MINUTES OF THE MEETING OF THE COUNCIL
THE VILLAGE OF TEQUESTA, FLO?IDA
February 8, 1977
A Council Meeting of the Village of Tequesta , Florida
was held on Tuesday, February 8, 1977 at 7:30 'P.M. in the
Village Hall. Present were Baron, Brown, Campbell, Huggins,
and Yoder. Also present were Robert Harp, Village Manager,
Cyrese Colbert, Village Clerk and John C. Randolph, Village
Attorney. Councilman Baron gave the Prayer and Pledge of
Allegiance to the Flag. Mayor Campbell made the announcements
and the changes to the agenda were made and approved. The
Council Meeting Minutes for January 11, . 1977 Special Council
Meeting Minutes for January 18, 1977, Village Manager's Report
January 21, 1977 through February 5 , 1977 and Council Meeting
Minutes for January 25, 1977 were approved and received.
Mr. Bob Dewey, asked about the Sign Ordinance being
enfor._qed r� e rge Fischer talked about growth in this area$
The Village Attorney gave second reading "by title
only" of an Ordinance of the Village of Tequesta , Florida,
prohibiting certain truck traffic from traveling on Tequesta
Drive and Country Club Drive within the Village of Tequesta ;
providing for enforcements; and prescribing penalties for the
violation of its provisions. Brown moved, "to approve
second reading of this Ordinance . " The motion was seconded
and vote on the motion was:

therefore Ordinance No. 246 was passed and adopted on second
reading.
The Village Attorney gave second reading "by title only"
Of an-Ordinance changing the election date from the third
Tuesday of March of each year to the second Tuesday of Karch
of each year. Brown moved, "its adoption". The motion was
seconded and vote on the motion was:

therefore Ordinance No. 247 was passed and adopted on second
reading.
Mayor Campbell read a Resolution to the Council from
the Jupiter-Tequesta Ministerial Association requesting that
the opening for the Council Meetings would be "Opening
Prayer or Meditation and salute to the American Flag". Brown
moved, "that we adopt the recommendation of the Jupiter-Tequesta
Ministerial Association and use the wording "Prayer and or
Meditation and Pledge of Allegiance to the Flag". The motion
was adopted.
Mr. D.M. Shephard, Robert E. Owen & Associates,
explained to Council the up-to-date report on the- Tequesta
Drive Improvements and told Council that the sod that was to
be laid. was not green due to the recent cold spell we had,
but Should come back a soon as the cold spell ends and the
weather gets warmer. he wanted the Councils approval
to accept the sod. Huggins moved, "that Robert E. Owen
be authorized to accept sod for the Tequesta Drive Improvement
Project outside of contract with agreement by the contractor,
Gorham Construction Company, that they will replace sod
judged to be inferior after a reasonable period of time to
be determined by Mr. Shephard and Mr. Harp". The motion was
adopted.
Mr. Viilliam B. Sydow, Gee & Jenson Engineer-Architects-
Planners, Inc . , informed Council that the contract between
the Village and E .N. Murray was at the Bonding Agency in order
to receive their needed bonding. The 120 days starts the date
of the Notice to Proceed is given. Mr. Sydow told Council the
work should start by February 15 , 1977•
The Village Attorney told Council about the two times,
he went to the Loxahatchee River Environmental Control District
to ask for an extension of the June 1, 1977 deadline. The
feeling he received from the Loxahatchee River Environmental
Control District was that, since they donit own Tri-Southern,
if they gave their approval it would be premature. The Attorney
felt that since our contract is with Tri-Southern then our
dealings should be with Tri-Southern and that Tri-Southern
should give us the extention. Brown suggested that the Village
Attorney get a letter from Tri-Southern approving the 30 days
extention. Baron moved, "that we get this extention from
Tri-Southern in writing". The motion was adopted.
Baron requested that the minutes show that he has attended
Loxahatchee River Environmental Control District meetings but
has never spoken regarding the cost of $27,000. a month.
Yoder moved, "they (poll workers for Election "?7") be
approved". The motion was adopted.

Campbell told Council of the bike pa' survey. Council
discussed the bike path. Baron moved, "tha: we proceed and
build the Country Club bike and pedestrian :ath". The motion
was adopted.
Council discussed the exsisting cont-ract with the Village
of Tequesta and Gee & Jenson Engineering-Architects-Planners, Inc.
Mr. Sydow told Council he would have a proposed revision of the
contract at the February 22, 1977 Council Meeting.
Brown moved, "to lower the speed limit on Riverside Drive
to 30 M.P.H . ". The motion was adopted.
Baron proposed new water rates to Council and suggested
the Village. Water Department lower the monthly service charge
by April 1, 1977 and that we ask Tri-Southern or the Loxahatchee
River Environmental Control District to lower the wholesale price
of their water by at least 10%.
The Village Manager was authorized by Council to send a
letter to the Board of Loxahatchee River Environmental Control
District and give them a list of what needs to be done to satisfy
the surrounding areas under the Loxahatchee River Environmental
Control District .
Baron asked the minutes to show that he felt the Chair
Woman did not give him enough time to discuss his proposal of
lowering water rates.
The meeting was adjourned at 11:42 P.M.
