E A S E M E N T
THIS INDENTURE OF EASEMENT made this 27th day of
November, 1962, between PALM BEACH TRUST COMPANY, a Florida
corporation, and FIELDS POINT MANUFACTURING CORPORATION, a
Rhode Island corporation, hereinafter called the "Grantors" ,
and JUPITER UTILITY CO. ,INC. , a Florida corporation, herein-
after called the "Grantee" .
W I T N E S S E T H:
That for and in consideration of the sum of $10 .00
in cash paid, the receipt whereof is hereby acknowledged, and
other good and valuable considerations, the Grantors have this
day bargained and sold and by these presents do bargain, sell,
convey, transfer and deliver unto the Grantee, its successors
and assigns, a permanent easement and right-of-way including a
perpetual right to enter upon the real estate hereinafter des-
cribed, and construct, maintain, and repair, underground pipe
lines and/or mains for the purpose of conveying water under,
across and through the lands hereinafter described, together with
the right to excavate and refill trenches for the location of said
pipe lines and/or mains, and the further right to remove trees,
bushes, undergrowth and other obstructions, except driveways,
interfering with the location, construction and maintenance of
said pipe lines and/or mains .
The land affected by the grant of this easement and
right-of-way is located in the County of Palm Beach and State of
Florida, and is more particularly described as follows :
A strip of land 5 feet in width, the center line
of which is 47 .5 feet westerly and northerly of
V and parallel to the center line of proposed
/ right-of-way of State Road No. 707 , as shown on

the plat thereof on file and of record in Road
Plat Book 2 , pages 69 and 71, Public Records of
Palm Beach County, Florida. Such right-of-way
to extend across Lot 197 of Jupiter Island,
as shown in Plat Book 1, page 80, Public Records
of Palm Beach County, Florida.
The Grantee, by the acceptance of this grant of easement,
recognizes that the aforesaid easement and right-of-way lies within
the proposed right-of-way of State Road No. 707 , which right-of-way
will eventually vest in the State of Florida, and the Grantee, by
the acceptance of this easement, hereby covenants and agrees to
abide by all lawful rules, regulations and requirements of the
State Road Department of the State of Florida.
TO HAVE AND TO HOLD said easement and right-of-way unto
the Grantee and unto its successors and assigns forever.
The Grantors do hereby covenant with the Grantee that
they are lawfully seized and possessed of the real property herein-
above described, that they have a good and lawful right to convey
it or any part thereof, that it is free from all encumbrances and
that they will forever warrant and defend the title thereto against
the lawful claims of all persons whomsoever, claiming under, by or through
them.
IN WITNESS WHEREOF, the Grantors have caused these presents
to be duly executed in their respective corporate names by their
officers thereunto duly authorized, the day and year first above
written.
