OF THE VILLAGE OF TEQUESTA, FLORIDA
JULY 14, 1981
A meeting was held by the Village Council of the Village of
Tequesta, Florida at 7:25 P.M. , Tuesday, July 14, 1981 in the Village Hall,
357 Tequesta Drive, Tequesta, Florida. Councilmembers present were: Brown, t
Cook, Mapes and Stoddard. Little had advised he would be out of town. Also
present were- Robert Harp, Village Manager, Cyrese Colbert, Village Clerk and
John C. Randolph. Village Attorney.
The opening Prayer and Pledge of Allegiance to the Flag was given
by Councilmember Brown.
Changes made and approved to the agenda were as follows:
Add lc - Discussion of 911 Emergency Plan (Chief Flannery)
Add 3c - Consideration of a resolution revising 1980/81 Budgets.
The minutes of the June 23, 1981 Council Meeting and the Village
Manager's Report for June 21, 1981 to July 11, 1981 were received.
Cotter Christian, Gee & Jenson, reviewed with Council the cost of
three alternatives for the Intracoastal Crossing, the original, Alternative
#1 is at $665,000. , the bridge crossing, Alternative #2 is at $683,000. and
the LRECD crossing which is at $654,000.
Mr. Dallas Durrance, Gee & Jenson, reviewed with Council his
memorandum of July 10, 1981. He reminded Council that Alternate #1 has been
denied by the Department of Environmental Regulation and that we have requested
a hearing before DER in Tallahassee. If approval is received from DER, the
Village would still need permits from the Army Corps of Engineers, the EPA,
the Fish and Wildlife Service and the National Marine Fishery Service.
Mr. Durrance told Council that at least one of them would object, so the
permits and construction would probably take eighteen (18) to twenty-four
(24) months.
Mr. Durrance told Council that the Alternate #2 would probably
take about six months of paper work and work would probably not get started
for about 10 to 12 months.
Alternate #4 would take about 6 months of paperwork also and about
12 - 14 months to get started.
Stoddard told Council he believed that once we received DER's
approval then the Army Corps of Engineers will probably go along with it.

Resident John Giba told Council he was for getting the line across
without delay.
Resident Dick Hutchison told Council that purity, quality, quantity
and pressure is what is most important for the Beach Road area.
Ernest Dorner, President of the Jupiter Island Vacant Property
Owners Association told Council that ,in his opinion ,any other way but the
bridge route.would not receive approval from the various governmental entitiEis
involved.
Stoddard told Council that during the past week to 10 days he has
been thinking about this situation of about 2000 peopre:'s welfare as opposed to
the turtle grass. He recommended that a delegation, made up of Mayor Mapes,
Gee & Jenson, John Giba and Doctor Thorhaug, make a trip to Tallahassee's DER.
He has arranged, along with "Doc" Myers, a July 21, 1981 meeting at around
3:30 P.M. to meet with Victoria Tschinkel of DER, Tallahassee. Stoddard
moved, "that we authorize a trip by Mayor Mapes, Gee & Jenson, Dr. Thorhaug,
John Giba to DER, Tallahassee". Motion died due to a lack of a second.
Brown moved, "that we go ahead aqd go with Alternate #2, the
bridge crossing and instruct Gee & Jenson to proceed with the plan and permitt-
ing immediately". Cook seconded and vote on the motion was:

John Giba, resident, told Council that Vice-Mayor Stoddard should
be commended for the hard work that he had done trying to get the delegation
together.
Mayor Mapes said he would also like to commend Vice-Mayor Stoddard.
Mayor Mapes announced that the 10 or 12 months is just a guess, for
those builders on the Island who were at the meeting.
George Webber, Tequesta Voters and Taxpayers Association, told
Council that the Association had recently given the Police Department $500. to
be spent in any way for investigation of vandalism or the interior remodeling
for the Police Department office.
The Village Attorney read a resolution entitled: "A RESOLUTION
OF THE VILLAGE OF TEQUESTA, FLORIDA, CREATING A TEQUESTA POLICE DEPARTMENT
BUILDING FUND". This resolution would provide for the creation of a fund
to be known as the Tequesta Police Department Building Fund. Stoddard moved,
"the adoption of this Resolution". Brown seconded and vote on the motion was:

