The subject property is located in the Multifamily Residential R-3 Zoning District in the Village of Tequesta. 2. The applicant has submitted all documents required by the Village's Code of Ordinances. 3. The application and all supporting documentation and presentation materials as reviewed by the Village Council at its November 13, 2025 meeting,and as kept on file by the Village, are made a part hereof and are hereby incorporated by reference. 4. According to Section 78-331, site plan approval is required prior to issuance of a building permit since the project is not located in the R-1 or R-IA zoning districts. 5. The applicant has applied for a site plan modification to add a second story for office space use to the existing single story marina building as more fully described in the staff report and application materials attached hereto as Exhibit A. 6. Under the provisions of the Village Code of Ordinances, the Village Council has the Page 1 right, power and authority to act upon the request herein made. IT IS THEREUPON CONSIDERED, ORDERED AND ADJUDGED BY THE VILLAGE COUNCIL OF THE VILLAGE OF TEQUESTA, FLORIDA, AS FOLLOWS: The application for Site Plan Modification, Case No. SPM 04-25 with reference to the above described property within the Village of Tequesta,Palm Beach County,Florida,to modify the existing site plan by adding a second story for office space use to the existing single story marina building, in accordance with the supporting documentation and presentation materials as reviewed by the Village Council at its November 13,2025 meeting is hereby APPROVED since the Village Council finds that the applicant has met the standards set forth in Section 78-331 of the Tequesta Zoning Code for site plan modification, with the imposition of the following special conditions: 1. The second story shall not be used for banquets,events,or parties. If any event is to be held, a Village of Tequesta special event permit shall first be obtained pursuant to Village of Tequesta Code Sec. 78-561. 2. All mechanical equipment, including but not limited to air conditioning and generator equipment,shall be screened in compliance with Village of Tequesta Code Sec.78-299. 3. Hours of construction for the work contemplated by this development approval shall be consistent with Town of Jupiter Inlet Colony regulations of 8:00 am to 5:00 pm Monday through Friday, and 9:00 am to 5:00 pm Saturday. * The term Aapplicant(s)as used herein shall include all successors and assigns. * The applicant's site plan modification approval shall expire in twelve (12) months unless a building permit has been obtained in accordance with Sec. 78-334(h). If the building permit expires or is voided, this site plan modification approval also expires or becomes void.
