OF THE VILLAGE OF TEQUESTA, FLORIDA
August 11, 1981
A meeting was held by the Village Council of the Village
of Tequesta, Florida at 7:30 P.M. , Tuesday, August 11, 1981 in
the Village Hall, 357 Tequesta Drive, Tequesta, Florida.
Councilmembers present were: Brown, Little, Mapes and Stoddard.
Cook had advised she would be out of town. Also present were
Robert Harp, Village Manager, Cyrese Colbert, Village Clerk
and John C. Randolph , Village Attorney.
The opening Prayer and Pledge of Allegiance to the Flag
was given by Councilmember Little.
Vice-Mayor Stoddard announced a P.R.C. Harris meeting on
Wednesday, August 12, 1981 at 8:00 P.M. in Martin County.
Changes made and approved to the agenda were as follows:

Mr. John McKune, Gee & Jenson, reviewed with Council his
letter to Council dated August 10, 1981 in reference to the
horizontal drilling method for the Intracoastal crossing.
Mr. McKune then reviewed the estimated cost of the horizontal
drilling method with Council. The total estimated cost is
$1,279,000. This would be a cost of $596,000 over and above the
estimated cost of $683 ,000. for the State Road 707 Crossing.
Mr. McKune told Council that although there are certain
benefits to this methodology it is not cost effective when compared
to the crossing at the State Road 707 Bridge.
Mr. Stoddard told Council that he has talked with Engineers
from the Loxahatchee River Environmental Control District and they
are quite interested in this method for their own crossing.
Mr. McKune told Council that he will keep Council updated
on the water crossing schedule and how things are progressing.
He told Council that the aerial photos should be done on August 12,
1981.
Mayor Mapes presented retiring Building Official Alvin W.
Butterfield with a plaque in appreciation for the dedicated and

professional service given to the Village of Tequesta as its
Building Official. Mr. Butterfield thanked the Village and
told Council that he had enjoyed working with the Village and
had gathered a lot of information and knowledge while doing so.
The Village Attorney read by title AN ORDINANCE OF THE
VILLAGE OF TEQUESTA, FLORIDA, AMENDING ARTICLE I, SECTION 18-3,
OF THE VILLAGE CODE, AS AMENDED BY CHANGING THE ADDITIONAL
CAPITAL IMPROVEMENT CHARGE TO $1,485 . FOR EACH NEW CONNECTION
TO THE VILLAGE OF TEQUESTA WATER SYSTEM ON THE AREA WITHIN
SAID SYSTEM KNOWN AS JUPITER ISLAND; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE.
Stoddard moved, "on second reading the Ordinance as read be

FOR OBTAINING AN IDENTIFICATION CARD FROM $1.00 to $5.00;
PROVIDING FOR SEVERABILITY, PROVIDING FOR CODIFICATION;
PROVIDING FOR AN EFFECTIVE DATE. Brown moved, "that second

second reading of this Ordinance". Stoddard seconded and vote
on the motion was:

The Village Attorney gave second reading, by. title of
AN ORDINANCE OF THE VILLAGE OF TEQUESTA, FLORIDA AMENDING
CHAPTER 2, SECTION 2.16(b) OF THE VILLAGE CODE TO MAKE IT
CONFORM TO THE VILLAGE CHARTER AND CHAPTER 2, SECTION 2.16(c)
OF THE VILLAGE CODE TO PROVIDE FOR REVISION IN THE DETERMINATION
OF THE FILING FEE; PROVIDING FOR CODIFICATION; PROVIDING FOR
AN EFFECTIVE DATE. Stoddard moved, "on second reading the
Ordinance as read be adopted". Brown seconded and vote on the
motion was:

FOR LAW ENFORCEMENT EDUCATION FROM $1.00 TO $2.00; PROVIDING
FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN
EFFECTIVE DATE. Brown moved, "on second reading to adopt amended

OF SAND, ROCKS, DEBRIS OR SPOIL ON ANY LOT OR PARCEL OF LAND
WITHIN THE VILLAGE; PROVIDING AN EXCEPTION FOR DU14PING OF
BUILDING MATERIALS UPON LOTS OR PARCELS OF LAND UPON WHICH
CONSTRUCTION IS TAKING PLACE ; PROVIDING AN EXCEPTION FOR THE
DUMPING OF SAID MATERIALS INTO ENCLOSED AREAS ON LOTS OR
PARCELS OF LAND WHERE SAID MATERIALS ARE STORED AS AN
ACCESSORY USE TO THE BUSINESS CONDUCTED THEREON; PROVIDING

been changes made at the first reading of the Ordinance.
The Village Attorney then read the Sections that had been
changed.
Little told Council that Rinker has said that they
need time to comply and there is nothing in the Ordinance
that provides a reasonable amount of time in cases where
the problem already exists.
Brown moved, "the adoption of this Ordinance on
second reading". Little seconded and vote on the motion was:

