HomeMy WebLinkAboutAgreement_General_4/9/2026_Kimley Horn VILLAGE OF TEQUESTA ENGINEERING SERVICES WORK AUTHORIZATION 136 BRIDGE ROAD PUBLIC SERVICE FACILITY RESTORATION This Work Authorization authorizes Kimley-Horn and Associates, Inc. to perform work set forth herein and is issued pursuant to The Professional Engineering Services Agreement, between the Village of Tequesta ("Client' or"Village") and Kimley-Horn and Associates, Inc. ("Kim ley-Horn" or "Consultant'), dated May 12, 2016 ("Agreement'). Kimley-Horn is honoring the rates in the May 12, 2016 contract per email correspondence between Tom Jensen and Doug Chambers on October 28, 2025. All terms and conditions of said Agreement are hereby incorporated and made part of this Work Authorization. PROJECT UNDERSTANDING Kimley-Horn performed an assessment of the steel framing of the building located at 136 Bridge Road ("Public Service Facility") in Tequesta, Florida. Following the assessment, which took place on January 22, 2025, Kimley-Horn prepared a damage report, titled "136 Bridge Road Public Service Facility Damage Report", with recommended repairs as well as an opinion of probable cost for two different repair options. The Village would like Kimley-Horn to prepare Construction Drawings with Specifications to detail the repairs needed to restore the deficiencies noted in the damage report as well as assistance with the bidding/permitting process and limited construction phase services. The Village has requested Kimley-Horn to assist with informal bid procurement i for bid phase services: Informal Procurement ($25,000—$75,000): Requires total of three written quotes. SCOPE OF SERVICES Kimley-Horn will perform the following services: Task 1 — Public Service Facility Construction Drawings; Kimley-Horn will develop a set of Construction Drawings for the restoration and repair of the Public Service Facility building structural steel framing as outlined in the Damage Report determined from the site visit conducted on January 22, 2025. It is anticipated that the Construction Drawings will include a total of five (5) sheets: Cover Sheet, General Notes, Site Plan, Structural Details, and Annotated Photographs to convey the intent of the repairs. Technical and material specifications may be provided as notes on the plans or as an appendix to the plans. A preliminary (90%) plan set will be submitted to the client for review. A 100% (Final) set of signed and sealed drawings will be prepared and submitted to the client. This task includes up to two (2) 1-hour virtual or in-person meetings with the Village to discuss the 90% and Final plans submittal. Review comments will then be incorporated into the final plan set. Page 1 of 4 This agreement does not include the repair or design details for those items which may be concealed or hidden at this time but uncovered during the construction phase of the repairs. The construction drawings will designate all repairs as either Priority 1 or Priority 2 level repairs. Priority 1 items will be those listed as in "poor condition" from Kimley-Horn's "136 Bridge Road Public Service Facility Damage Report". Priority 2 items will be those listed as in "fair condition" or"good condition"from Kimley-Horn's 136 Bridge Road Public Service Facility Damage Report". It is our expectation that the repair details included in the construction documents will be limited to the following: • Steel Column Structural Repairs • Steel Column Clean and Coat Repairs • Steel Girls Clean and Coat Repairs Task 2— Bid Assistance- Informal Procurement; Consultant will prepare a Bid package for the use in solicitation of Contractors. Bid documents will consist of the following: Scope of Work, Quotation Form, Bid Form, and Bid Drawings. This task assumes that the Client will provide all front end and contractual documents required for the project. Consultant will assist the client in identifying qualified Contractors to provide the bid package in order to solicit bids from a total of three(3)contractors. Consultant will coordinate with prospective bidders and help facilitate procurement of the bids by identifying a pool of Contractors, distributing the Bid Package, providing deadlines for bid response, and responding to RFIs from the Contractor(s). No modifications or revisions to drawings, following Contractor review, are included in this scope of work. Consultant will review the bids for completeness and tabulate the bids received. Bids will be evaluated for general compliance with the bidding package requirements. Consultant will provide a summary of this tabulation and evaluation. If requested, Consultant will notify the selected Contractor. Task 3— Construction Phase Services; Kimley-Horn will perform the following construction phase services, on a labor fee plus expense basis. Labor fee will be billed on an hourly basis according to our then-current rates. • Organize and conduct a pre-construction meeting before start of construction. • Make up to two (2) site visits to observe the progress of the work. Observations will not be exhaustive or extend to every aspect of Contractor's work, but will be limited to spot checking and similar methods of general observations. Based on site visits, Consultant will evaluate whether Contractors work is generally proceeding in accordance with the construction documents and keep client informed of the general progress of work. Based on the site visits Consultant will prepare corresponding field reports documenting observations. Page 2 of 4 • Attend up to one(1)construction meeting with Contractor and/or product representatives to review in-situ conditions / intended product installations and prepare written report summary of the meeting. • Review up to two (2) shop drawings, samples, substitutes, and submittals; which Contractor is required to submit, but only for general conformance with the Contract Documents. Such review and any action taken in response will not extend to means, methods, techniques, equipment choice and usage, schedules, or procedures of construction or to related safety programs. Any action in response to a shop drawing will not constitute a change in the Contract Documents, which can be changed only through the Change Orders. The following are anticipated for review: o Structural Column