Regular Council STAFF MEMO A-1 Meeting: Regular Council - Mar 12 2026 Staff Contact: Allyson Burg Department: Utilities First Hearing to Consider Approval of the First Addendum to the Development Agreement for The Reserve at Tequesta SUMMARY: A Royal Tequesta, LLC is the developer of The Reserve at Tequesta, a multi-family residential project located on SE Federal Highway. On May 13, 2021, the Village and Royal Tequesta, LLC entered into a Development Agreement governing the project. The original agreement provided for an initial five- year term with the option for up to two additional five-year extensions, subject to the terms and conditions of the agreement. The First Addendum extends the Development Agreement for the first available five-year term, as permitted under Section 41 of the original agreement. With approval of this Addendum, the Development Agreement will remain in effect until May 13, 2031. No other substantive changes to the original Development Agreement are proposed. In accordance with the original agreement, the Developer is required to pay the Village's internal and legal review fees associated with processing this extension. The fee for this extension is $1,000.00. The proposed First Addendum is administrative in nature and is consistent with the provisions of the original Development Agreement. Extending the agreement allows the Developer to maintain vested rights under the agreement while continuing to comply with all previously approved conditions. All terms and conditions of the original Development Agreement not specifically amended by this Addendum remain in full force and effect. Per Village of Tequesta Ordinance 62-151 this Amendment requires two public hearings as well as proper public advertisement. All public advertisement requirements have been met and a second and final hearing, if first hearing is approved, will be included on the April Council meeting agenda.
