OF THE VILLAGE OF TEQUESTA, FLORIDA
September 22, 1Q81
A meeting was held by the Village Council of the Village
of Tequesta, Florida at 7:30 P.M. , Tuesday, September 22, 19$1
in the Village Hall, 357 Tequesta Drive, Tequesta, Florida.
Councilmembers present were: Cook, Little, Mapes and Stoddard.
Brown had advised he could not be in attendance. Also present
were: Robert Harp, Village Manager, Cyrese Colbert, Village
Clerk and John C. Randolph, Village Attorney.
The opening Prayer and Pledge of Allegiance to the Flag
was given by Vice-Mayor Stoddard.
Changes made to the agenda were:

Add 6a. Approval of revised Budget 1981/82
The Council Meeting Minutes for July 14, 1981, the Village
Manager 's Reports for August 9, 19$1 to August 21, 1981 and
August 22, 1981 to September 19, 1981, the Financial Statement
for July, 1981 and the Water Department Financial Statement
for July, 1981 were received.
The minutes of the June 16, 1981 Workshop Meeting and
the Minutes of the July 14, 1Q$1 Public Hearing were also
received.
Mayor Mapes personally thanked all the people who worked
during the main .break at SR 707.
Mr. John McKune, Gee & Jenson, showed slides that he had
taken of the main break, There were several pictures of the
wash Out under the bridge at which time Gee & Jenson made
recommendations to the County that SR 707 and the bridge be
closed to traffic, because Gee & Jenson was not sure how much
underground wash out there had been between the road and the
bridge.
Mr. McKune told Council that the parallel crossing permit
(bridge route) goes before the Cabinet 's Agenda on October 6, 1981
and then on to the Department of Environmental Regulation (DER)
for approval and in about six (6) weeks we could have the permit
if approved.

He told Council that there had been a meeting with D.E.R. ,
Vice-Mayor Stoddard., Mr. McLendon, aide to Representative
Skip Bafalis and Gee & Jenson to discuss the possibilities of
getting approval for the original route,
Mr. McKune told Council that he would like to have letters
from the residents of Jupiter Inlet Colony, a Resolution from
Council and Gee & Jenson will also send a letter about the possible
dangers that could occur if this line is not added soon.
Mr. McKune told Council that one of the hardest groups to
get approval from is the National Marine Fishery because it is
their business to object.
The Village will know within 30 days if the permit will or
will not be approved for the watermain crossing,
The Village Manager read a Resolution entitled A RESOLUTION
OF THE VILLAGE OF TEQUESTA, FLORIDA, TO EXPEDITE PROMPT PERMITS
BY THE DEPARTMENT OF ENVIRON14ENTAL REGULATION AND U.S. ARMY CORPS
OF ENGINEERS FOR A LOOP WATER MAIN CROSSING OF THE INTRACOASTAL
WATERWAY TO JUPITER ISLAND which had been drawn up by Vice-Mayor
Stoddard. Little moved, "that the Resolution be approved".
Stoddard seconded and after a brief discussion vote on the motion
was:

and therefore Resolution No. 10- 80/$1was passed and adopted.
The Village Manager was instructed to send a cover letter
which will include the cost of the proposed crossings.
Chief Flannery was present to report on false burglar alarms
in the Village. A report had been sent to Council earlier with
a list of banks, businesses and homes that had had. false alarms
between the period of March through August in 1981. Chief Flannery
pointed out that during this six months period there had been a
total of 323 false alarn. cases.
There were as high as seven (7) cases for banks, eleven (11)
cases for one business and as high as fourteen (14) cases for one
home.
The Chief explained that as soon as an alarm goes off a car
is dispatched, the dispatcher calls the place where the alarm has
been set off to alert them that the alarm has zone off and to tell
them that an officer is on the way. Even though a police officer
may be told it is a false alarm he is to answer every call as
though it is real. The emotional feelings that this Police Officer
goes through is the same as if it were real and all 323 of these
alarms were false. He also told Council that in many areas they

have penalities for false alarms.
The Chief also pointed out that this false alarm pulls
a car off the streets that may be needed in another area.
Mrs. Young, 261 Country Club Drive, told Council she does
not feel that the truck Ordinance is being enforced on Country
Club Drive,
The Council asked Chief Flannery to speak to the matter.
Chief Flannery told Mrs. Young and Council that the Police
Department has done everything in their power to control the
truck traffic and to stop the truck traffic. He talked about
the patrol cars and where they are usually stationed and how
the Country Club Drive area was getting far more coverage than
any other area in the Village,
The Chief told Council that he has been instructed by the
Village Attorney to only issue warningsfor the time being.
The Village Attorney told Council that he was doing this until
he could change some wording in the truck Ordinance that will
give the Village a better chance in court and have a good chance
in winning the law suit against the Village.
. Council agreed to stand behind the opinion of the Village
Attorney,
The Village Attorney gave second reading of AN ORDINANCE
OF THE VILLAGE OF TEQUESTA, FLORIDA, PROVIDING FOR A CHANGE IN
ZONING CLASSIFICATION OF VARIOUS PARCELS OF LAND WITHIN THE VILLAGE
OWNED BY THE FLORIDA EAST COAST RAILWAY AND AMENDING THE OFFICIAL
VILLAGE ZONING MAP TO CONFORM TO THE AMENDMENTS HEREIN MADE.
Stoddard moved, "that on second reading we adopt this Ordinance
providing for change in Zoning Classification of various parcels of
land within the Village of Tequesta owned by the Florida East
Coast Railway". Cook seconded and vote on the motion was:

