MINUTES OF THE PUBLIC HEARING
OF THE VILLAGE OF TEQUESTA ZONING BOARD OF ADJUSTMENT
JUNE 23, 1980
A public hearing was held by the Village of Tequesta Zoning Board
of Adjustment at 7:30 P.M. , Monday, June 23, 1980 in the Village Hall,
357 Tequesta Drive, Tequesta, Florida. Board members present were: Head-
Chairman, Bryan, Otto and Wagner. Also present were Robert Harp, Clerk of
the Board, John C. Randolph, Village Attorney and A. W. Butterfield,
Village Building Official.
The Clerk read the legal notice of the public hearing and advised
that proof of publication was in hand for the publication of the notice in
the June 5, 1980 issue of the Courier and that letter notices had been sent
to all property owners within 500 feet of the subject properties. The
Clerk further advised that a letter reply of no objection to the Finnerty
application had been received from Karl Baarslag, 371 Riverside Drive.
No oral comments had been received. The Clerk also advised that the Wells'
had submitted written approval for Scott J. Constantakos to represent them
at the hearing.
The first item for consideration was:
The application of Morris and Helen Wells, 4830 S.E. 102nd Place,
Belleview, Florida 32620, owners of Lot 7, Tequesta Pines
Subdivision (33 Wingo Street) requesting a variance to the terms
of the Official Zoning Ordinance of the Village of Tequesta,
Ordinance No. 211, as amended, Section 9.6 (1) (a) - Front Yard;
to allow the construction of a residence on the referenced lot
with the southwest corner of the southeast side of the residence
twenty-two and nine tenths (22.9) feet from the front street
line instead of twenty-five (25) feet as required by the Zoning
Ordinance.
Constantakos said the house proposed for construction on the lot
was not a large house, having a living area of approximately 1640 square feet
and a total area of approximately 2050 square feet. He further advised
that the proposed location of the house on the lot was obtained by comput-
erization.
Bryan commented that if the house was built On the front setback
line, the rear yard setback would be violated. Otto asked if this house
provided for a two (2) car garage and was advised it did. Otto stated a
single car garage was all that is required in this area by the Tequesta
Pines Deed Restrictions.
Butterfield said that since the front of other houses would be
on a curve, a slight intrusion into the front setback would probably not
be noticeable. Bryan said he did not think the granting of a reasonable
variance would affect the aesthetics of the area and suggested that
perhaps it would be better to grant the variance at the rear instead of
the front as requested. The Village Attorney advised this could be done

if the Board so desired and he could not see a problem with either way.
Constantakos said the Wells' would be agreeable to the granting of the
variance either at the front or rear and that this had been discussed with
his client. Wagner said he would prefer to have the setback violation at
the rear since the lot backs up to F.E.C. Railway Co. right-of-way.
Butterfield called the Board's attention to possible future
problems at the rear in the event someone would want to construct a
swimming pool on the lot.
Otto asked if there was any problem with two (2) cars parking
in the driveway as required by the Tequesta Pines Deed Restrictions.
Constantakos said the driveway was seventeen (17) feet wide and there
should not be a problem in this regard.
Wagner moved, seconded by Bryan that a variance be granted to
allow the construction of a residence on Lot 7, Tequesta Pines (33 Wingo
Street) with the northeast corner of the residence closer than twenty (20)
feet to the rear lot line and maintaining a setback of twenty-five (25)
feet from the front lot line for the southwest corner of the southeast
side of the residence. The vote on the motion was:

Otto For
and the motion therefore passed.
The next item for consideration was:
The application of David C. and Helen R. Finnerty, owners of
Lot 31, Block 22, Jupiter in the Pines, Section "B" (451
Evergreen Avenue) requesting a variance to the terms of the
Official Zoning Ordinance of the Village of Tequesta, Ordinance
No. 211, as amended, Section 9.6 (3) (a) - Rear Yard, to allow
the construction of a covered patio at the rear of the existing
residence using the existing concrete slab fourteen and five
tenths (14.5) feet from the rear lot line instead of twenty (20)
feet as required by the Zoning Ordinance.
The Finnerty's were in attendance at the hearing to discuss
their application. The Board had copies of the existing plot plan for the
house indicating the location of the proposed covered patio addition.
Finnerty advised the house was constructed in 1959. Bryan asked what was
on the slab now and was advised it was an open patio area. There is a
dense hedge between the subject lot and Lot 1, Block 22, owned by Craig J.
Wood, who was in attendance and advised he supported the application.
Bryan noted the proposed variance would make the screened porch only
one (1) foot closer to the rear property line than the east corner of the
existing house.

Wagner moved, seconded by Otto that a variance be granted to
allow the construction of a covered patio at the rear of the existing
residence on Lot 31, Block 22, Jupiter in the Pines, Section "B" (451
Evergreen Avenue) with a setback of fourteen and five tenths (14.5) feet
from the rear lot line. The vote on the motion was:

Bryan For
Head For
and the motion therefore passed.
The hearing was adjourned at 8:00 P.M.
