SPECIAL MAGISTRATE MEETING
VILLAGE OF TEQUESTA, FL

CALL TO ORDER
The Special Magistrate Kevin Wagner began the meeting at 10.00 am and led the pledge of
allegiance. Present were Special Magistrate Kevin Wagner, Code Enforcement Officer Benjamin
Norman, Jupiter Inlet Colony Code Enforcement Jacqueline Milo, Village Attorney Dylan
Brandenburg and Jupiter Inlet Colony Attorney William Doney. The following cases were heard
by the Special Magistrate who swore in 4 people involved in the Quasi-Judicial cases.

FINE ASSESSMENT HEARINGS/ STATUS HEARINGS
1. Case Number: E240144 Buckwalter
48 Wingo, Tequesta FL 33469
Chapter 30, Sec 30-33 - Prohibited Conditions - Grass, weeds, overgrowth, rubbish,
trash, debris
The findings of facts were:
The Respondents were the owners of the above-described property. The Respondents
were present at the hearing; there was a finding of proper notice. Building Official Wayne
Cameron provided testimony and evidence of the violation, as contained in the Village's
evidentiary case file which was accepted into evidence without objection.
By the "Order Finding Violation" dated March 12th , 2024, the Special Magistrate ordered
the Respondents to comply with Chapter 30, Section 30-33 of the Code of Ordinances of
the Village of Tequesta by April 11 2025. If the respondents failed to achieve compliance
by the above date, a daily fine of fifty ($50.00) per day would be accessed against the
property for each day thereafter the violation continues to exist.
Based upon the evidence, pictures, and testimony presented at the hearing on June 11
2025, the property remained out of compliance as of the date ordered.
Conclusions of law were that the property remains in violation of Chapter 30, Section 30-
33 of the Code of Ordinances of the Village of Tequesta.
It was the order of the Special Magistrate that a Fine of fifty dollars ($50.00) per day be
assessed against the propel iy for each day the property remains in violation of
Chapter 30, Section 30-33 of the Code of Ordinances of the Village of Tequesta
beginning April 12"', 2025, and continuing until the property comes into compliance.
The respondent was further ordered to pay administrative costs in the amount of
seven-hundred and twenty dollars ($720.00) incurred be the Village for the March 12
2025 & June 9 2025, hearings.
Upon complying with any code compliance matter, it was always the responsibility of the
Respondents to contact the Code Compliance Division at (561) 768-0458 to request a
reinspection of the property.
2. Case Number. JIC-25-1-CE Jacobs

Section 9-11 Property Maintenance and Appearance Standards
The findings of facts were:
Respondents, Lori Jacobs and Michael Jacobs, are the owners of the above-described
property. Respondent, Lori Jacobs, attended the hearing and there was a finding of
proper notice. Jacqueline Milo, Code Compliance Officer, provided testimony and
evidence on behalf of the Town. In the Order Finding Violation and Notice of Hearing
dated April 22, 2025, the Special Magistrate ordered Respondents to comply with Section
9-11 of the Town Code; Sections 304.1.1, 304.2, 304.5, 304.6, 304.8, 308.1 of the
International Property Maintenance Code and Section 105.1, Florida Building Code on or
before April 30, 2025 or be subject to a fine. Based on the evidence presented at the
June 11, 2025 hearing, Respondents have not fully complied with the above-referenced
code sections and said violations are continuing. More particularly, Respondents have
not completed the repainting of the property, the wall along the public walkway has not
been painted, cornices and roof tiles at the property need to be securely attached and the
hole or opening in the south wall of the house needs to be covered.
The conclusion of the law was that the above-stated facts constitute a failure by
Respondents to fully comply with the April 22, 2025 Order.
It was the Order of the Special Magistrate that a fine in the amount of Six Thousand
Three Hundred ($6300.00) Dollars was hereby assessed at the amount of One Hundred
Fifty ($150.00) Dollars per day for the Code violations which have existed on the
property from May 1, 2025 to June 11, 2025, a period of forty-two (42) days, and such
amount will continue to accrue at the rate of One Hundred Fifty ($150.00) Dollars per
day until compliance is achieved.
Upon complying in any code enforcement matter, it was always the responsibility of the
Respondent to contact the Code Enforcement Department at (561) 701-3276, to request
a reinspection of the property.
VIOLATION HEARINGS
3. Case Number: JIC-25-23-CE Buck

Section 9-11 Property Maintenance and Appearance Standards
The findings facts were the respondent was the owner of the above-described property.
Respondent did not attend the hearing and there was a finding of proper notice.
Jaqueline Milo, Code Compliance Officer, provided testimony and evidence on behalf of
the Town.
The roof on the house at the property is discolored, weathered, has evidence of
deterioration and is in need of being cleaned.
The conclusion of law, based on the above-stated facts, Respondent was in violation of
Section 9-11 of the Town Code and Section 304.1 of the International Property
Maintenance Code.
I was the order of the Code Enforcement Special Magistrate that Respondent had to
comply with the referenced Code Sections by July 2, 2025. If Respondent did not
comply within the time specified, a fine in the amount of Two Hundred Fifty ($250.00)
Dollars per day may be imposed for each day the violation continues to exist.
Upon complying in any code enforcement matter, it was the responsibility of the
Respondents to contact the Code Enforcement Department at (561)701-3276 to request
a re-inspection of the property.