Repair Detail o Coating Material • Consultant may recommend Change Orders to the Client and will review to Change Orders (up to two) submitted or proposed by the Contractor for interpretations, clarifications and information. • Based on its observations and on review of applications for payment and supporting documentation, Consultant will recommend amounts that Contractor be paid. Recommendations will be based on Consultant's knowledge, information and belief, and will state whether in Consultant's opinion Contractor's work has progressed to the point indicated, subject to any qualifications stated in the recommendation. Consultant's recommendations will not be a representation that its observations to check Contractor's work have been exhaustive, extended to every aspect of Contractor's work, or involved detailed inspections. • Consultant will conduct a final site visit to evaluate whether the completed Work of Contractor is generally in accordance with the Contract Documents so that Consultant may recommend final payment to Contractor. • If all work is completed to Engineer's satisfaction, Consultant will prepare a final letter of acceptance. ADDITIONAL SERVICES Any services not specifically provided for in the above scope, as well as any changes in the scope requested by the Village, will be considered additional services to this Work Authorization and will be performed based on subsequent Work Authorizations approved prior to performance of the additional services. SCHEDULE We will provide our services as expeditiously as practicable with the goal of meeting a mutually agreeable schedule. COMPENSATION Kimley-Horn will perform the scope of services described in Task 1 through Task 2 for the lump sum fees shown below. Task 1 — Public Service Facility Construction Drawings $18,390 Task 2 — Informal Procurement Bid Assistance $6,480 Page 3 of 4 Task 3 will be performed on a labor fee plus expense basis with the maximum labor fee shown below. Labor fee will be billed on an hourly basis according to our then-current rates. Kimley-Horn will not exceed the total maximum labor fee shown without authorization from the Client. Date: February 13, 2025 Subject: Tequesta Public Service Facility Damage Report Introduction: In accordance with our agreement, Kimley-Horn visited the Tequesta Public Service Facility located at 136 Bridge Road Tequesta, Florida 33469 ("Property") on January 22"d, 2025, to observe the reported steel column corrosion. This report provides our observations from our site visit on January 22"d, 2025, as well as our repair recommendations for the observed deficiencies. Background: The Property is a Village of Tequesta Public Services Facility Building originally constructed in 1997, per the Palm Beach County Property Appraiser's website. The building is a pre-engineered metal building containing office, garage, and storage spaces. It is our understanding that the Village of Tequesta observed corrosion at the base of steel rigid frame columns. The purpose of our January 22"d site visit was to conduct a non-destructive, visual assessment of the readily accessible structural steel columns and base plates supporting the building at the Property. During the visual examination Kimley-Horn assessed the steel for discoloration, pitting, deterioration, corrosion, section loss, and excessive deflections indicative of substantial structural deterioration. Kimley-Horn was provided with eighteen (18)sheets of construction drawings prepared by Slattery& Root Architects as well as Albert C. Nelson & Associates and dated September 1996. The drawings contain structural plans that depict the construction of the building. 1920 Wekiva Way. Suite 00 �.. Kimley>Morn Page t Observations: On January 22"d, 2025, Mrs. Sheila Preble. P.E., and Mr. Jason Goldman E.I., visited the Property to conduct a site walk and document the reported damages. The following is a summary of Mrs. Preble's and Mr. Goldman's observations from their site visit. All referenced photographs are included in Appendix B - Photographs. • The Property consisted of a pre-engineered one-story metal building with an office, garage, and storage room. The building was constructed with steel rigid frames, purlins, wall girts, corrugated exterior wall panels, and a metal panel roof. There were CMU block exterior walls at isolated locations as well as CMU block partition walls (Photographs 1-3). During our review of the construction drawings, we noted that the building had a slab-on-grade with grade beams. • The steel rigid frame columns were connected to the grade beams with a steel base plate and steel anchor bolts. The columns were welded to the base plate (Photograph 4). Columns were spaced at approximately 20-feet on center. • We observed several columns with varying levels of corrosion at the connection to the base plate ranging from minor surface level corrosion to advanced corrosion resulting in section loss. All referenced columns are included in Appendix A— Column Layout. The base of columns 1 B and 26 were wet at the time of the site visit and were adjacent to opened garage doors where they were exposed to rain. There were columns observed that had no observable corrosion and were in good condition (Photographs 5-7). • See Table 1: Column Condition for our summary observation of each column. Refer to the Discussion and Recommendations Section for the definitions of the Poor, Fair and Good designations. Kim ey>>>Horn Page 3 Discussion and Recommendations: As part of this assessment, we designated each column reviewed with a condition rating. The condition ratings are defined as follows in accordance with ASTM E2018-15 Standard Guide for Property Condition Assessments: • Designation "Good": In working condition and does not require immediate or short-term repairs. The steel column is in overall good condition; Does not require repair. • Designation "Fair": In working condition but may require immediate or short-term repairs. The steel column exhibits surface corrosion and/or section loss less than 20%; may require limited repair such as cleaning and coating. • Designation "Poor": Not in working condition or requires immediate or short-term repairs. The steel column exhibits section loss over 20%and/or voids; requires structural repair. Based on our