 18-004, §2, 6-5-18) Sec. 2-136. Qualifications for membership. (d) Assist in the effort to encourage homeowners and associations to keep adequate levels of vegetation on the beach in order to avoid erosion. (e) Promoting green landscaping and advocating environmental concerns relating to plastics,etc. (f) Make recommendations about regulations related to beach cleaning as the board sees fit. (g) Assist the town commission, upon the commission request,with items and issues related to waterways within the corporate limits of the town including boat wakes, manatee protection and mangroves. The powers and duties of the environmental advisory board shall include the following: (a) Provide advice to the planning and zoning board and to the city council on the environmental impact of proposed developments which contain environmentally sensitive lands, listed species,or wetlands, including public works within the city's jurisdiction,and to recommend ways in which adverse environmental impact might be minimized. (b) Provide advice upon request to the planning and zoning board and to the city council regarding proposed amendments to the comprehensive plan or elements or portions thereof, proposed amendments to the zoning district regulations,and other matters as may be requested. (c) Study and make recommendations with regard to the reclamation and restoration of degraded property. (d) Study and advise the city council on public health problems resulting from environmental pollution. (e) Review existing and proposed city ordinances which affect the environment, and advise the planning and zoning board and the city council regarding the need for modifications or changes to such ordinances. (f) Advise the city council regarding environmental and conservation elements of the comprehensive plan. (g) Establish and maintain liaison with other governmental bodies and private institutions relating to the enhancement of environmental quality and maintain liaison with the general public regarding all environmental matters. Boylan, Town Clerk SUBJECT: Resolution 31-19; Establishing the Environmental Task Force EXECUTIVE SUMMARY: At the February 5, 2019 Town Council Meeting, the Town Council held a roundtable discussion regarding the establishment of an Environmental Task Force. Based on the discussion, the Task Force shall compose of nine members, one (1) member to be appointed by each member of the Council; two (2) at-large members, and two (2) alternate members who shall be appointed by a majority of the Council. The members shall be Jupiter residents with an interest in the environment; one (1) member with an environmental or scientific background and one (1) member shall be a local business owner. The Task Force meetings shall be quarterly or more frequently if deemed necessary. There is not currently a sunset provision provided for the Environmental Task Force. Should the Council desire a sunset provision (similar to that of the Education Committee), this should be added at the Council's discretion. Resolution No. 31-19 is provided for Council's consideration. RECOMMENDATION Staff recommends approval of Resolution No. 31-19 Establishing an Environmental Task Force. The resolution has been reviewed and approved for legal sufficiency by the Town Attorney. Council appointments are tentatively scheduled for the May 7, 2019 Town Council Meeting. This will allow 30-45 days to advertise for volunteers and final review of the applications to ensure qualified applicants meet Council's desired qualifications. RESOLUTION NO. 31-19 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF JUPITER, FLORIDA, ESTABLISHING AN ENVIRONMENTAL TASK FORCE; PROVIDING FOR THE COMPOSITION AND QUALIFICATIONS FOR MEMBERSHIP; PROVIDING FOR THE PURPOSE AND AUTHORITY THEREOF; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, t h e Town Council is committed to promoting and supporting natural areas, open spaces, tree preservation, and create sustainability initiatives; and WHEREAS, the Town's Strategic Plan includes strategic goals focused on Green, Blue, and Open Spaces; and WHEREAS, in order to maintain the Town's distinctive coastal community with open and natural environments; and WHEREAS, the Town Council believes that it is imperative to focus on the waterways, preserve natural vegetation, promote access and use of green spaces, and create open spaces for the protection of the environment ; and WHEREAS, the Town Council believes that the establishment of an Environmental Task Force to address tree preservation related to Code revisions and best practices, evaluation of the Town's Code and policies to create sustainability initiatives, and address open spaces; and NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF JUPITER, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Sectionl. The Council hereby establishes a Task Force to be known as The Town of Jupiter Environmental Task Force, (hereinafter"Task Force"). Section 2. Composition. The Task Force shall be composed of nine members, one member to be appointed by each member of the Council; two (2) at-large members, and two (2) alternate members who shall be appointed by a majority of the membership of the Council. The purpose of the Task Force is to provide information and recommendations to the Town Council regarding tree preservation related to Town Code revisions and best practices, identify and address open spaces opportunities, and review the Town's Code and policies to recommend sustainability initiatives in the Town of Jupiter. Section 6. Authority. The recommendations of the Task Force shall not be final or binding on the Town Council but shall be advisory only. Any and all reports, proposals or recommendations prepared by the Task Force shall be submitted to the Town Manager, prior to publication or release. Section 7. Compensation. The members of the Task Force shall serve without compensation. Section 8. Minutes of Meetings. Minutes shall be kept of all meetings held by the Task Force and shall include and state the vote of each member on any question or issue presented for vote of the membership. Section 9. Public Records. All records of the Task Force, including its minutes and any resolutions shall be open for public inspection during the Town's business hours. Section 10. Rules of Procedure. The conduct of the Task Force business and holding of its meetings shall be governed by Roberts Rules of Order. Section 11. Meetings. The Task Force shall meet on a quarterly basis at a minimum, or more frequently if deemed to be necessary. Section 12. This Resolution shall take effect immediately upon its execution. (a) Composition.The committee shall consist of seven (7) members. (b) Terms.The village council shall appoint members on an annual basis during April of each year to take effect the following May 1 for staggered terms of two(2)years as determined by the council. Village of Tequesta 345 Tequesta Drive 561-768-0700 Tequesta, FL 33469 www.tequesta.org TO: Village of Tequesta Council FROM: Brad Freese, Chair EAC DATE: 05/20/2025 SUBJECT: Environmental Advisory Committee Seat 6 Vacancy The Environmental Advisory Committee unanimously recommends to Council to keep seat 6 open and continue advertising the seat vacancy. In the five months of the seat 6 absence the committee has achieved quorum. The frequency of our meetings was discussed by the committee earlier this year. It was unanimous that a once-a-month meeting is an adequate frequency. If this changes and the committee deems the frequency excessive, we will revisit and make a recommendation to Council. If there is a lack of content to discuss, which hasn't occurred in 3+ years of committee participation, I have authority to cancel the scheduled meeting. The committee also unanimously recommends to Council to continue with the 2 pm start time. We discussed the possibility of having a later start time to make it more feasible for community participation/comments during our regular meetings. To test this later start time, we coordinated with the Community Development Department and held a living shorelines event in March with a start time of 6 pm. There was passive advertising through the weekly newsletter and direct mail advertising to our waterfront property owners. We had a group of four join the event. I understand the event was a focused subject unlike our regular committee meetings, but I consider this a reasonable barometer. The EAC would like to recommend to Council to broaden the eligibility requirements to fill seat 6 to include candidates not residing in Tequesta. We believe opening this vacancy to local environmentally focused subject matter experts and residents of surrounding communities will be a beneficial addition to Tequesta. The 2019 resolution (21-19) established the EAC to "control or mitigate negative impacts on the Village's environment from sources within and OUTSIDE the Village".
