Consider Approval of Change Order No. 1 for the WM #1 Tequesta Drive Water Main Replacement
project, authorizing a twenty (20) calendar-day extension to the contract time.
SUMMARY: A
The Utilities Department (UD) recommends approval of Change Order No. 1 for the WM #1 Tequesta
Drive Water Main Replacement project, authorizing a twenty (20) calendar-day extension to the
contract time due to abnormal weather conditions, with no change to the contract price.
On July 30, 2025, the Village issued a Notice to Proceed to Ferreira Construction Co., Inc. for the WM
#1 Tequesta Drive Water Main Replacement project. The original contract established a Substantial
Completion date of January 26, 2026, and a Final Completion date of February 25, 2026. During
construction, the project encountered periods of excessive rainfall and elevated groundwater
conditions that adversely impacted trenching, dewatering, and water main installation activities.
Section 4.05(C) of the EJCDC General Conditions of the Construction Contract allows for an
equitable adjustment to contract time when performance is delayed by unanticipated causes beyond
the control of the Contractor, including abnormal weather conditions.
Rainfall data from the South Florida Water Management District (SFWMD) Indiantown Road rain
gauge demonstrates that the project area experienced abnormal weather during the contract period.
October 2025 recorded approximately 25.27 inches of rainfall, exceeding the historical monthly
average by more than 17 inches and representing more than three times the typical rainfall for that
month. In addition to cumulative rainfall totals, daily rainfall records show that at least fourteen (14)
weekdays during the contract period experienced rainfall events of 0.50 inches or greater.
Several of these events, particularly the October 9, 2025, rainfall event exceeding 12 inches in a
single weekday, resulted in prolonged site saturation, elevated groundwater levels, and excessive
dewatering requirements. These conditions prevented safe and productive construction operations for
multiple consecutive days following the rainfall events.
The requested twenty (20) calendar-day time extension reflects both the documented rainfall events
and the resulting loss of workable days due to abnormal site conditions, as allowed under the
Contract. No additional compensation is requested or authorized under this change order.

established reference points and property monuments, and shall make no changes or
relocations without the prior written approval of Owner. Contractor shall report to Engineer
whenever any reference point or property monument is lost or destroyed or requires
relocation because of necessary changes in grades or locations, and shall be responsible for
the accurate replacement or relocation of such reference points or property monuments by
professionally qualified personnel.
4.04 Progress Schedule
A. Contractor shall adhere to the Progress Schedule established in accordance with
Paragraph 2.05 as it may be adjusted from time to time as provided below.
1. Contractor shall submit to Engineer for acceptance (to the extent indicated in
Paragraph 2.05) proposed adjustments in the Progress Schedule that will not result in
changing the Contract Times.
2. Proposed adjustments in the Progress Schedule that will change the Contract Times must
be submitted in accordance with the requirements of Article 11.
B. Contractor shall carry on the Work and adhere to the Progress Schedule during all disputes or
disagreements with Owner. No Work will be delayed or postponed pending resolution of any
disputes or disagreements, or during any appeal process, except as permitted by
Paragraph 16.04, or as Owner and Contractor may otherwise agree in writing.
4.05 Delays in Contractor's Progress
A. If Owner, Engineer, or anyone for whom Owner is responsible, delays, disrupts, or interferes
with the performance or progress of the Work, then Contractor shall be entitled to an
equitable adjustment in Contract Price or Contract Times.
B. Contractor shall not be entitled to an adjustment in Contract Price or Contract Times for delay,
disruption, or interference caused by or within the control of Contractor. Delay, disruption,
and interference attributable to and within the control of a Subcontractor or Supplier shall be
deemed to be within the control of Contractor.
C. If Contractor's performance or progress is delayed, disrupted, or interfered with by
unanticipated causes not the fault of and beyond the control of Owner, Contractor, and those
for which they are responsible, then Contractor shall be entitled to an equitable adjustment
in Contract Times. Such an adjustment will be Contractor's sole and exclusive remedy for the
delays, disruption, and interference described in this paragraph. Causes of delay, disruption,
or interference that may give rise to an adjustment in Contract Times under this paragraph
include but are not limited to the following:
1. Severe and unavoidable natural catastrophes such as fires, floods, epidemics, and
earthquakes;
2. Abnormal weather conditions;
3. Acts or failures to act of third-party utility owners or other third-party entities(other than
those third-party utility owners or other third-party entities performing other work at or
adjacent to the Site as arranged by or under contract with Owner, as contemplated in
Article 8); and
4. Acts of war or terrorism.
