Council Consideration and Direction on Filing Village Council Seat 1 in Accordance with Village Code
Sec. 2-273(a) and (b)
BACKGROUND
On February 3, 2026, the Village Clerk was notified the newly elected Council Member, who ran
unopposed for Village Council Seat 1, had moved to a new residence that is no longer located within
the Village of Tequesta municipal boundaries.
DISCUSSION
Village Code Sec. 2-273 addresses vacancies occurring after an election but prior to the Council
Member Elect taking the oath of office. Specifically, Sec. 2-273(c) provides that if a vacancy occurs
due to resignation, death, or forfeiture of office after the election but before the oath of office is taken,
the vacancy shall be filled in accordance with the appointment procedures outlined in Sec. 2-273(a),
using the criteria in Sec. 2-273(b).
Under Sec. 2-273(a), the Village Council may, by majority vote of the remaining Councilmembers,
appoint a qualified elector to hold the office until the next available general election, at which time a
successor Councilmember shall be elected to serve any remaining unexpired term.
CRITERIA
The criteria for selection of an appointed councilmember under subsection (a) above are as follows:
(1) Be a qualified elector of the Village of Tequesta pursuant to Village Charter section 2.02; and
(2) Be a resident of the Village of Tequesta for a minimum of one continuous year prior to being
appointed; and
(3) Submit a resume and letter of interest to the village clerk pursuant to any deadline for submissions
that has been advertised by the Village; and
(4) Agree to resign any currently held Village of Tequesta board or committee position immediately
upon appointment becoming effective.
(5) Satisfactory proof of having met the residency requirements required by the Village Charter and
this chapter shall include submission of at least one of the following items, in the name of the
candidate, for the one-year period prior to the date of the election for which the candidate is
qualifying: a Village of Tequesta utility bill in the candidate's name or a rental/lease agreement in the

candidate's name and showing the rental date range. Candidates shall also submit documentation
that they are qualified elector.
RECOMMENDED ACTION
Provide direction to staff to advertise the vacancy and accept the documents outlined under "criteria"
via an application process for placement on the March 12, 2026 Council agenda, in accordance with
Village Code Sec. 2-273.
