MINUTES OF THE PUBLIC HEARING OF THE
VILLAGE OF TEQUESTA ZONING BOARD OF ADJUSTMENT
JUNE 15, 1981
A public hearing was held by the Village of Tequesta Zoning
Board of Adjustment at 7:30 P.M. , Monday, June 15, 1981, in the Village
Hall, 357 Tequesta Drive, Tequesta, Florida. Board members present were:
Chairman Head, Bryan, Meyerowich, Otto and Wagner. Also present were
R. Harp, Clerk of the Board, A. W. Butterfield, Building Official and
John C. Randolph, Village Attorney.
The Chairman asked the Clerk to read the notice of the public
hearing, which was done. The Clerk advised that proof of publication was in
hand for publication of the notice in the May 31, 1981 issue of the Courier
and that sixty-three (63) letter notices had been sent- to property owners
within 500 feet of the Carras property and to sixty-eight (68) property
owners within 500 feet of the Denton property.
The Clerk advised that A written or oral comments had been
received on either application.
The Chairman asked Peter Carras to present his application.
Carras advised that the lot (No. 221) was approximately 11,000
square feet, five (5) sided, and being narrow at the front on the cul-de-sac
and widening out. He said he did not believe it fair to interpret the rear
lot line as the entire 114.56 feet of the north side of the lot from which
a twenty (20) foot rear setback to the building is required. He showed the
Board the site plan for the lot which showed that the proposed house would
not fit within the setbacks. Otto asked if, the house had been specially
designed for this lot or if it was a standard plan. Carras said it had not
been specially designed for this lot but was a good standard house plan.
Head asked if Carras had considered mirror imaging the house on the lot.
Carras advised it would be a poor plan that way since the garage and master
bedroom would be on the east side of the house. Bryan asked if Carras had
tried to mirror image the house on the lot. Carras advised no, but would have
to have an architect look at it to see if same could be done. Otto asked if
Carras was building the house to personally live in or for speculation and
Carras advised he definitely intended to live in it.
Wagner asked Carras about the "For Sale" on the lot at the present
time. Carras advised if his application for a variance is granted, he would
start building immediately and the sign would be removed. He said he also
owns another lot. Carras said the proposed house was a very popular floor
plan. Head questioned the width of the two (2) car garage and Meyerowich
questioned the depth of the garage and were advised 23 feet and 22 feet
respectively.

Bryan asked about hardship in this regard. The Village Attorney
advised that this was a typical, unique lot that could be used as one of the
.factors on which the Board could consider granting a variance. Otto asked
if stipulations could be included with any variance granted and the Village
Attorney advised they could be. Otto expressed her concern for the neighbor
to the rear (Lot 206). Bryan asked if an attempt had been made to design a
house that would fit the lot and Carras advised yes, but tough to do so.
He stated perhaps a two (2) story house could be built but they are harder
to sell than a one (1) story house. Carras advised that the average lot size
in Tequesta Pines is 8,000 square feet and this lot is 11,000 square feet
with a lot of the area on the east side of the lot not. particularly useable
for the main residence. Twisting the house on the front would cause encroach-
ment into the front and side setbacks.
William H. and Mary Ziesenciss, owners of Lot 207, Tequesta Pines
advised they favored the plan. Sterling and Mary Tremayne, owners of Lot 209,
advised they favored the plan and August F. and Rose Cursio, owners of Lot 220,
advised they favored the plan.
Wagner moved, seconded by Head, that due to the odd shape of
Lot 221, Tequesta Pines, that the application of Peter Carras for a variance
to allow the construction of a single family residence on said lot with a
rear yard at the northwest seventeen (17) feet of the rear wall of the
proposed structure varying from sixteen (16) feet to twenty (20) feet instead
of twenty (20) feet as required, be approved. The vote on the motion was

and the motion therefore failed.
Ralph T. Denton appeared before the Board to present his appli-
cation. Denton reviewed the fact that the Village had allowed the construction
of the porch about five (5) years ago with a fifteen (15) feet rear setback
instead of twenty (20) feet and when he applied to the Building Department for
a permit to enclose a portion of the existing open porch, was advised it was
a non-conforming use because of the setback and a variance would be required.
A. W. Butterfield, Building Official, advised that when the structure was
built there was some confusion on what was the front or side of the lot.
Without the porch the setback was approximately twenty-five (25) feet. He
stated he believed the main problem was with the house as originally placed
on the lot using a setback of thirty (30) feet from both Beacon Street and
Seabrook Road, and this placing used lot area which could have been adequate
for the addition if the larger setbacks had not been used. He said the house
number used by Denton is for Seabrook Road and the front of the house is on
Beacon Street.

Bryan asked if the Zoning Ordinance in respect to setbacks had
changed since the house was built and was advised it had not. Bryan asked
the Village Attorney if there was any legal_ opinion as to the definition of
the front of a lot and was advised it usually is the narrowest width.
J. Ray Francois, owner of Lot 4, Block 32, Jupiter in the Pines,
Section "B", advised he favored the requested variance. Bill Lamb, owner of
Lot 15, Block 31, Jupiter in the Pines, Section "B", advised he too favored
the requested variance.
Bryan moved, seconded by Meyerowich that since the existing porch
had been previously approved by the Village, that the application of Ralph T.
and Rachel L. Denton for a variance for Lot 10, Block 27, Jupiter in the Pines,
Section "B", approving the existing rear yard of fifteen (15) feet instead of
twenty (20) feet be approved. The vote on the motion was:

Wagner For
and the motion therefore passed.
The public hearing was adjourned at 8:03 ,P.M.
