AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA PROVIDING FOR THE VOLUNTARY
ANNEXATION OF ADDITIONAL TERRITORY OWNED BY ROBERT &
AMY SWAN TO BE INCLUDED WITHIN THE VILLAGE BOUNDARIES
IN ACCORDANCE WITH ARTICLE VIII SECTION 2(c) OF THE
CONSTITUTION OF THE STATE OF FLORIDA, SECTION 171.044,
FLORIDA STATUTES AS AMENDED, AND SECTION 4.02 OF THE
VILLAGE OF TEQUESTA CHARTER; REDEFINING THE BOUNDARIES
OF THE VILLAGE OF TEQUESTA TO INCLUDE ALL OF SAID REAL
PROPERTY; DIRECTING THE VILLAGE MANAGER TO DO ALL
THINGS NECESSARY TO EFFECTUATE THIS ANNEXATION;
DIRECTING THE VILLAGE CLERK TO FILE A COPY OF THIS
ORDINANCE WITH THE CLERK OF THE CIRCUIT COURT IN PALM
BEACH COUNTY, THE CHIEF ADMINISTRATIVE OFFICER OF PALM
BEACH COUNTY AND WITH THE DEPARTMENT OF STATE WITHIN
(7) DAYS AFTER ADOPTION; PROVIDING A CONFLICTS CLAUSE
AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
WHEREAS, the Village Council of the Village of Tequesta, Florida has received a
voluntary annexation request by all owners of the approximately 2.17 acres of contagious
land more thoroughly described in EXHIBIT A attached hereto; and
WHEREAS, the above parcels of real property comprise one area of contiguous,
compact, unincorporated territory in and adjacent to the Village of Tequesta, all of which
have been developed or are suitable for development for urban purposes;
WHEREAS, the voluntary annexation of said parcels will not result in the creation
of an enclave; and
WHEREAS, the Village of Tequesta has caused all required advertisements and
notices to be published and sent to all required recipients pursuant to Sec. 171.044,
Florida Statutes; and
WHEREAS, the Village is authorized by Chapter 171, Florida Statutes, to annex
contiguous and infill areas, and to extend the Village limits upon receipt of written consent
of the landowners together with the approval of the Village Council after notice and public
hearing; and
WHEREAS, The Village Council of the Village of Tequesta, Florida has reviewed
and evaluated the petition submitted, and has determined that the annexation of said
lands into the Village is in the public interest and is consistent with the Village's
Comprehensive Plan and Land Development Regulations.

NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS:
SECTION 1. The lands described in EXHIBIT A attached hereto, lying, and being
situated in Palm Beach County, FL are hereby annexed to and included
within the boundaries of the Village of Tequesta, Florida, a municipal
corporation.
SECTION 2. The Village Manager is hereby directed to do all things necessary to
effectuate this annexation.
SECTION 3. The additional territory annexed shall retain the comprehensive plan
future land use and zoning classifications existing at the time this ordinance
is approved, as those classifications appear in the comprehensive plan and
zoning ordinances of Palm Beach County, Florida, until such time as the
Village of Tequesta adopts a comprehensive plan future land use and
zoning designation for the annexed property as described above. In
addition, the Village accepts the March 4, 2025 Palm Beach County
Planning, Zoning, and Building Department "DRO Result Letter—Approval"
including its attached conditions of approval.
SECTION 4. The Village Clerk is instructed to file this ordinance with the Clerk of
the Circuit Court, with the Chief Administrative officer of Palm Beach
County, Florida and with the Florida Department of State within (7) days of
the adoption of this ordinance.
SECTION 5. All Ordinances or parts of Ordinances in conflict herewith are hereby
repealed.
SECTION 6. Should any section or provision of this Ordinance or any portion
thereof, any paragraph, sentence or word be declared by a court of
competent jurisdiction to be invalid, such decision shall not affect the validity
of the remainder hereof as a whole or any part thereof other than the part
to be declared invalid.
SECTION 7. Effective Date. This Ordinance shall take effect immediately upon
its passage and consistent with all requirements of general law.
