RESOLUTION NO. 5-99/00
A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, DESIGNATING THE VILLAGE CLERK AS
THE PERSON RESPONSIBLE FOR SUBMITTING THE
"REPORT OF MINORITY AND PHYSICALLY DISABLED
APPOINTMENTS" TO THE SECRETARY OF STATE, ET
AL, ANNUALLY, BY DECEMBER 1ST, AND AS THE
PERSON RESPONSIBLE FOR RETAINING ALL
APPLICATIONS FOR APPOINTMENTS, PER SECTION
760.80, FLORIDA STATUTES, ON BEHALF OF THE
VILLAGE.
WHEREAS, the Florida Department of State, Division
of Elections, has notified the Village of
certain annual reporting requirements
pursuant to Section 760.80, Florida
Statutes; and
WHEREAS, Section 760.80, Florida Statutes,
requires statutorily created decision
making or regulatory boards, commissions,
councils, or committees to submit a
report titled "Report of Minority and
Physically Disabled Appointments" to the
Secretary of State, et al, annually, by
December lst; and
WHEREAS, the Village Council, as appointing
authority for the Village of Tequesta, is
required to submit said annual Report to
the Secretary of State, the Governor, the
Speaker of the House of Representatives,
and the President of the Senate, and is
required to designate a person
responsible for retaining all
applications for appointment, who shall
ensure that information describing each
applicant's race, ethnicity, gender,
physical disability, if applicable, and
qualifications is available for public
inspection during reasonable hours; and
WHEREAS, the Village Clerk, as a function and
responsibility of the Village Clerk's

WHEREAS, it is in the best interests of the

applications for appointment who shall
ensure that information describing each
applicant's race, ethnicity, gender,
physical disability, if applicable, and
qualifications is available for public
inspection during reasonable hours, per
Section 760.80, Florida Statutes, on
behalf of the Village of Tequesta.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AS FOLLOWS:
Section 1. The foregoing recitals are hereby ratified
and confirmed.
Section 2. The Village Clerk is hereby designated as
the person responsible for submitting the "Report of
Minority and Physically Disabled Appointments" to the
Secretary of State, et al, annually, by December 1St,
and as the person responsible for retaining all
applications for appointment and ensuring that said
information is available for public inspection during
reasonable hours, per Section 760.80, Florida
Statutes, on behalf of the Village of Tequesta.

Section 3. This designation shall be deemed to be a
continuing designation until such time it is revoked
by resolution of the Village Council of the Village of
Tequesta.
Section 4. In order for the Village of Tequesta to
comply with this annual reporting requirement, Village
staff is directed to take the following actions:
i) Amend Tequesta's application for consideration
of appointments to various boards, commissions,
councils, and committees of the Village to
include the descriptive language and information
necessary to comply with the required reporting
data, per Section 760.80, Florida Statutes, as
found in the `Minority Appointment Reporting
Form,' attached hereto as Exhibit "A" and
incorporated by reference as part of this
Resolution; and
ii) Amend the standard Memorandum from Tequesta's
staff to the Village Council relative to
appointments to various boards, commissions,
councils, and committees of the Village to
include a table providing the descriptive
language and information necessary to comply with
the required reporting data, per Section 760.80,
Florida Statutes, as found in the proposed
standard Memorandum, attached hereto as Exhibit
~~B" and incorporated by reference as part of this
Resolution.
Section 5. The Village Clerk is hereby directed to
provide a copy of this Resolution to the Florida
Department of State, Division of Elections.
THE FOREGOING RESOLUTION WAS OFFERED by Councilmember
Schauer who moved its adoption. The motion was
seconded by Councilmember Capretta ,and upon being
put to a vote, the vote was as follows:
