Regular Council STAFF MEMO A-1 Meeting: Regular Council - Nov 13 2025 Staff Contact: Keith Davis, Village Attorney Department: Legal RESOLUTION NO. 24-25, A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, SUPPORTING THE 2026 FLORIDA LEAGUE OF CITIES LEGISLATIVE PLATFORM; PRIORITIZING AGENDA LEGISLATION THAT WOULD, IN GENERAL, SUPPORT AND PROTECT MUNICIPAL HOME RULE FOR SUBJECT MATTER INCLUDING, BUT NOT LIMITED TO LEGISLATION REGARDING HOUSING (LAND DEVELOPMENT / RE- DEVELOPMENT, AND CODE COMPLIANCE), LEGISLATION REGARDING MUNICIPAL OPERATIONS (SOVEREIGN IMMUNITY AND OPEN CARRY FOR FIREARMS), LEGISLATION REGARDING UTILITIES, NATURAL RESOURCES, AND PUBLIC WORKS (ENTERPRISE FUND TRANSFERS, AND "ONE WATER" POLICIES), LEGISLATION REGARDING INTERGOVERNMENTAL RELATIONS, LEGISLATION REGARDING TRANSPORTATION AND MOBILITY, LEGISLATION REGARDING EMERGENCY MANAGEMENT, LEGISLATION REGARDING MUNICIPAL ELECTIONS, AND LEGISLATION REGARDING REGULATION OF E- BIKES; FURTHER SUPPORTING THE 2025 LEGISLATIVE PLATFORM ADOPTED BY THE PALM BEACH COUNTY LEAGUE OF CITIES; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. SUMMARY: Resolution 24-25 is the annual legislative policy resolution that the Council sees prior to each legislative session. THE resolution addresses legislative issues at both the state and local level. RESOLUTION NO. 24-25 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, SUPPORTING THE 2026 FLORIDA LEAGUE OF CITIES LEGISLATIVE PLATFORM; PRIORITIZING AGENDA LEGISLATION THAT WOULD, IN GENERAL, SUPPORT AND PROTECT MUNICIPAL HOME RULE FOR SUBJECT MATTER INCLUDING, BUT NOT LIMITED TO LEGISLATION REGARDING HOUSING (LAND DEVELOPMENT / RE-DEVELOPMENT, AND CODE COMPLIANCE), LEGISLATION REGARDING MUNICIPAL OPERATIONS (SOVEREIGN IMMUNITY AND OPEN CARRY FOR FIREARMS), LEGISLATION REGARDING UTILITIES, NATURAL RESOURCES, AND PUBLIC WORKS (ENTERPRISE FUND TRANSFERS, AND "ONE WATER" POLICIES), LEGISLATION REGARDING INTERGOVERNMENTAL RELATIONS, LEGISLATION REGARDING TRANSPORTATION AND MOBILITY, LEGISLATION REGARDING EMERGENCY MANAGEMENT, LEGISLATION REGARDING MUNICIPAL ELECTIONS, AND LEGISLATION REGARDING REGULATION OF E-BIKES; FURTHER SUPPORTING THE 2026 LEGISLATIVE PLATFORM ADOPTED BY THE PALM BEACH COUNTY LEAGUE OF CITIES; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the Village of Tequesta wishes to engage in productive, focused dialogue with the Florida State Senate and House of Representatives; and WHEREAS, the State of Florida 2026 Legislative Session will convene on January 13, 2026; and WHEREAS, the Village of Tequesta is an active member of the Florida League of Cities and actively support the development of priorities for the 2026 Legislative Action Agenda; and WHEREAS, the Village of Tequesta supports the 2026 Florida League of Cities legislative platform; and prioritizes legislation which would in general, support and protect municipal home rule for subject matter including, but not limited to legislation regarding housing (land development / re-development, and code compliance), legislation regarding municipal operations (sovereign immunity and open carry for firearms), legislation regarding utilities, natural resources, and public works (enterprise fund transfers, and "One Water" policies), legislation regarding intergovernmental relations, legislation regarding transportation and mobility, legislation regarding emergency management, legislation regarding municipal elections, and legislation regarding regulation of e-bikes; and WHEREAS, the Village Council further supports the 2026 Palm Beach County League of Cities Legislative Platform. 1 Page 602 of 603 Agenda Item #30. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA: SECTION 1. The above recitals are declared to be true and correct and are incorporated herein by reference. SECTION 2. The Village Council supports the formation of a 2026 Florida League of Cities Legislative Platform which would, in general, support and protect municipal home rule for subject matter including, but not limited to legislation regarding housing (land development / re-development, and code compliance), legislation regarding municipal operations (sovereign immunity and open carry for firearms), legislation regarding utilities, natural resources, and public works (enterprise fund transfers, and "One Water" policies), legislation regarding intergovernmental relations, legislation regarding transportation and mobility, legislation regarding emergency management, legislation regarding municipal elections, and legislation regarding regulation of a-bikes as part of the legislative priorities of the Village of Tequesta. As an active member of the Florida League of Cities, the Village of Tequesta, through the Village Council, will also support additional legislative priorities identified by the Florida League of Cities, unless the Village Council determines that it is in the best interests of the Village and its residents to take a contrary position. SECTION 3. The Village Council further supports the formation of the 2026 Palm Beach County League of Cities Legislative Platform attached hereto and incorporated as "Exhibit A" as part of the legislative priorities of the Village of Tequesta. SECTION 4. The Village Manager is directed to forward a copy of this resolution to the members of the Florida League of Cities and all local representatives. SECTION 5. This resolution shall take effective immediately upon its adoption. 2 Page 603 of 603
