Re: Consider Approval Kimley-Horn and Associates (KHA) Work Authorization for Reverse
Osmosis Discharge Permit Renewal Related Engineering Services for a Total Not to
Exceed $23,250
The Village of Tequesta (VOT) Utilities Department (UD) recommends approval of a work authorization
(WA)to Kimley-Horn and Associates for environmental engineering services related to the renewal of
the Village's Reverse Osmosis Discharge Permit, for a total not to exceed $23,250.
Reverse osmosis concentrate is conveyed to a surface water discharge at the base of the US-1 bridge.
This discharge is permitted through the Florida Department of Environmental Protection (FDEP) under
permit number FLO168572 and must be renewed every 5 calendar years.The current permit will expire
on December 15, 2026.
During permit renewal, FDEP may request additional information on previous permit requirements,
current and previous water quality sampling data, and intended future disposal options. It is important
for the Village to have the appropriate qualified consultants to respond to these requests within the
regulatory timeframe required by FDEP.
KHA has a master agreement with the Village procured through the Consultant's Competitive
Negotiations Act(CCNA), FS287.055, approved October 9, 2025.The UD has ongoing projects and
activities that need general engineering expertise throughout the year.As part of its CCNA continuing
services agreement, KHA has contracted with it to perform as-needed general engineering services.The
CCNA requires public agencies to select professional service firms based on qualifications.
Please see the attached scope of services for more details.The work authorization will be funded by the
Water Fund account for engineering services.

VILLAGE OF TEQUESTA
ENGINEERING SERVICES WORK AUTHORIZATION
CONCENTRATE DISPOSAL MAIN—INDUSTRIAL WASTE PERMIT RENEWAL
The terms used in this work authorization (Work Authorization or WA) with initial capital letters
have the meaning stated in the 2025 "Request for Qualifications" documents and the "Master
Agreement for Professional Services" (Agreement) referenced below.
This Work Authorization authorizes Kimley-Horn and Associates, Inc., to perform work set forth
herein and is issued pursuant to The Professional Engineering Services Agreement, between
the Village of Tequesta ("Client" or"Village") and Kimley-Horn and Associates, Inc. ("Kimley-
Horn" or"Consultant"), dated October 9, 2025, (or the date fully executed, if approved, after the
October 9, 2025, Council meeting in which the agreements will be brought for consideration of
approval) ("Agreement"). All terms and conditions of said Agreement are hereby incorporated
and made part of this Work Authorization.
PROJECT UNDERSTANDING
The Village's RO Water Treatment Plant discharges the plants reject fluid (a highly concentrated
brine solution generated by the RO process) through a dedicated 12-inch reject disposal main
that discharges into the Jupiter Inlet on the east side of the US 1 bridge. The Village maintains
an Industrial Waste Permit with the Florida Department of Environmental Protection (FDEP) that
allows the Village to discharge the reject into the Inlet at the defined permitted location. This
permit has an expiration date of December 14, 2026. Renewal applications for this permit are
due to the FDEP at least 180 days prior to the expiration date, that will be on or before May 14,
2026.
In order to ensure that the renewal of this application and supporting documentation is
completed timely, the Village requested Kimley-Horn to provide this scope of work early so that
these deadlines are met.
SCOPE
The following is description of services to be provided under this Work Authorization.
TASK 1 — FDEP APPLICATIONS
Consultant will perform the following services:
1. Complete a site visit to evaluate the condition and operation of the treatment process
applicable to the Industrial Wastewater Permit.
2. Review of the last 2 years of Discharge Monitoring Reports (DMR) as submitted to the
FDEP.

3. Prepare supporting documentation as required by the FDEP Permit Application to
include new outfall location, pertinent DMR data and overall site plan/reject main route.
Information in the application and supporting documentation shall be based on operating
data provided by the Village.
4. Prepare and submit the appropriate FDEP applications for renewal. The Village will be
responsible for payment of any permit application fees.
5. Address up to two (2) requests for additional information from the FDEP.
TASK 2 — CONSULTANT COORDINATION
Provide assistance and coordination with the Village's environmental consultant that will be
providing data and reasoning relative to the relocation of one of the permitted sample locations.
ADDITIONAL SERVICES
Any services not specifically provided for in the above scope, as well as any changes in the
scope requested by the Village, will be considered additional services to this Work Authorization
and will be performed based on subsequent Work Authorizations approved prior to performance
of the additional services.
INFORMATION AND SERVICES PROVIDED BY THE VILLAGE
Kimley-Horn assumes that all information provided by the Village can be relied upon in the
performance of professional services. The following information shall be provided to Kimley-
Horn and/or the following services will be performed by the Village.
• Past DMR data/reports.
• Payment of the permit application fee.

COMPENSATION
Kimley-Horn will perform the services described herein on an hourly basis with a not to exceed
amount of Twenty-three Thousand Two Hundred and Fifty dollars ($23,250.00) in accordance
with the hourly rates established in the Professional Engineering Services Agreement between
the Village and Kimley-Horn.

PUBLIC RECORDS. In accordance with Sec. 119.0701, Florida Statutes, CONTRACTOR must keep
and maintain this Agreement and any other records associated therewith and that are associated
with the performance of the work described in the Proposal or Bid. Upon request from the
Village's custodian of public records, CONTRACTOR must provide the Village with copies of
requested records, or allow such records to be inspected or copied, within a reasonable time in
accordance with access and cost requirements of Chapter 119, Florida Statutes. A CONTRACTOR
who fails to provide the public records to the Village, or fails to make them available for
inspection or copying, within a reasonable time may be subject to attorney's fees and costs
pursuant to Sec. 119.0701, Florida Statutes, and other penalties under Sec. 119.10, Florida
Statutes. Further, CONTRACTOR shall ensure that any exempt or confidential records associated
with this Agreement or associated with the performance of the work described in the Proposal
or Bid are not disclosed except as authorized by law for the duration of the Agreement term, and
following completion of the Agreement if the CONTRACTOR does not transfer the records to the
Village. Finally, upon completion of the Agreement, CONTRACTOR shall transfer, at no cost to
the Village, all public records in possession of the CONTRACTOR, or keep and maintain public
records required by the Village. If the CONTRACTOR transfers all public records to the Village
upon completion of the Agreement, the CONTRACTOR shall destroy any duplicate public records
that are exempt or confidential and exempt from public records disclosure requirements. If the
CONTRACTOR keeps and maintains public records upon completion of the Agreement, the
CONTRACTOR shall meet all applicable requirements for retaining public records. Records that
are stored electronically must be provided to the VILLAGE, upon request from the Village's
custodian of public records, in a format that is compatible with the Village's information
technology systems.

Pursuant to Article XII of the Palm Beach County Charter, the Office of the Inspector General has
jurisdiction to investigate municipal matters, review and audit municipal contracts and other
transactions, and make reports and recommendations to municipal governing bodies based on
such audits, reviews, or investigations. All parties doing business with the Village shall fully
cooperate with the inspector general in the exercise of the inspector general's functions,
authority, and power. The inspector general has the power to take sworn statements, require
the production of records, and to audit, monitor, investigate and inspect the activities of the
Village, as well as contractors and lobbyists of the Village in order to detect, deter, prevent, and
eradicate fraud, waste, mismanagement, misconduct, and abuses.