observations, we recommend completing a structural repair to the columns designated as Poor condition. Our preliminary analysis shows that it is feasible to weld steel plates to the portion of the column that does not exhibit corrosion and to the base plate.An exception was observed to this assumption at Column 2B where the base plate and anchor bolts may lack sufficient section size after cleaning. For this case, a new base plate and anchor bolt will require installation as well as concrete patch work. An appropriate corrosion protection system should be applied to the steel after the structural repair is complete. We recommend cleaning all corrosion from the steel and coating the steel with an appropriate corrosion protection system for columns designated as Fair condition. All other steel with surface corrosion noted at the top of columns and in the wall girts is recommended to be cleaned and coated. The steel columns are connected to a steel base plate slightly elevated on a grout pad; however, the grout pad at each location varies in thickness. We noted there are columns adjacent to garage openings where they are subject to contact with rain. We recommend applying an appropriate corrosion protection system to the base of all columns, base plates, and anchor bolts, including columns with a Good condition rating, to promote longevity of the structural steel members. In addition,the garage doors are recommended to be closed during storm events to prevent interior steel contact with moisture. Our review of the provided structural drawings from Albert C. Nelson and Associates shows hooked anchor bolts connecting the column base plate to the foundation. See Figure 1, taken from S-1 of the drawings, which depicts the connection between the base plate and foundation. Due to clearance limitations in the garage as well as the hooked bolt configuration,we recommend utilizing the existing base plate and anchor bolt configuration in the structural repair process. e J 3' Figure 1: Column to Foundation Connection 1920 Wekiva Way, Suite 00 �.. Our observations and recommendations are based upon conditions visibly evident at the time of our site visit. The conclusions and recommendations do not reflect variations in conditions not visually apparent, or which exist in locations not observed,or which could exist in the future. It is possible that hidden damage or other unknown items of concern remain undiscovered. Kimley-Horn has no responsibility for damages or claims resulting from such hidden damage or unknown items. Response actions are the sole responsibility of the Client and should be conducted in accordance with local, state, and federal requirements, and should be performed by appropriately trained personnel. Any repairs requiring engineering design should be done only pursuant to permitted plans and specifications prepared by licensed professionals. If the Client does not implement any repair recommended by Kimley- Horn, the Client agrees it will not assert any claims in any way related to those conditions for which repair was recommended, and Client will indemnify, defend, and hold harmless Kimley-Horn and its employees from any claim arising out of those conditions. In accordance with Sec. 119.0701, Florida Statutes, CONTRACTOR must keep and maintain this Agreement and any other records associated therewith and that are associated with the performance of the work described in the Proposal or Bid. Upon request from the Village's custodian of public records, CONTRACTOR must provide the Village with copies of requested records, or allow such records to be inspected or copied, within a reasonable time in accordance with access and cost requirements of Chapter 119, Florida Statutes. A CONTRACTOR who fails to provide the public records to the Village, or fails to make them available for inspection or copying, within a reasonable time may be subject to attorney's fees and costs pursuant to Sec. 119.0701, Florida Statutes, and other penalties under Sec. 119.10, Florida Statutes. Further, CONTRACTOR shall ensure that any exempt or confidential records associated with this Agreement or associated with the performance of the work described in the Proposal or Bid are not disclosed except as authorized by law for the duration of the Agreement term, and following completion of the Agreement if the CONTRACTOR does not transfer the records to the Village. Finally, upon completion of the Agreement, CONTRACTOR shall transfer, at no cost to the Village, all public records in possession of the CONTRACTOR, or keep and maintain public records required by the Village. If the CONTRACTOR transfers all public records to the Village upon completion of the Agreement, the CONTRACTOR shall destroy any duplicate public records that are exempt or confidential and exempt from public records disclosure requirements. If the CONTRACTOR keeps and maintains public records upon completion of the Agreement, the CONTRACTOR shall meet all applicable requirements for retaining public records. Records that are stored electronically must be provided to the VILLAGE, upon request from the Village's custodian of public records, in a format that is compatible with the Village's information technology systems. All persons (including SUBCONTRACTORS) assigned by the Contractor to perform work pursuant to the contract. The Contractor acknowledges and agrees that use of the U.S. Department of Homeland Security's E-Verify System during the term of the contract is a condition of the contract with the Village of Tequesta. Contractor further agrees to retain sufficient evidence of their enrollment in the E-Verify System and provide such evidence to the Village of Tequesta upon request. Sufficient evidence shall consist of a printed copy of the completed E-Verify Company Profile page, obtained from https://www.e- verify.gov Contractor also agrees to obtain from each of its subcontractors/subconsultants an affidavit stating that the subcontractor/subconsultant does not employ, contract with, or subcontract with an Unauthorized Alien, as that term is defined in Section 448.095(l)(k), F.S. Contractor further agrees to maintain a copy of any such affidavit from a subcontractor/subconsultant for, at a minimum, the duration of the subcontract and any extension thereof.
