SECTION 4. - Severability
If any provision of this ordinance or the
application thereof is held invalid, such invalidity shall
not affect the other provisions or applications of this
ordinance which can be given effect without the invalid
provisions or applications and to this end the provisions of
this ordinance are hereby declared severable.
SECTION 5. - Repeal of Laws in Conflict
All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
II SECTION 6. - Codif icat ion
This ordinance shall be codified and made a gart of
the official Code of Ordinances of the Village of Tequesta.
Florida.
SECTION 7. - Effective Date
This ordinance shall take effect immediately upon
its passage and approval, as provided by law.
The foregoing ordinance was offered by Council
Member Earl L. Collings who moved its adoption.

and upon being gut to a vote, the vote was as follows:

6. The buffering of the dumpsters shall be of a
material that blends in with the architecture of the
building, when possible. All screening must be a minimum of
four (4') feet high. The height of the dumpster may not
protrude above the screening.
7. All dumpsters must be placed on a hard surface,
the minimum dimensions of which shall be adequate for the
size of the dumpster located there. Inadequate or non-
durable pads shall be the responsibility of the property
owner to repair or replace as needed.
8. In the event the property owner elects to place
gates on the screened dumpster enclosure, the doors must be
kept closed at all times except when the dumpster is being
serviced. The doors must be kept in good repair at the
expense of the owner.
j 9. These regulations cover all existing and future
~ development within the Village of Tequesta. In the case of
~' new development, the location of these dumpsters shall be
shown on the approved site plan.
• 10. All existing non-conforming dumpsters in the Village
of Tequesta shall be in compliance with these regulations no
later than eighteen (18) months from the date of the passage
of the Ordinance.
11. Appeals to the decisions of the Village staff to
these matters may be implemented by the appeal process to the
Board of Adjustment as described elsewhere in the zoning
Ordinance.
Section IV:
VIOLATIONS
Any person violating the provisions of this Ordinance
shall, upon conviction, be subject to the penalties provided
by the General Penalty Provision of the Code of Ordinances of
the Village of Tequesta. Each day that such violation shall
continue shall constitute a separate offense.
Section V: SEVERABILITY

AMENDING CHAPTER 6. BUILDINGS AND BUILDING
REGULATIONS. ARTICLE VII. PLUMBING. SECTION 6-122.
OF THE CODE OF ORDINANCES. OF THE VILLAGE OF
~ TEQUESTA. TO PROVIDE FOR THE ADOFTION OF CERTAIN
' AMENDMENTS TO THE UNIFORM. MINIMUM COUNTYWIDE
AMENDMENTS TO THE STANDARD PLUMBING CODE. 1985
4 EDITION; PROVIDING AUTHORITY AND PURPOSE; PROVIDING
FOR SEVERABILITY; PROVIDING FOR REPEAL OF
ORDINANCES OR FARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.

WHEREAS. Florida Statutes empower municipalities to
provide for the health, safety and general welfare of its
citizens, including the enactment and enforcement of
construction and related technical codes and regulations; and
WHEREAS. Florida Statutes authorize municipalities
to adopt by ordinance, amendments to modify and improve their
construction codes, provided that said amendments do not
lower the standards of the minimum code adopted; and
WHEREAS, the Federal Government has amended the
~~ Safe Drinking Water Act requiring states, through state or
local plumbing codes, to enforce the requirements of
subsection < a> < 1> of the act, "Prohibit ion on use of Lead
i Fipes. Solder and Flux"; and
WHEREAS, the adoption of these amendments will be
f in the public interest by strengthening the standard plumbing
code. 1985 edition, for the health, safety and general
1 welfare of the citizens of the Village of Tequesta; and

WHEREAS, the Village Council of the Village of
Tequesta, sitting as the local planning agency, has
determined, as required by Florida Statutes, that the
proposed amendments to the Standard Plumbing Code. 1985
Edition, are consistent with the adopted comprehensive plan
of the Village of Tequesta.
Now, therefore, be it ordained by the Village
Council of the Village of Tequesta. Florida, as follows:
SECTION 1. - Authority
This ordinance is promulgated pursuant to Chapter
166 and 553. Florida Statutes.
SECTION 2. - Furpose
These amendments to the Standard Plumbing Code.
1985 Edition, are being promulgated pursuant to requirements
put forth by the Federal Government in the 1986 amendments to
the Safe Drinking Water Act.
SECTION 3. - Amendments Adopted
The amendments to the Standard Plumbing Code. 1985
Edition, hereto attached, and as recommended by the Cade
Advisory Board of Palm Beach County. Florida, are hereby
adopted and incorporated herein, as Bart of the minimum
construction cods for the Village of Tequesta. Florida.
