ORDINANCE N0. 361
• AN ORDINANCE OF THE VILLAGE COUNCIL OF THE
VILLAGE OF TEQUESTA, PALM BEACH COUNTY,
FLORIDA, AMENDING THE VILLAGE CODE OF
ORDINANCES BY INCLUDING A NEW SECTION TO BE
RELATED TO LOCATION AND SCREENING OF
i DUMPSTERS; PROVIDING REGULATIONS FOR
SAME; AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
TEQUESTA, FLORIDA, as follows:
The Code of Ordinances of the Village of Tequesta is
hereby amended by the addition of a new section, entitled
"Location and Screening of Dumpsters, "to read as follows:
LOCATION AND SCREENING OF DUMPSTERS
Section I: INTENT
The purpose and intent of this section is to provide
regulations for the location and screening of dumpsters for
'~ the enhancement of community amenities of beauty and visual
~, interest and to protect public health, safety and welfare by
promoting refuse and litter control.
Section II. APPLICATION OF REGULATIONS
The regulations provided by this section shall apply
within all zoning districts within the Village of Tequesta,
on properties having or using dumpsters for their sanitation
service. Temporary dumpsters, such as those which are placed
on job sites during construction activity, are not subject
to the provisions of this section.
Section III. REGULATIONS PERTAINING TO DUMPSTERS
1. All dumpsters in the Village of Tequesta shall be
located on the property serviced so as to be reasonably
accessible for trash collection by the sanitation vehicles,
. and shall not be located within the right-of-way of a public
street or alley.
2. All dumpsters shall be screened from public view,
from public streets, and from abutting properties having a
residential zoning district classification.
3. Screening on three (3) sides of the dumpster shall
be erected with access to the dumpster on the fourth side
being obtained by an approved opening. The sufficiency of
the access of the dumpster shall meet the concurrence of the
Village and the franchised sanitation company.
4. Dumpsters are not required to be screened when
placed in the rear setback behind buildings and not in view
of the general public, except when the rear of a commercial
establishment abuts residentially zoned property.
5. Screening shall be opaque in nature and be
constructed in conformity with material approved by the
Standard Building Code. A permit must be obtained from the
Village Building Official prior to the commencement of
construction.

Skip, please check the attached ordinance for
legal sufficiency and make any corrections that should be
made, if any. Please advise as to what date we can expect
to submit the proposed ordinance for first reading before
the Village Council so that we can schedule it as an agenda
item. Also, because the contents of this ordinance are a
mandate from both the Federal Government and the State, is
it required that we advertise this ordinance as a public
hearing.

AMENDING CHAPTER 6. BUILDINGS AND BUILDING
REGULATIONS, ARTICLE VII, PLUMBING, SECTION 6-122,
UNIFORM MINIMUM COUNTYWIDE AMENDMENTS ADOPTED, OF
THE CODE OF ORDINANCES, OF THE VILLAGE OF TEQUESTA,
TO PROVIDE FORM THE ADOPTION OF CERTAIN AMENDMENTS
TO THE UNIFORM, MINIMUM COUNTYWIDE AMENDMENTS TO
THE STANDARD PLUMBING CODE, 1985 EDITION; PROVIDING
AUTHORITY AND PURPOSE; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL OF ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT HEREWITH;
CODIFICATION; PROVIDING AN EFFECTIVE DATEVIDING FOR
WHEREAS, Florida Statutes empower municipalities to
provide for the health, safety and general welfare of its
citizens, including- the enactment
construction and related technical codes anddregulations:1tandf

construction codes, provided that said amendments do no lower
the standards of the minimum code adopted; and

SECTION 1. - Authority

These amendments to the Standard Plumbing Code,
1985 Edition, are being promulgated pursuant tv requirements
put forth by the Federal Government in the 198E amendments to
the Safe Drinking mater Act.
SECTIOtd 3. - Amendments Adopted

SECTION 9. - Severability
If any provision of this ordinance or the
application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this
ordinance which can be given effect without the invalid
provisions or applications and to this end the provisions of
this ordinance are hereby declared severable.
SECTION 5. - Repeal of Laws in Conf 1 ict
All ordinances oc parts of ordinances in conflict
herewith are hereby repealed.
SECTION 6. - Codification
This ordinance shall be codified and made a part of
the official Code of Ordinances of the Village of Tequesta,
Florida.
SECTION 7. - Effective Date
This ordinance shall take effect immediately upon
its gassage and approval, as provided by law.

fittings. Surfaces to be soldered shall be cleaned bright and all
burrs shall be rernaved and the tubing shall be returned to full
bare. The joints shall be properly fluxed and made with approved