Council had received a copy of "Notice of Hearing" to
consider the Village of Tequesta 's petition to the State of Florida,
Department of Environmental Regulation requesting installation
of a subaqueous water main under the Intracoastal Waterway. The
Hearing is scheduled for 10:30 A.M. , October 2, 1981. The Village
Attorney recommended that the Hearing date remain as though we
are going for the Hearing even though we have begun the alternate
route procedures. Council agreed that we should proceed with the
normal steps to get approval on the original route and continue
with the alternate route at the same time,

The Village Attorney announced that the "Order for
Temporary Injunction" against the truck Ordinance was denied.
He cautioned that this was .just the Order for Temporary
Injunction against the Ordinance and that this battle had
been won but there is still a war to fight,
Mayor Mapes congratulated the Village Attorney on the
.job he did with the case.
The Village Attorney told Council that a proposed Ordinance
requiring alarm permits was requested by Mapes because of the
large amount of false alarms in the area . due to faulty alarm
systems. The proposed Ordinance would provide for permitting,
exemptions, appeals, would provide for revocation of permits,
would provide for service charge, inspections, exemption of
hearing, reporting servicing information, criminal penalties
and several other items would also be provided for.
The Ordinance would have a specified number of signals
that could be set off before the revocation of the permit.
The Village Attorney was asked to incorporate Council 's
suggestions into an Ordinance together with his idea 's and
have an Ordinance ready for the next Council meeting,
The Village Attorney reminded Council that some of the
items which Council wanted put in a proposed anti-litter
Ordinance is already in an Ordinance on the books in Tequesta
and also there are State Statutes that could be enforced.
Council said they would still like an Ordinance addressing
anti-litter,
The Village Manager informed Council that it has been
necessary to replace two fire hydrants in Jupiter Inlet Colony.
The cost of the fire hydrants were $970.20 and should be paid
for from the Renewal and Replacement Fund, All expenditures
from this fund requires Council 's approval. The Water Department
Consulting Engineers agree with the expenditure for the fire
hydrants. Brown moved, "that we approve the expenditure
$970.20 from the Renewal and Replacement Fund for two fire hydrants".

The Village Manager sent Council a memorandum explaining
several items that were put into Change Order No. 2 for the Village
Hall Addition. The amount of the Change Order was $1, 712.30.
(Attached is a copy of the memorandum) Stoddard moved, "that
we approve the Change Order No. 2 for the Village Hall Addition
in the amount of $1, 712.30". Little seconded and vote on the

Mayor Mapes announced that the Council had instructed the
Village Manager to proceed with the necessary Public Hearing
Notices for the 1981/82 proposed Budget of 3 .9589 mills. This
budget is 11% higher than the rolled back rate and is 21.49%
down from last years Budget. He also told the audience that the
largest increase was in the garbage pick-up service.
Stoddard said he would like to congratulate the Village
Manager and Finance Director on the fine ,job they had done on
the budget. Little moved, "to accept this millage rate of
3 .9589 mills". Stoddard seconded and vote on the motion was:

Council set Monday, September 28, 19$1 ,at 7:30 P.M. as
the first Budget Public Hearing. They then set Tuesday,
October 13 , 1981 at 7:00 P.M. as the second Budget Public
Hearing. Stoddard moved, "that the dates of Monday, September 28,
1981 at 7:30 P.M. for the first Budget Public Hearing and
Tuesday, October 13 , 1981 at 7:00 P.M. as the second Budget
Public Hearing". Brown seconded and vote on the motion was:

The Village Manager announced that State Representative
"Doc" Meyers will be at the August 25 , 1981 Council Meeting to
bring Council up-to-date on what has happened *in the State. -
The Village Manager explained to Council that at the Site
Plan Review for the proposed Gill Office Building on Bridge Road
the Site Plan had been approved, but this caused a problem with
the Site Plan originally approved for Burger Chef, therefore the
Site Plan for the Gill Office Building needs to be rescinded.
Stoddard moved, "to rescind the previous Site Plan Review Approval
of the Gill property". Brown seconded and vote on the motion was :

The Village Manager told Council that he had reviewed
the Water Department Budget with the Water Department Consulting
Engineers and they had said there was no problem with the
proposed 1981/82 Water Department Budget. He also told Council
that most of the items are pretty much down the line.
The Village Manager briefly reviewed the Budget with the
Council. Brown moved, "tentative approval of the Water Department
Budget (1981/82) ". Stoddard seconded and vote on the motion was:

Mrs. Young, Country Club Drive, 'told Council she hopes the
Police Department will enforce the "No Through Trucks" Ordinance.
