McCollom~~~~ May 27, 2009 PALM BEACH COUNTY SUBSTANCE ABUSE COALITION MOU ~~ Attached for Council approval is a Memorandum of Understanding (MOU) between the Village of Tequesta and the Palm Beach County Substance Abuse Coalition (PBCSAC). By signing the MOU the Village of Tequesta is agreeing to participate in the PBCSAC initiative to combat underage drinking. There are limited activities required of the Police Department. We have participated with PBCSAC on numerous occasions. Until now there was never an MOU, but they require it to receive equipment related to the initiative. The Pafm Beach County Substance Abuse Coalition will supply the Village with two Portable Breath Testing units free of charge, a value of $400.00. Attorney Keith Davis has reviewed the agreement and found it to be of legal form and sufficiency. If you concur, I would request that the agreement is placed on the June 11, 2009 Council agenda. This Agreement between the Palm Beach County Substance Abuse Coalition and the Village of Tequesta Police Department shall be from May 22, 2009 until terminated by mutual written agreement: SERVICES AND RESPONSIBILITIES 2. The Palm Beach County Substance Abuse Coalition shall be responsible to: a. Formulate goals and objectives for the collection and use of Portable Breath Testers data in compliance with Florida law and Village of Tequesta Police Department policy; b. Purchase Portable Breath Testers for indefinite loan to law enforcement agencies including the Village of Tequesta Police Department; d. Train and direct Palm Beach County Substance Abuse Coalition staff and volunteers who are involved with Portable Breath Testing activities and programs; e. In cooperation with the Village of Tequesta Police Department, jointly set goals and objectives for law enforcement, staff and volunteers, and negotiate and approve their activities relative to the use of Portable Breath Testers; f. Create and follow the Underage Drinking Task Force strategic plan within the requirements of its funding; g. Respect the right of law enforcement agencies, including the Village of Tequesta Police Department's members to their own opinions and beliefs. 3. The Village of Tequesta Police Department shall be responsible to: a. Attend a minimum of 7 of Underage Drinking Task Force meetings annually; b. Attend Coalition sponsored Portable Breath Tester Training sessions; 1~Page of c. Participate in reporting and analyzing the use of Portable Breath Testers in the Village of Tequesta; d. Participate in on-going refinement of the Underage Drinking Task Force strategic plan including its vision,. mission, objectives, goals, and activities; e. Maintain the Portable Breath Testing unit provided by the Palm Beach County Substance Abuse Coalition, to include its calibration and the provision of supplies for the duration of the loan; It is understood that the Portable Breath Tester is part of the PBCSAC library and is on indefinite loan to the Village of Tequesta Police Department until mutual written termination of this agreement; g. The unit, if not used by the Village of Tequesta Police Department, will be returned to PBCSAC. CONFIDENTIALITY Both parties agree that they shall be bound by and shall abide by all applicable federal and/or state statutes or regulations pertaining to the confidentiality of client records or information, including volunteers. The parties shall not use or disclose any information about a recipient of the services provided under this Agreement for any purpose not connected with the parties' contract responsibilities, except with the written consent of such recipient, recipient's attorney, or recipient's parent or guardian, or otherwise in accordance with Florida or federal law. AMENDMENT This agreement may be amended by mutual consent of both parties; however, such agreements MUST BE in writing and signed by both parties before a notary. DATED this 19th day of May, 2009.
