MINUTES OF THE MEETING OF THE COUNCIL
OF THE VILLAGE OF TEQUESTA, FLORIDA
November 25 , 1980
A meeting of the Council of the Village of Tequesta,
Florida, was held at 7:30 P.M. , Tuesday, November 25 , 19AO
in the Village Hall, 357 Tequesta Drive , Tequesta, Florida.
Councilmembers present were Cook, Mapes and Ryan. Council-
members Little and Stoddard advised they would not be in
attendance . Also present were Robert Harp, Village Manager,
Cyrese Colbert, Village Clerk and John C. Randolph, Village
Attorney.
The opening Prayer and Pledge of Allegiance to the Flag
was led by Councilmember Cook.
There were no announcements.
Mayor Mapes informed Council that because two (2)
members of Council were absentL that any vote taken had to
have a majority of three votes in order to pass or the motion
would be defeated.
There was no one wishing to speak under "Time for
Visitors".
The Village Attorney gave second reading by "title" only
AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, ARENDING
ORDINANCE NO. 285 AT SECTION 6 THEREOF SO AS TO PROVIDE FOR
THE UNIFORM MINIMUM COUNTYWIDE AMENDMENTS TO THE STANDARD
MECHANICAL CODE 1979 EDITION ; PROVIDING AN EFFECTIVE DATE
and explained that this amendment provides for adoption of
the Standard Mechanical Code 1979 Edition which was inadvertently
left out of Ordinance No. 285 , adopting various Building Codes,
in error. Ryan moved, "we approve second reading". Cook
seconded and vote on the motion was:

and therefore Ordinance No. 286 was passed and adopted.
The Village Attorney read by title an Ordinance entitled,
AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING
( ORDINANCE NO. 246 RELATING TO THE PROHIBITION OF TRUCK TRAFFIC
FROM TRAVELING ON TEQUESTA DRIVE AND COUNTRY CLUB DRIVE WITHIN
THE VILLAGE OF TEQUESTA ; PROVIDING CERTAIN OTHER RESTRICTIONS
ON SAID TRUCK TRAFFIC ; PROVIDING FOR EXCEPTIONS ; PROVIDING FOR
CODIFICATION ; PROVIDING AN EFFECTIVE DATE. Ryan moved, "that
we approve the amendment and reading of the "No Thru Traffic"
_ 11-25-$0 -02
Ordinance No. 21p6". Cook seconded and there were no comments
from the Council so Mayor Mapes opened discussion from the
audience.
Dottie Campbell, 4 Tradewinds Circle, told Council that
she is aware that both Tequesta Drive and Country Club Drive
are Tequesta owned and maintained roads. She asked Council
to keep thru truck traffic off of Tequesta 's streets.
Sam Doyle , Lone Star Florida, Inc. was present and
told Council his company opposed the proposed Ordinance
amending Ordinance No. 246, No Thru Truck Ordinance.
Mr. John Giba, 78 Fairview East, drew a map of the areas
in Martin County, ie : Turtle Creek, Riverbend, Little Club , etc.
where the thru truck traffic is going. He showed what he
believes are alternate routes trucks could take.
Mr. Jack Carmondy, Attorney, explained that the entrance
into Turtle Creek that was shown by Mr. Giba, he believes is
actually on private property.
Mr. Hugh Campbell, 4 Tradewinds Circle, talked of large
trucks using Country Club Drive and doing damage not only
to the roads, but are also causing cracks in peoples homes.
Mr. Larry Zielinski, 430 Dover Road, told Council that
Tequesta should take a stand and stop the truck traffic through
the Village.
Sam S. Ticker, told Council that he believes that the
locked gate into Turtle Creek off of Country Club Drive, in
Martin County, is in fact privately owned.
Mr. James Kirkwood, 62 Turtle Creek Drive, Martin County,
told Council that he believes that Martin County residents in
that area will get mad and not shop in Tequesta °s stores.
Mr. Fred Raach, talked against the truck Ordinance and thought
the whole thing was getting out of control. He said a moving
van had been given a wicket for using Country Club Drive and
going into Turtle Creek.
The Village Attorney advised that moving vans are exempt
from the Ordinance therefore making them allowable to use
Country Club Drive and Tequesta Drive.
Mr. Robert Moore, Country Club Drive, explained that the
noise of the large cement and various other trucks going into
Turtle Creek, Riverbend, , etc. was just terrible.

