Regular Council STAFF MEMO x Meeting: Regular Council - Aug 12 2025 Staff Contact: Jeffery Snyder, Finance Director Department: Finance RESOLUTION NO. 17-25, A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, ADOPTING THE REFUSE, RECYCLING AND YARD WASTE COLLECTION RATES FOR FISCAL YEAR ENDING SEPTEMBER 30, 2026 AND AUTHORIZING THE VILLAGE MANAGER TO PROCEED IN ACCORDANCE WITH THE VILLAGE'S ADOPTED PROCEDURES; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES M. In accordance with the Uniform Method of Collection for non-ad valorem assessments, the Village of Tequesta is required to adopt refuse, recycling, and yard waste collection rates by resolution and transmit the adopted rates to the Palm Beach County Property Appraiser's Office for assessment. The Village currently holds a franchise agreement with WM (formerly Waste Management), which remains in effect through September 30, 2030. This agreement includes an annual rate adjustment provision tied to the United States Consumer Price Index (CPI) for Water, Sewer, and Trash Collection (WST), as published monthly by the U.S. Bureau of Labor Statistics. The contractual annual increase is capped at 5.75%. As of April 2025—the date referenced in the agreement—the applicable CPI increase was calculated at 4.88%. In addition to the CPI-based adjustment, staff recommends an additional 3.5% increase. This increment is intended to offset the Village's cost burden associated with early payment discounts (up to 4% as allowed by statute) and the expense of noticing ratepayers of the updated assessments. As required by state law, the Village has duly notified all residential ratepayers of the proposed changes. (The total estimated revenue represents the gross revenue absent of any discounts.) The public notice included the following statement: "The Village of Tequesta is considering a non-ad valorem assessment of up to $252.96 per Residential Class Dwelling Unit (RCDU) starting with the 2025 tax year and continuing annually until such assessment is discontinued. This assessment will fund residential waste collection, processing, disposal, and related services. The proposed increase is $19.56 per year ($1.63 per month) per RCDU, raising the current annual rate from $233.40 to $252.96. The total estimated revenue from this assessment is $798,488."