and therefore Ordinance No. 308 was passed and adopted.
The Village Attorney read by title AN ORDINANCE OF THE VILLAGE
OF TEQUESTA, FLORIDA, PROVIDING FOR SHORT TITLE; PROVIDING FOR
DEFINITIONS; PROVIDING FOR REQUIREMENT FOR ALARM PERMIT; PROVIDING
FOR EXEMPTION; PROVIDING FOR THE APPLICATION FOR ALARM PERMIT;
PROVIDING FOR THE ISSUANCE OF ALARM PERMIT; PROVIDING FOR APPEALS;
PROVIDING FOR REVOCATION OF PERMIT; PROVIDING FOR SERVICE CHARGE;
PROVIDING FOR INSPECTION; PROVIDING FOR EXEMPTION OF HEARING;
PROVIDING FOR REPORTING SERVICING FOR EXEMPTION; PROVIDING FOR
PROHIBITIONS; PROVIDING FOR CRIMINAL PENALTIES; PROVIDING FOR
LIMITATION OF LIABILITY; PROVIDING FOR SEVERABILITY;

PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING FOR EFFECTIVE
DATE. This Ordinance had been discussed in prior meetings but had
been rescheduled for first reading at this Council Meeting so
that the Police Chief could speak to it. Little moved, "that we
accept this Ordinance as prepared". Stoddard seconded and vote
on the motion was:

and therefore the motion was passed and adopted.
Mayor Mapes presented a Resolution entitled A RESOLUTION
OF THE LOXAHATCHEE COUNCIL OF GOVERNMENTS (COG) SUPPORTING THE
ACQUISITION OF LAND BY THE SOUTH FLORIDA WATER MANAGE14ENT DISTRICT
ALONG THE BANKS OF THE NORTHWEST FORK OF THE LOXAHATCHEE RIVER
FROM JONATHAN DICKINSON STATE PARK TO INDIANTOWN ROAD (ROUTE 706)
and told the Council that COG would like the Village of Tequesta
to accept this Resolution and to give the Mayor authorization
to approve the Resolution for adoption by COG and since he is the
appointed representative to COG by the Village he needs Council 's
approval. Stoddard moved, "that we .pass this Resolution and
authorize the Mayor to vote in favor of A RESOLUTION OF THE
LOXAHATCHEE COUNCIL OF GOVERNMENTS (COG) SUPPORTING THE
ACQUISITION OF LAND BY THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT
ALONG THE BANKS OF THE NORTHWEST FORK OF THE LOXAHATCHEE RIVER
FROM JONATHAN DICKINSON STATE PARK TO INDIANTOWN ROAD (ROUTE 706)".
Cook seconded and vote on the motion was:

and therefore the motion was passed and adopted.
The Village Manager had sent a memorandum to Council on
September 16, 1981 in which he had enclosed a copy of the
September 14, 1981 letter from South Florida Water Management
District advising that the district has removed all water use
restrictions. The Village Manager recommended that the Council
make a motion to remove same. Stoddard moved, "that we authorize
the Village Manager to end the water use restrictions". Little
seconded and vote on the motion was:

and therefore the motion was passed and adopted.
Little moved, "in the event the South Florida Water
Management District imposes another water restriction use in the

Water Management District that the Village Manager has the
authority to reimpose the restrictions required". Stoddard
seconded and vote on the motion was:

and therefore the motion was passed aqd .adopted.
The Village Manager explained to Council that it was necessary
to purchase a new base radio for the Water-Department-because the
old unit was beyond .:repair. The cost of the radio was $686;
and the cost of this replacement should be paid from the Water
Department Renewal and Replacement Fund. This needs the approval
of the Village Council and has received the approval of Gee & Jenson,
Water Department Consulting Engineers. Stoddard moved, "that
we approve the purchase of the Water Department Base Radio from the
Water Department Renewal and Replacement Fund". Little seconded
and vote on the motion was:

and therefore the motion was passed and adopted.
The Mayor told the audience that at a Workshop Meeting by
Council on the Budget held on September 21, 1981 it was the
concensus of Council to reducethe proposed millage rate to 3.0166.
He stated that he would like a motion to that fact. Little
moved, "that we approve the reduction in the millage rate from
3 .958 to 3.0166". Stoddard seconded and vote on the motion
was:

Council talked briefly about the September 21, 1981
Council Budget Workshop Meeting,
The Village Attorney announced that Rinker Materials
Corp. would be present at the October 13 , 1981 Council Meeting.
The meeting was adjourned at 9:09 P.M.
