Background In late April 2025, Village staff met with Amy and Rob Swan, the owners of 19245 North Riverside, a parcel of land in unincorporated Palm Beach County. The Swans expressed interest in annexing their property into the Village, as it is bordered by the Village's municipal boundaries on three sides. The property is also identified as part of Annexation Area C in the Village's Potential Annexation Area map, which is incorporated into the Village's Comprehensive Plan. Site Plan Overview The property has a site plan that was approved by Palm Beach County on March 4, 2025. The site plan contains eight single family lots, a small passive park, and a dry retention area. The Swans indicated that the site plan approval process with Palm Beach County was lengthy and costly. As such, they did not want to have to go through the process again if they opted to annex into the Village. Village staff, in consultation with the Village Attorney have confirmed that the existing site plan can be adopted as part of the annexation process. The approved site plan has 3.75 units per acre, which is below the Village's allowed residential density of 5.4 units per acre in the low-density residential district. There are some inconsistencies between the Village's standard zoning regulations in the R-1 District and the approved site plan, which is common in the subdivision process. If the project was going through the Village's full site plan review process, the Planned Residential Development (PRD) process would create a path to approve the project. Annexation Process Page 119 of 313 Agenda Item #19. On May 14, 2025, the Swans formally submitted a petition to voluntarily annex their property into the municipal boundaries of Tequesta. The Village then followed the annexation procedures required by the Florida Statutes and Palm Beach County Ordinance 2007-018. Within 10 days of the annexation request, the Village provided copies of the request, along with an annexation report to Palm Beach County. Additionally, the Village provided a notice of hearing to the County and published notice of the annexation in the Palm Beach Post on June 23, 2025, and June 30, 2025. Next Steps Annexation Ordinance 05-25 will undergo two readings. The second reading is scheduled for August 14, 2025. If adopted, the Village will be required to file the executed ordinance with the Clerk of the Circuit Court, the County Administrator, and the Department of State within seven days. Upon receipt, the County will notify the Property Appraiser and all applicable County departments that the annexation has taken place. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: SECTION 1. The lands described in EXHIBIT A attached hereto, lying, and being situated in Palm Beach County, FL are hereby annexed to and included within the boundaries of the Village of Tequesta, Florida, a municipal corporation. SECTION 2. The Village Manager is hereby directed to do all things necessary to effectuate this annexation. SECTION 3. The additional territory annexed shall retain the comprehensive plan future land use and zoning classifications existing at the time this ordinance is approved, as those classifications appear in the comprehensive plan and zoning ordinances of Palm Beach County, Florida, until such time as the Village of Tequesta adopts a comprehensive plan future land use and zoning designation for the annexed property as described above. In addition, the Village accepts the March 4, 2025 Palm Beach County Planning, Zoning, and Building Department "DRO Result Letter — Approval" including its attached conditions of approval. SECTION 4. The Village Clerk is instructed to file this ordinance with the Clerk of the Circuit Court, with the Chief Administrative officer of Palm Beach County, Florida and with the Florida Department of State within (7) days of the adoption of this ordinance. SECTION 5. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION 6. Should any section or provision of this Ordinance or any portion thereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part thereof other than the part to be declared invalid.