and therefore Resolution No. 8-80/81 was passed and adopted.
Chief Flannery explained that the 911 Emergency Plan was far from
perfect but there are improvements that are being made to improve the plan.
Mr. Herb Foxman, President, Tequesta Pines Property Owners
Association read a letter to Council from the Association about the proposed
expansion of the Rinker Materials Corp. Plant. The T.P.P.O.A. feels the
expansion should be denied because of several reasons listed in the letter.
Council talked about the unloading of large rocks and boulders
within the Village of Tequesta town limits.
The Village Attorney told Council that the following ordinance
entitled:
"AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING
ARTICLE I, CHAPTER II, LICENSES, OF THE VILLAGE CODE, TO
PROVIDE THAT LICENSE APPLICATIONS SHALL BE FILED WITH THE
BUILDING OFFICIAL AND PROVIDING THAT UPON PAYMENT OF THE
LICENSE TAX, THE VILLAGE SHALL ISSUE A LICENSE SIGNED BY THE
VILLAGE BUILDING OFFICIAL OR VILLAGE MANAGER, BY AMENDING
ARTICLE I, SECTION 11-17 AND ARTICLE I, SECTION 11-18 OF SAID
CODE; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
PROVIDING FOR AN EFFECTIVE DATE
was housekeeping that needed to be taken care of. The Village Attorney read,
"by title", the ordinance. Stoddard moved, "approval on first reading of this
ordinance". Cook seconded and vote on the motion was:

The Village Attorney read "by title":
"AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA, AMENDING
THE BUILDING AND BUILDING REGULATIONS CHAPTER OF THE VILLAGE
CODE, CHAPTER 6, BY PROVIDING THAT PERMIT FEES SHALL BE PAID TO
THE BUILDING OFFICIAL BY AMENDING ARTICLE VIII, SECTION 6-142;
ARTICLE VIII, SECTION 6-143 AND ARTICLE VIII, SECTION 6-144 OF
SAID CODE; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
PROVIDING FOR AN EFFECTIVE DATE
Stoddard moved, "approval on first reading of this ordinance". Brown seconded
and vote on the motion was:

The Village Manager explained that the next ordinance provided
increasing the assessment of court costs for law enforcement education from
$1.00 to $2.00. The Village Manager read "by title" an ordinance entitled:
"AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA,
AMENDING CHAPTER 14.1, SECTION 14.1-1 OF THE VILLAGE
CODE BY INCREASING THE ASSESSMENT OF COURT COSTS FOR
LAW ENFORCEMENT EDUCATION FROM $1.00 TO $2.00;
PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION;
PROVIDING FOR AN EFFECTIVE DATE
Brown moved, "approval on first reading". Cook seconded and vote on the
motion was:

The Village Manager explained that the Village needed to open a '
payroll account at the First Marine Bank with the authorized signatures to
be two (2) : the Treasurer and/or Village Manager and one (1) Councilmember.
Cook moved, "that we approve the authorization of the First Marine Bank as
the depository and the signatures". Brown seconded and vote on the motion
was:

and therefore the motion was passed and adopted.
The next item on the agenda was the discussion of new funding
sources for local government which was brought about by a letter received
from Senator Tom Lewis. In the letter Senator Lewis listed five (5)
concepts of new sources of funding for local governments and asked to be
advised of the Council's position. It was the consensus of Council that
there be a 1% tax on gasoline at the County level for roads and that a letter
be sent to Senator Lewis stating such.

Mayor Mapes read a resolution entitled:
"A RESOLUTION OF THE VILLAGE OF TEQUESTA, FLORIDA,
PROVIDING FOR REVISIONS TO THE BUDGETS FOR THE
FISCAL YEAR COMMENCING OCTOBER 1, 1980".
The resolution amends the 1980/81 Budget, including Federal Revenue Sharing.
A Workshop Meeting was held on June 16, 1981 on these revisions. Stoddard
moved, "we approve this resolution providing for revisions to the budgets
for the fiscal year commencing October 1, 1980". Brown seconded and vote on $
the motion was:

and therefore Resolution No. 9-80/81 was passed and adopted.
Council agreed to support the County in their passage of the
Mangrove Protection Ordinance.
The Village Manager told Council that on June 4, 1982 the Village
of Tequesta will be twenty-five (25) years old, and that he would like the
past Mayors to be on a committee to plan for the celebration. Council gave
their approval.
The meeting was adjourned at 9:37 P.M.
