Regular Council

STAFF MEMO
Meeting: Regular Council - Jan 08 2026
Staff Contact: Wayne Cameron Department: Building
Consider approval to allow construction activity outside of regular construction hours during the
period of 9:00p.m. — 7:00a.m., January 8th through January 22nd for a necessary roof replacement
project at 221 S US HWY 1 —Village Square.
Pursuant to Code of Ordinances, Section 14-1, construction activities are limited to the hours of 7:00
a.m. to 6:00 p.m. during weekdays, unless approval is granted by the Village Council. Please
consider approval to allow construction activity outside of regular construction hours during the period
of 9:00p.m. — 7:00a.m., January 8th through January 22nd for a necessary roof replacement project
at 221 S US HWY 1 — Village Square.
The roof at Village Square is currently in poor condition and some sections of it have deteriorated to a
point where replacement is necessary to protect the health and safety of business owners,
employees, and customers. Delaying or prolonging this work increases the risk of water intrusion,
structural damage, and unsafe conditions within the occupied commercial spaces.
Village Square is an active commercial center with multiple operating local businesses that depend
on consistent daytime access for customers. Conducting roofing construction, in this particular case,
during normal business hours would significantly disrupt operations, potentially forcing businesses
closures and creating safety concerns for the public.
This request is made in the interest of:
• Protecting the health and safety of occupants and visitors
• Minimizing disruption to local businesses and their employees
• Allowing the work to be completed more efficiently and safely
• Reducing risks associated with construction activity during peak daytime hours
All work would comply with applicable safety standards and any conditions imposed by the Village.
A building permit for the roof has been obtained by the plaza. Please see attached aerial view of the
current roof and petition signed by the businesses owners who are being affected the most by the
roof construction project.

Agenda Item #15.
Petition Requesting Approval for Nighttime Construction
221 S US HWY 1 -Village Square,Tequesta, Florida
January 7th9 2026
Subject: Request for Approval of Nighttime Construction for Roof Replacement at
Village Square
We,the undersigned business owners, employees, and patrons of Village Square in
Tequesta, respectfully submit this petition to request approval for nighttime construction
hours to complete the planned roof replacement at the Village Square shopping center
during Thursday, January 811 through January 22nd, 2025
Background
Village Square is home to several small, locally operated businesses that rely heavily on
consistent daytime operations.A roof replacement is necessary to maintain the safety,
integrity, and long-term viability of the property. However, conducting this work during
normal business hours would result in significant disruption, including:
■ Potential safety concerns during peak daytime
• Forced business closures or reduced operating hours
• Loss of revenue for small businesses and their employees
• Inconvenience to customers
Request
To minimize these impacts, we respectfully request permission for the roof replacement
work to be conducted during nighttime hours, within reasonable limits set by the Village,
such as:
■ Defined nighttime construction hours—9:00pm--7:00am.
■ Compliance with all applicable noise, safety, and lighting regulations.
• Temporary and time-limited approval strictly for the duration of the roof
replacement project.
Community Benefit
Allowing nighttime construction would:
• Reduce congestion and safety risks during peak hours
• Preserve uninterrupted daytime business operations
• Protect local jobs and small business income
• Enable the project to be completed more efficiently
We appreciate your consideration and are happy to cooperate fully to ensure the project is
completed responsibly and with minimal community impact.
