HomeMy WebLinkAboutMinutes_Special Master_2/11/2026 MINUTES SPECIAL MAGISTRATE MEETING JUPITER INLET COLONY, FL 10:00 AM (OR IMMEDIATELY FEBRUARY 11, 2026 FOLLOWING COUNCIL CHAMBERS THE VILLAGE'S HEARINGS) CALL TO ORDER The Special Magistrate Kevin Wagner began the meeting at 10:05 am and led the pledge of allegiance. Present were Special Magistrate Kevin Wagner, Code Enforcement Officer Jacqueline Milo and Town of Jupiter Inlet Colony Attorney. The following cases were heard by the Special Magistrate who swore in 8 people involved in the Quasi-Judicial cases. PLEDGE OF ALLEGIANCE - Special Magistrate Kevin Wagner REPEAT VIOLATION HEARINGS None were presented at this meeting FINE ASSESSMENT HEARINGS/ STATUS HEARINGS None were presented at this meeting. VIOLATION HEARINGS 1. Michael Jacobs & Lori Jacobs Address: 16 Ocean Drive Jupiter Inlet Colony, FL 33469 JIC Case Number: JIC-25-46-CE - FBC Section[A]105.1 The findings of facts were that: 1.Respondents, Lori Jacobs and Michael Jacobs, were the owners of the property located at 16 Ocean Drive, Jupiter Inlet Colony, FL 33469 (the "Subject Property"). 2.13oth Respondents attended the February 11, 2026 hearing, and proper notice to the Respondents was provided by the Town pursuant to Chapter 162, Florida Statutes. 3.Respondents constructed a wall out of concrete cinderblock with rebar (the "Wall") without obtaining a building permit from the Town as required by Section 4.1 of the Town of Jupiter Inlet Colony's Code of Ordinances, adopting Section 105.1 of the Florida Page 1 of 3 Building Code. 4.The Town never issued a building permit to Respondents for the construction of the Wall. 5.Respondents submitted an application for a building permit to the Town. However, Respondents' application was denied by the Town due, in part, to Respondents' failure to provide a survey showing the location of the proposed Wall was on the Subject Property. 6.Respondents did not have a building permit from the Town for the Wall. Conclusions of law were that based on the Findings of Fact set forth above, Respondents were in violation of Section 4.1 of the Town of Jupiter Inlet Colony's Code of Ordinances, adopting Section 105.1 of the Florida Building Code. It was the order of the Special Magistrate that the Respondents were required to comply with Section 4.1 of the Town of Jupiter Inlet Colony's Code of Ordinances, adopting Section 105.1 of the Florida Building Code by March 1, 2026. If Respondents did not comply within the time specified, a fine in the amount of Two Hundred Fifty Dollars ($250.00) per day could have been imposed for each day the violation continued to exist after March 1, 2026. Upon complying in any code enforcement matter, it was the responsibility of the Respondents to contact the Code Enforcement Department at (561) 701-3276 to request an inspection of the Subject Property. In the event Respondents did not fully comply with the Town's Code of Ordinances within the time specified, a fine assessment hearing was to be held before the Special Magistrate on March 11, 2026 at 10:00 AM at Village Hall for the Village of Tequesta, 345 Tequesta Drive, Tequesta, FL 33461 to determine whether Respondents continued to be in violation of the above-referenced code section and to consider the assessment of a fine. FINE REDUCTION HEARINGS None were presented at this meeting. FORECLOSURE AUTHORIZATIONS None were presented at this meeting. ANY OTHER MATTERS None were presented at this meeting.