and therefore Ordinance No. 287 was passed and adopted.
The Village Attorney read by title an Ordinance entitled
AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING THE
OFFICIAL ZONING ORDINANCE OF THE VILLAGE SO AS TO PROVIDE A
ZONING CHANGE FOR THE PROPERTY DESCRIBED HEREIN FROM R-1, SINGLE
FAMILY DWELLING DISTRICT TO C-1 RETAIL COMMERCIAL DISTRICT
AND FURTHER AMENDING THE ADOPTED COMPREHENSIVE PLAN OF THE
VILLAGE OF TEQUESTA BY PROVIDING A LAND USE CLASSIFICATION
CONSISTENT WITH THE C-1 RETAIL COMMERCIAL DISTRICT. He
explained to Council that this Ordinance was brought about
by the request of the North County First Aid Squad to have
the parcel behind the squad hall rezoned from R-1, Single
Family Dwelling District to C-1 Retail Commerical District.
The Village Attorney felt that since the Village was rezoning
by Ordinance the Ordinance should also include an amendment to
the Comprehensive Plan for this parcel of land. The Village
Attorney read the description of the property. Cook moved,
"that we approve the first reading of AN ORDINANCE OF THE VILLAGE
OF TEQUESTA, FLORIDA, AMENDING THE OFFICIAL ZONING ORDINANCE OF
THE VILLAGE SO AS TO PROVIDE A ZONING CHANGE FOR THE PROPERTY
DESCRIBED HEREIN FROM R-1, SINGLE FAMILY DWELLING DISTRICT TO
C-1 RETAIL CONLXERCIAL DISTRICT AND FURTHER AMENDING THE ADOPTED
COMPREHENSIVE PLAN OF THE VILLAGE OF TEQUESTA BY PROVIDING A
LAND USE CLASSIFICATION CONSISTENT WITH THE C-1 RETAIL COh1MERCIAL
DISTRICT". Ryan seconded and vote on 'the motion was:

and therefore the motion was passed and adopted.
The Village Attorney reminded Council that he had been
directed by Council to draft an Ordinance regulating the times
the Railroad Companies could block the railroad crossings
within the Village and he is presenting this Ordinance to
Council tonight. The Village Attorney read the Ordinance.
Council asked for a clearer definition of emergency and was
given one by the Attorney.
The Village Attorney advised Council that State Statute
says that the railroad crossing can not be blocked for more
than a ` reasonable time. The proposed Ordinance considers
ten (10) minutes a reasonable amount of time, except in an
emergency.
Council wanted this matter on the next agenda also just
so they could get the feelings of the absent Councilmembers.
Cook moved, "that we adopt AN ORDINANCE OF THE VILLAGE OF TEQUESTA,
FLORIDA, REGULATING THE BLOCKING OF RAILROAD CROSSINGS WITHIN
THE VILLAGE BY RAILROAD COM1PANIES OPERATING WITHIN THE VILLAGE
OF TEQUESTA ; PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE ;
PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE on first
reading". Ryan seconded and vote on the motion was:

The next proposed Ordinance on the Agenda was an Ordinance
amending the Official Zoning Ordinance to change certain
properties from C-2, Wholesale Commercial and Light Industial
to C-1 Retail Commercial and to amend the Zoning map of the
Village to reflect same.
The Village Attorney read the description on each parcel.
There are three (3 ) parcels. One belonging to Otto B. DiVosta,
another belonging to Ernest A. Dorne r and the last belonging to
the Fehlhaber Corporation. Ryan moved, "that we approve first
reading (of an Ordinance entitled AN ORDINANCE OF THE VILLAGE
OF TEQUESTA, FLORIDA, AMENDING THE OFFICIAL ZONING ORDINANCE
OF THE VILLAGE SO AS TO PROVIDE A ZONING CHANGE FOR THE
PROPERTY DESCRIBED HEREIN FROM C-2 - WHOLESALE COMMERCIAL
AND LIGHT INDUSTRIAL TO C-1 - RETAIL COMMERCIAL AND FURTHER
AMENDING THE ZONING MAP OF THE VILL_4GE SO AS TO REFLECT SAID
CHANGES)". Cook seconded and vote on the motion was:

and therefore the motion was passed and adopted.
The minutes of the Council Meeting for November 11, 1980
were received. The Village Manager's Report for November 9, 1980
through November 22, 1980 was received. The Village Financial
Statement and the Water Department Financial Statement for
October, 1980 were received. Council also received the minutes
of the November 11, 1980 Public Hearing and the November 11, 1980
Site Plan Review.
The Village Manager explained that the wheel base on the
bid from Al Packer Ford for the two (2) Police Cars were smaller
than the specs but Ford does not make that size wheel base as
required on the specs.
Bids for two (2) 1981 Police Cars, one (1) 1 ton pick-up
truck for Maintenance and one (1) Water Department passenger
car were received until 2:00 P.M. , November 24, 1980. There
were three (3 ) bids received per vehicle. The Village Manager
reviewed the bids that were received and sent his recommendation,
in the form of a memorandum, to Council the same day. The Village
Manager reviewed his memorandum and the bids received with Council.
Cook moved, "that we accept the bid of Al Packer Ford, LTD 'S
Police Specials of $14,338.58 for two cars, less trade in with
$8,035. of the cost being paid by Federal Revenue Sharing Funds.".

Ryan moved, "that we accept the bid of Roger Dean Chevrolet ,
(one, � ton pick-up truck) in the amount of $; ,499,95". Cook
seconded and vote on the motion was:

and therefore the motion was passed and adopted.
Cook moved, "that we accept the bid of Lake Worth OIC/Jeep,
AMC Concord, (Water Department passenger car) in the amount
of $6,000.00 and the funds be used from the Water Department
Renewal and Replacement Fund". Ryan seconded and vote on the
motion was:

and therefore the motion was passed and adopted.
