HomeMy WebLinkAboutMinutes_Regular_10/28/1980 MINUTES OF THE MEETING OF THE COUNCIL OF THE VILLAGE OF TEQUFSTA, FLORIDA October 28, 1980 A meeting of the Council of the Village of Tequesta, Florida, was held at 7:30 P.M. , Tuesday, October 28, 1980 in the Village Hall, 357 Tequesta Drive , Tequesta, Florida. Councilmembers present were Cook, Little , Mapes, Ryan and Stoddard. Also present were Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The opening Prayer and Pledge of Allegiance to the Flag was led by Councilmember Ryan. Mayor Mapes announced a Public Hearing to be held at 7:00 P.M. , Tuesday, November 11, 1980 to consider the expansion, enlargement or modification of existing special exception uses for Tequesta Country Club and First Baptist Church of Jupiter- Tequesta. The minutes of the Budget Public Hearing for October 13 , 1980 and the minutes of the Council Meeting for October 14, 1980 were received. The Village Manager's Report for October 12, 1980 through October 25 , 1980 was received. Stoddard requested that the letter received from the Tequesta Association of Voters and Taxpayers concerning the "Connector Road" be forwarded to Martin County Commissioners and to the law firm representing the Village on this subject. Mrs. Evelyn F. Schrecengost , Administrative Director for Lighthouse Gallery, Inc . was present to request permission from Council to allow various banners on the flag poles in Gallery Square North in conjunction with the Arts and Crafts Festival. The festival will be held Sunday, November 16, 1980. Little moved, "that we allow the Lighthouse Gallery, for one day, to use the signs as requested". Ryan seconded and vote on the motion was : Cook -for .Little -for Mapes -for Ryan -for Stoddard -for and therefore the motion was passed and adopted. 10-28-80 -02 The Village Attorney read by title AN ORDINANCE OF THE VILLAGF OF TEQUESTA, FLORIDA, A111ENDING ORDINANCE NO. 285 AT SECTION 6 THEREOF SO AS TO PROVIDE FOR THE UNIFORM MINIMUM COUNTYWIDE AMENDMENTS TO THE STANDARD MECHANICAL CODE 1979 EDITION ; PROVIDING AN EFFECTIVE DATE. Then the Village Attorney explained to Council that the Village had recently passed an.,Ordinance adopting the Uniform M1_inium Countywide Amendments to the various codes which the Building Code Advisory Board of Palm Beach County has adopted, but in doing so had , in error, left out the amendments to the Standard Mechanical Code 1979 Edition. This Ordinance would amend the previously passed Ordinance upon its adoption. Stoddard moved, "that the first reading of this amended County Wide Building Code , as just read by the Village Attorney, be adopted". Cook seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and therefore the motion was passed and adopted. The Village Attorney read by title AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING ORDINANCE NO. 246 RELATING TO THE PROHIBITION OF TRUCK TRAFFIC FROM TRAVELING ON TEQUESTA DRIVE AND COUNTRY CLUB DRIVE WITHIN THE VILLAGE OF TEQUESTA; PROVIDING CERTAIN OTHER RESTRICTIONS ON SAID TRUCK TRAFFIC; PROVIDING FOR EXCEPTIONS; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. He explained to Council that this Ordinance amending the Original "No Through Trucks" Ordinance would amend Section 3 (a) adding the phrase . . . .within the Village of Tequesta. . . . it would also add an additional paragraph 3d. which would allow the operation of trucks providing essential services associated and compatible with the residential nature of the Village such as refuse collection, mail and parcel post delivery and pick up, gas and fuel oil trucks and trucks that make routine household deliveries. Mr. Kenneth Mates, 15 Oakridge Lane asked the Village Attorney if this would prohibit vans going into the area of Country Club Drive into Martin County. The Village Attorney advised that Ordinance No. 246 allows motor vehicles such as pick-up trucks, sedan panel trucks, station wagons or similar light vehicles designed for carrying small loads. Mr. Frank Grisafo owner of Grisafo Jewelers, Tequesta Drive, told Council he is building a home in Turtle Creek and is ready to pour the foundation and Rinkers would not deliver because they say they cantt. The Village Attorney advised that 10-28-8o -03 there were two (2) alternate routes that could be taken. It was Council 's feeling that since Country Club Drive belongs to the Village and the taxpayers have just gone through a great expense of doing the Village's drainage and street resurfacing program they would protect the taxpayers interest. Stoddard moved, "that the (first reading) Ordinance to amend Ordinance No. 246 as read to us by the Village Attorney including the new wording for Section 1 and Section 2 and his verbatim reading to prevent the reentry of heavy truck traffic back into Tequesta be adopted". Cook seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for and therefore the motion was passed and adopted. Little asked the Village 11anager if there had been some personnel changes made in the Police Department, if so, who authorized it and is there a job description for the new position. The Village Manager answered that there was in fact a change made by the Chief. There is no present job description for a Captain, but the Chief needs one to help with the Administrative parts of the Police Department and is writing up ,a job description for that position. Council discussed briefly, what Little feels is an "uneasy feeling" in the Police Department. Cook asked why Winn Dixie had been allowed to start their remodeling. The Village Manager told Council that most everything on the punch list for Lighthouse Plaza repairs had been completed and complied with. The Village Manager told Council that after the completion of the Property Appraiser Adjustment Board hearing the Property Appraiser would notify the tax authority of the aggregate change in the assessment roll, if any, from previous Certifed Tax Assessment Roll. The tax authority then has three (3 ) days after the notification to notify the Property Appraiser of the necessary millage. The Village Manager needed the authorization to notify the Property Appraiser. Stoddard moved, "to authorize the Village Manager to certify to the Property Appraiser the adjusted adopted rate of the Village of Tequesta subsequent to the hearings within a period of three (3 ) days after receipt of notification of the results". Little seconded and vote on the motion was: Cook -for Little -for Mapes -for Ryan -for Stoddard -for .,,,• -`10-28-80 -04 and therefore the motion was passed and adopted.
