Re: Consider Approval of Engenuity Group, Inc. Work Authorization for NPDES Annual
Compliance Reporting Assistance for a Total Not to Exceed $5,500
The Village of Tequesta (VOT) Utilities Department(UD) recommends approval of a work authorization
(WA)with Engenuity Group, Inc. for NPDES Annual Compliance Reporting Assistance for a Total Not to
Exceed $5,500.
The Village is required to comply with the National Pollutant Discharge Elimination System (NPDES)
Municipal Separate Storm Sewer System (MS4) permit program, which requires implementation and
continuous improvement of a Stormwater Management Program (SWMP)to reduce pollutants to the
maximum extent practicable (MEP) and protect water quality. Florida MS4 permit coverage generally
requires an SWMP that includes six minimum control measures and measurable goals, along with
required annual reporting to the Florida Department of Environmental Protection (FDEP). Palm Beach
County MS4 permittees also coordinate program activities through an established MS4 Steering
Committee, with the Northern Palm Beach County Improvement District (NPBCID) serving in a
lead/administrative role for the group's program.
Engenuity Group, Inc. submitted a proposal dated December 16, 2025, to provide professional
engineering services to support the Village's NPDES/MS4 compliance activities during FY 2025-2026.
The proposed scope includes:
- Attendance at monthly NPDES Steering Committee meetings at NPBCID as the Village's
representative.
- Gather required documentation for the joint annual report and submit to FDEP.
- Guidance to staff on SOPS for inspecting inlets, control structures, and outfalls, and addressing
reactive illicit discharges.
- Guidance on Year 1 additional requirements including interdepartmental review of
stormwater/land development regulations and development of a stormwater structures inventory.
These services directly support the Village's permit obligations, including SWMP implementation,
inspection/IDDE support, coordinated countywide reporting, and meeting participation—elements
commonly relied upon to demonstrate MS4 program implementation and annual reporting compliance.

Engenuity Group, Inc. has a master agreement with the Village procured through the Consultant's
Competitive Negotiations Act (CCNA), FS287.055, approved October 9, 2025. The CCNA requires public
agencies to select professional service firms based on qualifications.
Please see the attached scope of services for more details. The work authorization will be funded by the
Storm Water Fund Engineering Services account.

Dear Ms. Felsburg:
We are pleased to offer this proposal to render professional Civil Engineering
services for representation and reporting for the National Pollutant Discharge
Elimination System (NPDES) (hereinafter called the 'Project') for the Village of
Tequesta. This analysis will be pursuant to Section 403.0885 of the Florida Statutes
and will be completed during the 2025-2026 Fiscal Year.
Our services will consist of the following:
1. Attendance at monthly NPDES Steering Committee meetings at the
Northern Palm Beach County Improvement District as a representative for
the Village of Tequesta.
2. Gather all necessary paperwork and information for the joint annual
report and submit it to the FDEP.
3. Guide Town personnel on the implementation of "Standard Operating
Procedures" for inspecting inlets, control structures, and outfalls, and any
reactive illicit discharges.
4. Guide Town personnel on gathering Year 1 additional requirements such
as inter-departmental review of stormwater/land development
regulations/codes and the stormwater structures inventory.
We propose providing these services with an Hourly NTE fee of 5,500.00
If the Village is selected for an audit, we can assist on an hourly basis at our
discounted rates. Special requests made by the steering committee throughout
the fiscal year will be reviewed individually to determine whether additional fees
are needed. We will not perform any additional services without your written
consent.
In addition to the above services, we have NPDES certified inspectors on staff
(available at an hourly discounted rate) that may be utilized on an as needed

basis. Our staff can also be utilized to perform observations of the catch basins,
swales, and/or retention ponds, as required for the Annual Report.
Permit Fees, Reproduction Charges and Reimbursable Expenses
The Total Contract Price does not include the payment of any governmental
agency submittal or processing fees. The cost of these fees and any costs
incurred by the office for printing, reproduction and other reimbursable expenses
such as long-distance telephone calls, facsimile, postage, travel, and document
copy charges will be billed to the client monthly.
Invoicing and Payment
Invoicing and payment shall be in accordance with our agreement with the
Village of Tequesta.
This proposal represents the entire understanding between you and us with
respect to the Project. If this satisfactorily sets forth your understanding of our
agreement, please execute the attached Authorization and return it to us. If you
have any questions, please do not hesitate to contact us.
PURSUANT TO SECTION 558.0035 FLORIDA STATUTES, THE CONSULTANT IS THE
RESPONSIBLE PARTY FOR THE PROFESSIONAL SERVICES IT AGREES TO
PROVIDE UNDER THIS CONTRACT. NO INDIVIDUAL PROFESSIONAL
EMPLOYEE, AGENT, DIRECTOR, OFFICER OR PRINCIPAL MAY BE
INDIVIDUALLY LIABLE FOR NEGLIGENCE ARISING OUT OF THIS CONTRACT,
AS LONG AS THE CONSULTANT MAINTAINS THE PROFESSIONAL LIABILITY
INSURANCE REQUIRED UNDER THIS CONTRACT AND AS LONG AS ANY
DAMAGES ARE SOLELY ECONOMIC IN NATURE AND THE DAMAGES DO NOT
EXTEND TO PERSONAL INJURIES OR PROPERTY NOT SUBJECT TO THIS
CONTRACT.
