ORDER It is the Order of the Code Enforcement Special Magistrate that the Village of Tequesta may continue to abate the pool violation to keep the premises in compliance (see F.S. 162.09) and to assess the costs of the abatement against the Respondent and to include those costs with the fine assessed herein. It is the Order of the Code Enforcement Special Magistrate that Respondent, PAUL RESTREPO, shall continue to comply with International Property Maintenance Code, Chapter 3, Secs. 302.7, 302.7.1, and 302.4, of the Code of Ordinances of the Village of Tequesta. If the Respondent fails to keep the property in compliance, a fine oftwo-hundred-fifty-dollars ($250.00) per day shall be assessed for each day the violation continues to exist. Respondents shall be assessed two-hundred-twenty-eight-dollars and twelve-cents ($228.12) for administrative costs to be paid by the 6`'' day of October, 2008. A certified copy of this Order may be recorded in the Public Records of Palm Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. Upon complying, it is the responsibility of the Respondent to notify the Village of Tequesta Code Enforcement Clerk at (561) 575-3826 to request a reinspection of the property. Address: 332 River Drive Tequesta, Florida 33469 Legal Description: TEQUESTA LT 94 & W 1/2 OF ABNDED RD R/W A/K/A TEE LANE LYG ELY & ADJ THERETO (PCN:60-42-40-26-01-000-0940) The Special Magistrate appointed by the Village of Tequesta to hear code enforcement cases for the Village of Tequesta, in accordance with Chapter 162, Florida Statutes, has heard testimony at the Code Enforcement Hearing held on the 28t day of August, 2008, and based on the evidence and testimony presented, the following FINDINGS OF FACT, CONCLUSIONS OF LAW, and ORDER are hereby entered: FINDINGS OF FACT 1. The Respondent, RAUL RESTREPO, was not present at the hearing. 2. There was a finding of proper notice in regards to violations of Secs. 302.7 and 302.7.1 of the International Property Maintenance Code, pursuant to the finding that these violations constitute a serious threat to the public health, safety and welfare. In accordance with Florida Statutes, § 162.06(4), the Village made a reasonable effort to notify the Respondent by mailing the notice of violation/hearing to the owner at the address listed in the tax collector's records by UPS overnight and by posting the property on August 26, 2008, the date the violation was discovered and cited. CODE ENFORCEMENT ORDER VILLAGE OF TEQUESTA ORDER FINDING VIOLATION Page 1 of 3 • • 3. The violation of Sec. 302.4 of the International Property Maintenance Code did not constitute a serious threat to the public health, safety or welfare, and, as such, there was a finding of improper notice regarding this violation only. 4. Tequesta Code Enforcement Officer Fitzer testified to and produced photographs of the violations. These photos and the Officer's testimony established that the pool was ridden with algae, frogs, and tadpoles. The fence was broken and could be easily breached by a child or adult and the gate was not self-latching, thereby leaving the unsanitary pool unsecured. The property appears to be abandoned. CONCLUSIONS OF LAW Respondent, Raul Restrepo, is in violation of Sections 302.7 and 302.7.1 of the International Property Maintenance Code as adopted by the Village of Tequesta in its Code of Ordinances. These violations constitute a serious threat to the public health, safety and welfare. ORDER It is the Order of the Code Enforcement Special Magistrate that the Village of Tequesta may abate the violations and assess the costs of the abatement against the Respondent pursuant to Florida Statutes, § 162.09 or any other applicable law. A Fine Assessment Hearing will be held before the Special Magistrate on the 25th day of September, 2008, at 10:00 a.m., at the Village of Tequesta, Code Compliance Division, 345 Tequesta Drive, Tequesta, Florida. Respondent shall be assessed Three Hundred Thirty-One Dollars and fifty-four cents ($331.54) for administrative costs to be paid by the 8th day of September, 2008. Future violations of the aforementioned code sections maybe considered a repeat violation for which a fine of up to five-hundred-dollars ($500.00) per day may be imposed beginning on the date the violation begins. A certified copy of this Order may be recorded in the Public Records of Palm ,Beach County, Florida, and, once recorded, shall constitute a lien against the property of the original amount upon which the violation existed and upon any other real or personal property owned by the Respondent, pursuant to Chapter 162, Florida Statutes for the original amount. GENERAL REQUIREMENTS Section 301. General. 301.1 Scope. The provisions of this chapter shall govern the minimum conditions and the responsibilities of persons for maintenance of structures, equipment and exterior property. 301.2 Responsibility. The owner of the pre- mises shall maintain the structures and exterior property in compliance with these requirements, except as otherwise provided for in this code. A person shall not occupy as owner-occupant or permit another person to occupy premises which are not in a sanitary and safe condition and which do not comply with the requirements of this chapter. Occupants of a dwelling unit are respon- sible for keeping in a clean, sanitary and safe condition that part of the dwelling unit or pre- mises which they occupy and control. 301.3 Vacant structures and sand. All va- cant structures and premises thereof or vacant land shall be maintained in a clean, safe, secure and sanitary condition as provided herein so as not to cause a blighting problem or adversely affect the public health or safety. Section 302. Exterior property areas. 3021 Sanitation. All exterior property and premises shall be maintained in a clean, safe and sanitary condition. The occupant shall keep that part of the exterior property which such occupant occupies or controls in a clean and sanitary con- dition. 302.2 Grading and drainage. All premises shall be graded and maintained to prevent the erosion of soil and to prevent the accumulation of stagnant water thereon, or within any structure located thereon. Exception: Approved retention areas and res- ervoirs. 302.3 Sidewalks and driveways. All side- walks, walkways, stairs, driveways, parking spaces and similar areas shall be kept in a proper state of repair, and maintained free from hazardous con- ditions. § 302 302.4 Weeds. All premises and exterior prop- erty shall be maintained free from weeds or plant growth in excess of 10 inches (254 mm). All noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegeta- tion, other than trees or shrubs provided; how- ever, this term shall not include cultivated flow- ers and gardens. 302.5 Rodent harborage. All structures and exterior property shall be kept free from rodent harborage and infestation. Where rodents are found, they shall be promptly exterminated by approved processes which will not be injurious to human health. After extermination, proper pre- cautions shall be taken to eliminate rodent har- borage and prevent reinfestation. 302.6 Exhaust vents. Pipes, ducts, conduc- tors, fans or blowers shall not discharge gases, steam, vapor, hot air, grease, smoke, odors or other gaseous or particulate wastes directly upon abutting or adjacent public or private property or that of another tenant. 302.7 Accessory structures. All accessory structures., including detached garages, fences and walls, shall be maintained structurally sound and in good repair. 302.7.1 Gates. Gates which are required to be self-closing and self-latching in accordance with the International Building Code shall be main- tained such that the gate will positively close and latch when released fram a still position of 6 inches {152 mm) from the gatepost. 302.7.2 Swimming pools. Swimming pools shall be maintained in a clean and sanitary condition, and in good repair. 302.8 Motor vehicles. Except as provided for in other regulations, no inoperative or unlicensed motor vehicle shall be parked, kept or stored on any premises, and no vehicle shall at any time be in a state of major disassembly, disrepair, or in the process of being stripped or dismantled. Paint- ing of vehicles is prohibited unless conducted inside an approved spray booth.
