HomeMy WebLinkAboutMinutes_Regular_8/25/1981 �s MINUTES OF THE VILLAGE COUNCIL MEETING OF THE VILLAGE OF TEQUESTA, FLORIDA August 25, 1981 A Meeting was held by the Village Council of the Village of Tequesta , Florida at 7:30 P.M. , Tuesday, August 25 , 1981 in the Village Hall, 357 Tequesta Drive , Tequesta, Florida. Councilmembers present were: Brown, Cook, Mapes and Stoddard. Little had advised he would be on vacation. Also present were Cyrese Colbert, Village Clerk and John C. Randolph, Village Attorney. The Village Manager was also on vacation. The opening Prayer and Pledge of Allegiance to the Flag was given by Mayor Mapes. The Honorable William "Doc" ldyers was present to inform the Village what has happened in the State Legislature. He told Council that most of the laws that were created deal with Police matters such as immediate suspension for D'.W. I. - and the Police Department can now give tickets in parking lots. Mr. John Giba, 78 Fairview East, told Council that he was concerned with what he feels is an ongoing violation of the Zoning Ordinance by Rinkers Materials. He suggested to Council that he feels the Building Official should attend each Council Meeting, that there should be updated inspections done by the Building Department and that old business that was discussed and not resolved or answered should be put on the next agenda, until which time the item is taken care of. The Village Attorney reviewed with Council an Ordinance providing for. alarm permits. Council discussed various changes they would like incorporated into the Ordinance. The Village Attorney noted the changes. The changes are to be made and the Ordinance brought back to Council for first reading. Council discussed a proposed Ordinance on littering within the Village. The Ordinance addressed itself to commerical and non-commercial handbills, litter, newspapers, etc. abeing distributed in Tequesta. Council disagreed on several points in the Ordinance. There was no action taken on this Ordinance. The next item on the Agenda was the consideration of Application for permit to dump rocks by Murray Logan Construction, Inc. Mayor Mapes asked if there was someone from Murray Logan present tonight, but there was no one present . The Village Attorney explained S08-25-81 -02 to Council that this request was presented because Murray Logan Construction, Inc. is the firm who is doing the restoration on the beach in Jupiter Inlet Colony and they need the area near the Lone Star Plant to dump the large rocks and boulders. Mayor Mapes said he feels this is an emergency situation because the people on the beach stand a good chance in losing their homes if something isn 't done soon. Stoddard said that he would like to permit Murray Logan to load and unload rocks there but would like to see the hours restricted. Mr. Dick Jannarone, 81 Teakwood Circle, told Council he feels the primary issue is the noise. There were several people from the Tequesta Pines area that agreed and told Council that work was going on in that area until the early morning hours. The Village Attorney advised that no action be taken by Council on the application because there was not a represent- ative of Murray Logan present. Stoddard moved, "that Mayor Mapes, representing the Village of Tequesta, agree to the changes in the By-Laws for the Loxahatchee Council of Governments". Brown seconded and vote on the motion was: Brown -for Cook -for Mapes -for Stoddard -for and therefore the motion was passed and adopted. The Council requested the Village Manager's Report be put on the next agenda, since he was not present to explain or to answer any questions about the report. Stoddard told Council that it appears that there may be action taken by the Army Corpsof Engineers and D.E.R. that has overlooked State Statutes that provides certain steps that may be taken by a municipality when they disagree with an entity such as Army Corpsof Engineers, D.E.R. , etc. He told Council that he has given a copy of the laws to the Village Attorney and would like Council to approve the Attorney reviewing the laws. Mapes said if it would cost the Village one more red cent he was not in favor. He said he felt the Village is paying too much for this project now as compared to when it was first stated. Stoddard moved, "that our Village Attorney be simply authorized to review the requirements and give us his recommendations". Brown seconded and vote on the motion was : Brown -for Cook -against Mapes -against Stoddard -for '08-25-81 -03 the vote being tied the motion failed. The Village Attorney told Council he could brief through them and give the Village his opinion at no cost to the Village. The Council agreed with his offer. The meeting was adjourned at 9:34 P.M.
